THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
OCTOBER 19, 1992, AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM
OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,
BRYAN, TEXAS.

3. Consider and take action on budget amendments.
4. Consider and take action on the appointment of Presiding'
Election Judges and Alternate Presiding Judges.
5. Consider and take action on approval of PCS card for all
Brazos County employees.

for Macy Road right-of-way.
7. Consider and take action on request from Aquila Southwest
Pipeline Corporation to install pipeline in county right-
of-way of Old Mumford Road in Precinct 4.
8. Consider and take action on two (2) variances of minimum

SPECIAL MEETING
OCTOBER 19, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, October 19, 1992, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Absent;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment $91/92-34 and
#92/93-01. Budget Amendment $91/92-34 would reallocate funds
budgeted for the County Clerk's Department, the County
Attorney, Justice of the Peace Precinct 5 and the Jail.
Budget Amendment X192/93-01 would increase the balance in the
Bail Bond Fund in order to refund fees collected since 1985.
On motion by commissioner Turner, seconded by Commissioner
Norton, the Court voted unanimously to approve both budget
amendments as submitted, a copy of each is attached hereto.
On motion by Commissioner Norton, seconded by Commis-
sioner Sims, the Court voted unanimously to appoint the
following persons as presiding judge and alternate judge for
the current voting year at the following voting precincts:

The Court next considered an amendment to the County's
Health Insurance plan. The amendment would provide those
employees enrolled in the deductible plan with Pharmaceutical
Card Sorvices. The PCs card would enable the employees to
purchase generic prescription drugs for $5.00 each and name
brand drugs for $10.00 each. The cost to the county for this
amendment will be $2,470.00 for this plan year. On motion by
Commis-sioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve an amendment to the
County's Health Insurance contract in the amount of $2,470.00.
The next matter for consideration by the Court was an
easement grant conveyed to Brazos County by Sandy McCarty,
Independent Executrix of the Rachel Brunner Estate, as
easement for the purpose of expanding and improving Macey
Road. On motion by Commissioner Norton, seconded by
Commissioner Turner, the Court voted unanimously to accept the
easement grant from Sandy McCarty, Independent Executrix of
the Rachel Brunner Estate.
The Court next considered the request by Aquila Southwest
Pipeline Company to place a road bore in the right-of-way of
Old Mumford Road in order to install a natural gas pipeline.
The site is located in Precinct 4. Accompanying the request
is check number 016170 in the amount of $500.00. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request of Aquila Southwest Pipeline Company
and authorized the installation. A copy of the request is
attached hereto.
The next matter for consideration was a request for two
variances of minimum set back lines and sight triangle

requirements at Dilly Shaw Tap Road and FM 974 intersection.
Holland Winder, County Engineer, that there would be minimal
encroachment on the set back line. On motion by Commissioner
Turner, seconded by Commissioner Norton, the Court voted
unanimously to grant the two variances of minimum set back
lines and sight triangle requirements at Dilly Shaw Tap Road.
The Court received, approved and ordered filed as sub-
mitted the Treasurer's report for September 1992. A copy of
which is attached to and made a part of these minutes.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the changes as
submitted with the exception of the salary increases for
Cheryl Coffman and Ginger Lanehart because those would require
a budget amendment.

Commissioners' Court, the following members were present:

formal notice is hereby given that (Applicant) Aquila Southwest Pipeline Corporation
proposes to place a (type)
pipeline within the right-of-way of (Road) old Mumford
in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.

1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any eAisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing lava.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
Construction of this line will begin on or sfter (date) 10-19-92
