A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, October 12, 1992, with the following members
of the Court present:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first matter before the Court was a request from Mary
Vallejo, Court Coordinator of the 361st District Court, to

commissioners' Court meeting October 6, 1992
address the Court on a matter of salary changes. Mrs. Vallejo
asked the Court about the personnel action form submitted
August 27, 1992 in which Carolyn Ruffino, Judge of the 361st
District Court, requested pay increases for her employees.
The increases would be a 1% increase to put the employees back
on the county pay scale. The total increase would be $886.00
and would not require a budget amendment. Commissioner Sims
explained that he had not understood the intent of Judge
Ruffino and assumed it was a 4% increase that the Judge was
requesting rather than a 1% increase. The County Judge
apologized for the misunderstanding and asked Mrs. Vallejo to
resubmit the personnel action form for consideration.
The Court next considered Budget Amendment #91/92-33,
which would transfer funds budgeted for the Non-Departmental
Department to the Landfill. On motion by Commissioner Norton,
seconded by Commissioner Sims, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
On motion by Commissioner Norton, seconded by Commis-
sioner Turner, the Court voted unanimously to appoint the
following persons as presiding judge and alternate judge for
the current voting year at the following voting precincts:

The Court next considered speed limits on various County
roads. The Commissioners' Court of Brazos County, Texas held
a Public Hearing to consider Traffic Regulation on various
county roads pursuant to Section 2.301 of the County Road and
Bridge Act, Art. 6702-1 subchapter D, Vernons Civil Statutes
in the Commissioners' Courtroom in the Courthouse in Bryan,
Brazos County, Texas, beginning at 9:00 a.m. on Tuesday,
October 6, 1992. On motion by Commissioner Norton, seconded
by Commissioner Turner the Court voted unanimously to adopt
speed limits on the following County roads:
Barron Road - From FM 2154 to State Highway 6:
speed 1 m t shall be set at 35 miles per hour.
Barron Cut-Off Road - From 2154 to Barron Road the
speed limit shall be set at 30 miles per hour.
Britten Road - From Smetana Road to FM 1687 speed
limit shall be set at 45 miles per hour. Curves
(2) - near FM 1687, both directions: 15 miles per
hour Speed Advisory.
Cain Road - From FM 2154 to end of road speed limit
shall be set at 30 miles per hour.
Hardy Weedon Road - From State Highway 30 to Dyess
Road speed limit shall be set at 45 miles per hour.
Curve - Approx. 0.7 miles northeast of State
Highway 30, both directions: 25 miles per hour
Speed Advisory.
Leonard Road - Curve - approximately 0.1 miles
north of Thompson's Creek Bridge: 20 miles per
hour Speed Advisory both directions.
Smetana Road - From State Highway 21 to Britten
Road Speed limit shall be set at 45 miles per hour.
Tonkaway Lake Road - From Bird Pond Road to a point
0.7 miles southeast of Bird Pond Road speed limit
shall be set at 35 miles per hour. From a point
0.7 miles southeast of Bird Pond Road to the end of
Tonkaway Lake Road speed limit shall be set at 35
miles per hour.
BALD PRAIRIE SUBDIVISION:
Renee Lane - From Barron Road to end of Renee Lane
speed limit shall be set at 30 miles per hour.
HOLLOW HEIGHTS SUBDIVISION:
Hollow Heights Drive - From Merka Road through loop
and back to Merka Road speed limit shall be set at
30 miles per hour.
SMETANA FOREST SUBDIVISION:
Caroline Drive - From Smetana Road to cul-de-sac
speed limit shall be set at 30 miles per hour.

Luc Ellen Parkway - From Smetana Road to cul-de-
sac speed limit shall be set at 30 miles per hour.
McDonald Avenue - From Lucy Ellen Parkway to Nonie
Drive speed limit shall be set at 30 miles per
hour.
Nonie Drive - From Smetana Road to McDonald Avenue
the speed limit shall be set at 30 miles per hour.
SEVEN ELEVEN RANCH SUBDIVISION:
Chisolm Trail - From Westward Ho to end of Chisolm
Trail speed limit shall be set at 30 miles per
hour.
Paradise Way - From State Highway 6 South to
Westward Ho speed limit shall be set at 30 miles
per hour.
Westward Ho - From State Highway 6 South to end of
road speed limit shall be set at 30 miles per hour.
The Court next considered the request from Union Pacific
Gathering, Inc. to place a road bore in the right-of-way of
Jones Road 1.2 miles southeast of Leonard Road in order to
install 4.750" of O.D. P.V.C. saltwater pipe line. The
request is accompanied by company draft #116813 in the amount
of $500.00. The site is located in Precinct 4. The County
Engineer stated that all appeared to be in order and recom-
mended approval. On motion by Commissioner Turner, seconded
by Commissioner Norton, the Court voted unanimously to approve
the request of Union Pacific Gathering, Inc. and authorized
the installation. A copy of the request is attached hereto.
The Court next considered the request by Ferguson
Burleson County Gas Gathering System to install an 8.0" steel
gas pipeline in the right-of-way of Old Reliance Road. The
request is accompanied by company draft #3946 in the amount of
$5,570.80. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and recom-
mended approval. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve
the request of Ferguson Burleson County Gas Gathering System
and authorized the installation. A copy of the request is
attached hereto.

The next matter for consideration was the awarding of an
alternate bid for the Annual Hot Mix Asphaltic Concrete
Pavement Contract for the Road and Bridge Department and
authorize the payment thereof. The County Engineer asked that
this be placed back on the agenda in the event the primary
bidder was unable to provide the concrete. On motion by
Commissioner Norton, seconded by Commissioner Wilcox, the
Court voted unanimously to award the alternate bid to
Bluebonnet Paving.
The Court next considered awarding the following bids:

Commissioner Sims questioned claim number 119381 which
was payment to the American Bar Association. He recommended
adopting a policy on the payment of Professional Dues and deny
payment of the claim. He next questioned claim number 119423
for payment to Wheels for Less. The County Judge explained
that this was for an educational trip for the juveniles cur-
rently held in detention. On motion by Commissioner Norton,
seconded by Commissioner Turner, the Court voted unanimously
to approve the claims with the exception of claim number
119381.

On this the 12th day of October 1992 at a special meeting of the
Commissioners' Court, the following members were present:

The location or description of the proposed Installation Is more fully shown by
3 copies of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to designate the actual location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way In accordance
with governing laws.
8. That the line or lines will be constructed no less than forty-elght Inches (48") lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (7) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open ph be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or 840 00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698: test
shall be conducted by an Independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) October 1, 1992

proposes to place a (type) 8" Steel Pipeline
