COMMISSIONERS' COURT
REGULAR MEETING
DECEMBER 16, 2003
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos Center in Bryan, Brazos
County, Texas, beginning at 6:30 p.m. on Tuesday, December 16,
2003 with the following members of the Court present:
Randy Sims, County Judge, Presiding;
Eric Caldwell, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns
The Court next considered Budget Amendment #03/04-10.1
through 10.3, which would change accounting procedures for the
Debt Service Fund; transfer funds from Contingency to the
County Clerk-Election; and reallocate funds for the MPO. On
motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered approval of the Assignment and
Assumption of Agreements between College Station Development
Group, L.P. and Donald A. Ball and the City of College Station
and the Research Valley Partnership and Brazos County for the
for the sale of the F. C. Jordan building to Mr. Don A. Ball.
Bob Malaise, representative of the Research Valley
Partnership, presented an overview of the assignment and
stated that F. C. Jordan had not applied for a tax abatement
during the last two (2) years. On motion by Commissioner
Peters, seconded by Commissioner Mallard, the Court voted
unanimously to enter into Assignment and Assumption of
Agreements between College Station Development Group, L.P. and

Donald A. Ball and the City of College Station and the
Research Valley Partnership and Brazos County for the for the
sale of the F. C. Jordan building and authorized the County
Judge to execute the document the Agreement on behalf of
Brazos County. A copy of the Agreement is attached.
The next matter before the Court was authorization for
Use of Project Contingency to complete County Court at Law No.
2 renovations. The Architect is asking to use $863.00 in
contingency funds to complete the courtroom. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the Use of Project
Contingency to complete County Court at Law No. 2 renovations.
The Court next considered approval of Change Order No. 1
for the additions and renovations to Brazos County Courthouse
County Court at Law # 2. The change order changes the
contract as follows:
Unused Contingency Allowance $1,813.00
Unused Graphics Allowance $ 675.00
Total Credit $2,488.00
Extension days from RFP work 6
Extension days for Owners delay 9
Extension Days Total 15
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve Change Order
No. 1.

The next matter before the Court was the approval of the
Eckerd Health Services Sponsor/TPA On-Line Information Access
Agreement and Release. On motion by Commissioner Peters,
seconded by Commissioner Mallard, the Court voted unanimously
to approve of the Eckerd Health Services Sponsor/TPA On-Line
Information Access Agreement and Release. A copy is attached.
The Court next considered renewal of a lease agreement
between Brazos County and S.N.S. Investments, LLC of Brazos
County for rental of office space in the building located at
1904 North Earl rudder Freeway, in Bryan, Texas, for the use
of the Justice of the Peace for Precinct 2 Place 2. Term of
the lease is fort the period of nine months commencing on
January 1, 2004 and ending on September 30, 2004. The County
agrees to pay to S.N.S. Investments, LLC the amount of One
Thousand Five Hundred Eighty Three and 00/100 Dollars
($1,583.00) per month. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to renew the lease agreement between Brazos County and S.N.S.
Investments, LLC for the period stated above. A copy of the
Lease Agreement is attached.
The next matter before the Court was a request by
Constable, Precinct 2 for Cybercom as the Internet provider
for the Fuginet database at a cost of $99.00 per year. On

motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request.
The Court next considered approval of the official bond
of Eric V. Caldwell, newly appointed Commissioner, Precinct 1.
On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to approve the bond.
The next matter before the Court was a request from the
Information Technology Department to generate a Purchase Order
to pay the third year Enterprise Agreement (EA) fee for the
licensing of Microsoft software used by Brazos County. The
base cost of the EA is $111,790.00. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the request.
The next matter for consideration by the Court was a
request submitted by the Information Technology Department
seeking approval for out of state travel for Matthew Pierce to
attend the "BrainShare 2004", training conference in Salt Lake
City, Utah on March 22-26. On motion by Commissioner Cauley,
seconded by Commissioner Caldwell, the Court voted unanimously
to grant the request from the Information Technology Department
and approved payment of out of state travel expense for Matthew
Pierce.

The next matter before the Court was a request by the
Information Technology Department for approval of the renewal
of the following hardware/software support agreements for the
County's network firewall for fiscal year 2004:
a. Firebox 2500 1 year Live Security Subscription $995
b. Firebox SOHO 1 year Live Security Subscription $395
c. 1 year extended warranty for Firebox 2500 $450
On motion by Commissioner Cauley, seconded by Commissioner
Caldwell, the Court voted unanimously to approve the request
in the amount of $1,840.00.
The Court next considered another request from the
Information Technology Department for approval of educational
services to be provided on site by Blinn College. On motion
by Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the request.
The Court proceeded to consider the following blanket
Purchase Orders:

approve the Blanket Purchase Order as submitted.
The next matter for consideration was approval for
the Purchasing Agent to advertise for the following bids:
a. Bid 2004-016, Decking Timbers
b. Bid 2004-017, Bridge Piling

C. Bid 2004-018, Bridge Repairs
On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the Purchasing Agent to advertise for
previously noted bids.
The Court next considered a request by the
Purchasing Department for approval to invoice Mustang
Tractor and Equipment Company for the buy back of two Cat
12H Motorgraders. In December 1999, the Motorgraders
were purchased for $136,512 each with a guaranteed
repurchase price of $117,800 each after 4 years of usage.
Commissioner Caldwell had some questions about the amount
of the buy back. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted
unanimously to approve the request to invoice Mustang
Tractor and Equipment Company for the buy back of two Cat
12H Motorgraders.
The Court next considered a request by the
Purchasing Department for approval of a proposal and
requisition for the design of the Emergency Management
Website. DeMerle Giordano, Emergency Coordinator,
recommended acceptance of the proposal submitted by
Travis Collins in the amount of $2,500.00. On motion by

Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve the proposal and
payment of requisition in the amount of $2,500.00.
The Court next considered an Exemption from
Competitive Bidding Requirements of Local Government
Code, Section 262.024(a)(7)(D). This is for the purchase
of captive replacement parts-Freightliner. On motion by
Commissioner Peters, seconded by Commissioner Caldwell,
the Court voted unanimously to approve the Exemption of
Competitive Bidding Requirements and authorized the
payment for costs incurred during the 2003-2004 fiscal
year.
The next matter before the Court was a request by
the Purchasing Department for approval to dispose of
paper stock and toner cartridges no longer used. On
motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve only the
disposal of the paper stock.
On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to
receive, approve and order filed as submitted the
Treasurer's report for October 2003. A copy of which is
attached to and made a part of these minutes.

The Court next considered the appointment of two
positions to the Brazos County Bail Bond Board. On
motion by Commissioner Cauley, seconded by Commissioner
Caldwell, the Court voted unanimously to appoint
Commissioner Duane Peters and County Court at Law # 2
Judge, Jim Locke. The term of the appointment is January
1, 2004 through December 31, 2004.
The Court next considered approval of the Final Plat
of Nemec Acres, 5.4996 Acres, One Block, Two Lots in
Precinct 4. Richard Vance, County Engineer, stated that
he had reviewed the plat and all appeared to be in order.
On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to
approve the final plat of the Nemec Acres 5.4996 Acres,
One Block, Two Lots as submitted.
The Court next considered authorizing work outside
of county rights-of-way for the health, safety and
welfare of the general public. The Road and Bridge
Department requested permission to enter the private
property of Edsel Jones on I&GN Road in Precinct 1 to
clear a 25 foot strip of land adjoining the proposed new
Jones-Butler Road for the installation of a private water
line and the construction of a common ditch for drainage
purposes. On motion by Commissioner Caldwell, seconded

by Commissioner Cauley, the Court voted unanimously to
authorize the work.
The next matter for consideration was approval of
the attached tax refund applications. On motion by
Commissioner Mallard, seconded by Commissioner Cauley,
the Court voted unanimously to approve the tax refund
applications.
The next matter before the Court was the
consideration of an Addendum to the agenda. The Court
next considered the payment of $1,000.00 to Gene
Zulkowski for property damages during the clearing of the
proposed new Jones-butler Road. The site is located in
Precinct 1. On motion by Commissioner Caldwell, seconded
by Commissioner Peters, the Court voted unanimously to
approve payment to Gene Zulkowski.
Under announcement of interest items and possible future
agenda topics the following spoke:
County Judge
a) Announced that there would be no

Tuesday, December 30, 2003.
Commissioner Mallard
a) Said that they would be discussing the
Tax Freeze Election at the next night
meeting and asked that the Tax
Assessor-Collector be present.

There was no citizen input and/or concerns.
Under Agency/Board/Committee reports by Court members,
the following spoke:
Commissioner Mallard
a. He attended the Bryan Business Council meeting where
one of the topics of discussion was the Brazos
Center.
Commissioner Caldwell
a. Attended a meeting at Easterwood Airport with
representatives of American Airlines to determine
what can be done to attract more service.
County Judge
a. Reported on the Expo Center ETECQ problems have
been solved and are awaiting a permit and
possible ground breaking by Christmas.
There being no further business before the Court,
the meeting was adjourned.

ASSIGNMENT AND ASSUMPTION OF AGREEMENTS
The parties to this Assignment and Assumption of Agreements are College Station Development
Group, L.P. ("Assignor") and Donald A. Ball ("Assignee"). The consenting parties are the City of
College Station, the Research Valley Partnership and Brazos County ("Consenting Parties").
WHEREAS, the Assignor has contemporaneous herewith transferred, sold and conveyed to
Assignee that certain real property ("Real Property") more particularly described on Exhibit A attached
hereto;
WHEREAS, the Assignor desires to assign to Assignee the contracts ("the Contracts") described
on Exhibit B attached hereto.
NOW THEREFORE, in consideration of the foregoing and the agreements and covenants herein
set forth, the sum of TEN AND NO/100 DOLLARS ($10.00), and other good and valuable consideration
paid by Assignee to Assignor, the receipt and sufficiency of which are hereby acknowledged, the
Assignor and Assignee hereby agree as follows:
1. Assignor does hereby ASSIGN, TRANSFER, SET OVER and DELIVER unto Assignee all of
the Contracts, and all of the rights, benefits, privileges, duties and obligations of Assignor
thereunder.
II. From and after the date hereof Assignor shall not be responsible to the Consenting Parties for the
discharge or performance of any duties or obligations which are set forth in the Contracts, and the
Consenting Parties do hereby release and discharge the Assignor from any duties or obligations
set forth in the Contracts.
III. The Consenting Parties do hereby consent to the assignment contemplated herein and the
Consenting Parties do hereby accept the Assignee in the place of the Assignor with respect to all
of the rights, benefits, privileges, duties and obligations of the Assignor under the Contracts.
IV. From and after the date hereof Assignee hereby assumes and agrees to perform all of the terms,
covenants, conditions, duties and obligations of the Assignor under the Contracts. Assignee does
further consent to and agrees to be bound by all restrictive covenants applicable to the Real
Property, including without limitation, the reversionary rights set forth. in that certain General
Warranty Deed dated July 27, 1998, Bryan/College Station Economic Development Corporation
as Grantor and College Station Development Group, L.P. as Grantee, and recorded in the Official
Records of Brazos County, Texas at Volume 3202, Page 108.
V. In consideration of the agreement of the Consenting Parties to consent to the assignment of the
Contracts to the Assignee, the Assignee does hereby agree to the following terms and conditions
which shall be an amendment or modification to the Contracts upon assignment to Assignee:
A. Assignee shall not be a "Qualified Tenant" and shall not occupy any portion of the
leaseable area of the Building.
B. Assignee is simultaneously herewith receiving an assignment from Assignor of the
existing lease in favor of Prodigene, Inc. Assignee does hereby agree to allow a
representative of the City of College Station to review a copy of the lease in favor of
Prodigene, Inc., such review to take place at the offices of Assignee, and the
representative of the City of College Station will not be allowed to make or retain a copy
of the lease. Assignee does further agree that Assignee will not terminate the lease in

favor of Prodigene, Inc. prior to the conclusion of the term of the lease with the exception
of a material default by Prodigene, Inc. in which case Assignee may exercise its rights
under and pursuant to the lease in favor of Prodigene, Inc.
C. The Assignee will exercise its best efforts to immediately market and lease any unleased
portion of the Real Property.
VI. Assignee hereby agrees to indemnify and hold harmless Assignor from and against any and all
loss, cost or expense (including, without limitation, reasonable attorneys' fees) resulting by reason
of Assignee's failure to perform any of the obligations under the Contracts after the effective date
hereof. Assignor hereby agrees to indemnify and hold harmless Assignee from and against any
and all loss, cost or expense (including, without limitation, reasonable attorneys' fees) resulting
by reason of the failure of Assignor to perform any of the obligations of Assignor under the
Contracts prior to the effective date hereof.
VII. All of the covenants, terms and conditions set forth herein shall be binding upon and shall inure to
the benefit of the parties hereto and their respective heirs, executors, administrators, personal
representatives, successors and assigns.
VIII. The terms, conditions, covenants, rights, benefits, privileges, duties and obligations of the
Contracts shall remain in full force and effect, save and except the assignment set forth herein and
the additional terms and conditions to which the Assignee has hereby agreed.

LEASE AGREEMENT
This lease Agreement is made and entered into this 31st day of December,
2003, by and between S.N.S. INVESTMENTS, LLC of Brazos County, herein
called "Lessor," and BRAZOS COUNTY, TEXAS, herein called "Lessee."
In consideration of the mutual covenants and agreements herein set forth, and
other good and valuable consideration, lessor does hereby demise and lease to Lessee,
and Lessee does hereby lease from Lessor, the following described premises located
in Brazos County, Texas:
Office space (approximately 3,540 sq. ft.) in the building located at 1904
North Earl Rudder Freeway, Bryan, Texas 77803, to include electricity, water and
sewer along with restrooms (the "leased premises"). It will also provide handicap
access.
TERM
The term of this lease shall be for a period of nine (9) months, commencing
January 1, 2004 and ending on September 30, 2004. The term of this Lease may be
extended on the termination date hereof for successive one year terms conditioned
upon the County budgeting funds for such lease and payment out of currently
available funds. Such Renewal shall be on the same terms and conditions stated
herein, provided however the parties may agree to change the rental amounts charged
hereunder. Such renewal shall be accomplished by Lessee addressing a letter to the
Lessor at least sixty (60) days prior to the termination date hereof, requesting a
renewal of the Lease. Lessor shall respond within ten (10) days of receipt of such
request by the County.
RENT
Lessee agrees to pay to Lessor as rent for the leased premises the sum of

INDEMNITY AGREEMENT
Lessee agrees to indemnify and hold Lessor and the property of Lessor,
including the leased premises, free and harmless from any and all liability for injury to, or
death of, any person, including employees of Lessee or for damage to property arising from
the use and occupancy of the leased premises by Lessee or from the act or omission of any
person, or persons, including employees of Lessee, in or about the leased premises with the
express or implied consent of Lessee, provided that nothing in this agreement shall expand or
enlarge the liability of Lessee greater than that of Lessee under the Texas Tort Claims Act.
ALTERATIONS AND IMPROVEMENTS
Lessee shall make no alterations to the building on the leased premises nor
construct any buildings or other improvements on the leased premises without first having
obtained the written consent of Lessor.
LESSOR REPAIRS
Lessor shall, at his expense, be responsible for fresh water lines to the building.
Unless otherwise herein provided, all normal repairs, painting and replacements to the inside
of the buildings shall be made at the expense of Lessee which shall surrender the same at the
end of the Lease term or any extension thereof in substantially as good condition as when
received, ordinary wear and tear, damage by fire or the elements and unavoidable casualties
excepted. Lessee shall keep the grass mowed and trimmed around the building.
DESTRUCTION OF PREMISES
Should any building or improvements on the leased premises be damaged or
destroyed by fire, the elements, acts of God, or other causes not the fault of Lessee or any
person in or about the leased premises with the express or implied consent of Lessee, they
shall be repaired or replaced by Lessor at his own cost and expense and the rent payable by
Lessee pursuant to this lease shall be abated to the extent such damage or destruction renders
the leased premises uninhabitable by Lessee. Provided however, should the cost of repairing
or restoring any buildings or improvements so damaged or destroyed exceed twenty-five
percent (25%) of the replacement cost of all buildings and improvements flow located on the
leased premises, or if more than fifty percent (50%) of the total floor space of the leased
premises be rendered unfit for Lessee's occupancy, this lease may be terminated by either
party by ten (10) days written notice. If less than fifty percent (50%) of the total floor space
of leased premises shall be uninhabitable and repair and restoration can be accomplished
within ninety (90) days, Lessor may, at his option, either repair and restore the damaged
buildings and improvements or cancel this lease and return any unearned rent previously paid
by Lessee under this lease.
CONDITION OF PREMISES
Lessee stipulates that the leased premises, as well as all buildings and improvements
located thereon, are at the date of this lease in good order, repair and a safe and clean
condition.

UTILITIES
All charges for electricity, water and other utility services shall be paid by Lessor.
IMPROVEMENTS
All alterations, changes and improvements built, constructed or placed in the leased
premises by Lessee, other than movable personal property, shall, unless otherwise provided
by written agreement between Lessor and Lessee, be the property of Lessor and remain in the
leased premises at the expiration or sooner termination of this lease. Lessee, at the
termination of this lease, shall not be required to restore the improvements to their original
condition. Nothing contained in this paragraph, however, shall authorize Lessee to make or
place any such alteration, change or improvements on the leased premises without having
first obtained the written consent of Lessor.
ASSIGNMENT AND SUBLETTING
Lessee shall not assign this lease nor sublet the leased premises or any interest therein
without first obtaining the written consent of Lessor, which consent shall not be unreasonably
withheld. A consent by Lessor to one assignment or subletting shall not be deemed to be a
consent to any subsequent assignment or subletting. An assignment or subletting without the
written consent of Lessor, shall be void and shall, at the option of the Lessor, terminate the
lease.
LESSEE'S RIGHT TO PERFORM
In the event Lessor violates or fails to perform any provisions or agreements of the
lease to be performed or complies with by Lessor, and such violation or failure continues for
fifteen (15) days after written notice thereof to Lessor, Lessee may, in addition to all
remedies available to it, be entitled to perform on behalf of Lessor and deduct all such
payments from the rent.
DEFAULT BY LESSEE
Should Lessee be in default for a period of more than ten (10) days in the payment of
any rent payable under this lease or in the performance of any other provision of this lease
and such default continues for thirty (30) days after written notice, Lessor may terminate this
lease and regain possession of the leased premises in the manner provided by the laws of the
State of Texas in effect at the date of such default.
HOLD OVER
At the expiration of this lease, should Lessee hold over for any reason whatsoever, it
is hereby agreed that, in the absence of a written agreement to the contrary, such tenancy
shall be from month to month only under the seine conditions and at the same monthly rental
as provided herein.
SUBORDINATION OF LEASE
This lease and Lessee's leasehold interest under this lease are and shall be subject,
subordinate, and inferior to any lien or encumbrance now on the leased premises by Lessor.

RIGHT OF INSPECTION
Lessor and his agents have the right at all reasonable times during the terms of this
lease to enter the leased premises for the purpose of inspecting them an d all buildings an

improvements thereon, provided, however, that the right of inspection shall not exceed to any
record, the disclosure of which is prohibited by law.
PARKING
Ample space will be provided for parking vehicles.
NOTICES
Any and all notices or other communication required or permitted by this lease to be
served on or given to either patty to this lease by the other party hereto shall be in writing and
shall be deemed duly served and given when personally delivered to the party to whom it is
directed, or in lieu of such personal service, when deposited in the United States Mail,
postage prepaid, addressed to Lessor, Carey Smith, TexCon General Contractors, at 1707
Graham Road, College Station, Texas 77845; addressed to Lessee, Brazos County, 300 East
26th Street, Bryan, Texas 77803-5317, until otherwise notified. Either party hereto may
change his address for the purpose of this paragraph by giving written notice of such change
to the other party in the manner provided for in this paragraph.
USE OF OFFICES
The leased premises are to be used as office space for the Justice of the Peace for
Precinct Two (2), Place Two (2) of Brazos County.
LOCATION FOR RENT PAYMENT
Unless changed by written notice pursuant to the provisions in the above heading
under Notices, all rent payable under this lease shall be paid to Lessor at 1707 Graham Road,
College Station, Texas 77845.
ATTORNEY'S FEES
Should any litigation be commenced between the parties hereto concerning the
leased premises, this lease, or the rights and duties of either party in relation thereof, the
party prevailing in such litigation shall be entitled, in addition to such relief as may be
granted, to a reasonable sum as and for his attorney' s fees in such litigation.
TEXAS LAW TO APPLY
This agreement shall be construed under and in accordance with the laws of the State
of Texas and all obligations of the parties created hereunder are performable in Brazos
County.
LEGAL CONSTRUCTION
In case any one or more of the provisions contained in the agreement shall for any
reason be held to be invalid, illegal or unenforceable, it shall not affect any other provision
thereof and this agreement shall be construed as if such invalid, illegal or unenforceable
provision had never been contained herein.

PRIOR AGREEMENTS SUPERSEDED
This agreement constitutes the sole and only agreement of the parties hereto and
supersedes any prior understandings or written or oral agreements between the parties
respecting the within subject matter.
AMENDMENT

unless the same be in writing, dated subsequent to the date hereof, and duly executed by the
parties hereto.

AGREEMENT FOR SERVICES
GENERAL: This AGREEMENT is entered into by and between the Performing Party and the
Receiving Party in consideration of the mutual promises contained herein.
Section I. AGREEING PARTIES
A. The Performing Party: Blinn College, Department of Workforce Education

Section II. TERMS OF AGREEMENT
A. This document shall be considered as a proposal for services until signed by both parties.
B. The term of this Contract shall commence on January 2, 2004 and terminate on September 30,
2004.
C. Responsibility for assuring administrative control, program criteria, and program evaluation will
rest with Performing Party.
D. The Receiving Party agrees to pay for services received as outlined in this AGREEMENT 15
days after receipt of an invoice.
E. The Performing Party agrees to provide those services as outlined in Section IV, STATEMENT
OF SERVICES. Services will be scheduled with the agreement of both parties.
F. The Receiving Party may for any reason delete or cancel any portion of services specified herein
by notifying the Performing Party in writing as long as written notice is received at least 10 days
before the date the services are to be provided. If services are deleted or canceled, and not
rescheduled, payment shall be due for all past services performed including any developmental or
consultant work on or in support of the services deleted or canceled. Such developmental or
consultant work for which Performing Party seeks payment shall be described with specificity in
any invoice presented for such work.
G. Either party has the right to cancel services specified by this AGREEMENT for failure of
the other party to perform in accordance with the terms outlined herein. Such cancellation will not
take effect until 10 days following receipt of the written cancellation notice. Additionally, the
Receiving Party shall have the right to request the Instructor providing the Services herein be
replaced if the Receiving Party is dissatisfied with his performance.
Section III. MAXIMUM EXPENDITURES IN AGREEMENT
The maximum expenditures for services rendered pursuant to this AGREEMENT shall not exceed the
amount in Section V. Charges for services specified within this AGREEMENT are set forth in Section V,
COSTS OF SERVICES.

If additional charges become necessary as the result of the adding of additional classes, the new charges
