THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
SEPTEMBER 28, 1992, AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM
OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,

for the enhancement of county road projects.

SPECIAL MEETING
SEPTEMBER 28, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, September 28, 1992, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1, Absent;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendments #91/92-30 and
#91/92-31. Budget Amendment #91/92-30 would reallocate funds
budgeted for the Jail, Data Processing, Buildings and Yards
and Juvenile Services. Budget Amendment #91/92-31 would
increase the budget of the Juvenile Services Department to
defray expenses incurred by order of the Juvenile Courts. On
motion by Commissioner Sims, seconded by Commissioner Wilcox,
the Court voted unanimously to approve the two budget amend-
ments as submitted, a copy of each is attached hereto.
The Court next considered two requests for tax refunds
from PMAC LTD. Per Court ordered settlement, the appraisal of
one track was reduced from $1,871,900 to $1,600,000 and the
other track from $1,735,000 to $1,400,000. On motion by
Commissioner Sims, seconded by the County Judge, the Court

voted unanimously to refund $1,472.63 and 1,196.36 in county
taxes for 1991 to PMAC, LTD as requested.
The Court next considered the request by Wickson Creek
Special Utility District to place a road bore in the right-of-
way of Rustic Oaks Drive in order to install a water line to
provide service to county residents. The site is in Precinct
3. The County Engineer stated that all appeared to be in
order and recommended approval. On motion by Commissioner
Sims, seconded by Commissioner Turner, the Court voted
unanimously to approve the request of Wickson Creek Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the enhancement of county road
projects. The Road and Bridge Department submitted two
requests. The first for permission to enter the private

property of M. S. Kavanaugh on Dowling Road to pile and burn
brush and trees cleared from N. Dowling Road right-of-way.
The second request was for permission to enter the private
property of Jerry Bullin off Rabbit Lane for the purpose of
hauling water to be used for road work. On motion by
Commissioner Sims, seconded by Commissioner Turner, the Court
voted unanimously to authorize the work.
The Court next considered awarding the following bids:

On this day this cause came on for trial and came the
Plaintiff, PMAC, LTD., by and through it's attorney of record and
also came the Defendant, BRAZOS COUNTY APPRAISAL DISTRICT, by and

announced ready for trial, all matters of fact and law were

The parties announced to the Court that they had reached a
final settlement regarding the appraised value of the property
which is the subject of this cause. The parties have agreed that

j having reviewed the terms of the settlement is of the belief that
i it should be in all ways approved, accordingly;
IT IS ORDERED, ADJVDdED AND DECREED that:
1. The appraised value placed by the Brazos County Appraisal
District and the Brazos County Appraisal Review Board upon
Plaintiff's property, described in Plaintiff's Original petition
is hereby canceled and set aside.
2. The Court hereby fixes the appraised value for
Plaintiff's property for the year 1991 as follows:

On this day this cause came on for trial and came the
Plaintiff, PMAC, LTD., by and through it's attorney of record and
also came the Defendant, BRAZOS COUNTY APPRAISAL DISTRICT, by and
through their attorney of record, and all parties having
announced ready for trial, all matters of fact and law were
submitted to the Court.
The parties announced to the Court that they had reached a
final settlement regarding the appraised value of the property
which'is the subject of this cause. The parties have agreed that

it should be in all ways approved, accordingly;
IT IS ORDERED, ADJUDGED AND DECREED thatt
1. The appraised value placed by the Brazos County Appraisal
District and the Brazos County Appraisal Review Board upon
Plaintiff's property, described in Plaintiff's Original petition
is hereby canceled and set aside.
2. The Court hereby fixes the appraised value for
Plaintiff's property for the year 1991 as follows:

Formal notice is hereby given that Wickson Creek Special Utility District
(Applicant), proposes to place a road bore
W As the right-of-way of Rustic Oaks Drive, Lot 5 Block 3 (name of
road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after the 28th day of
September , 1992 .
