COMMISSIONERS' COURT
SPECIAL MEETING
AUGUST 31, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, August 31, 1992, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first matter before the Court was consideration of
the premium rates for medical insurance for Brazos County
employees. Those rates are as follows:

On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to approve the rates for
group health insurance coverage for full time County employees
and retirees.
The Court next considered the following orders relating
to the 1992 General Election.
1. Order Relocating One Temporary Early Voting
Location
2. Order Authorizing Mobil Voting In The 1992
General Election
3. Order Combining Certain Voting Precincts And
Polling Places
On motion duly made and seconded, the Court voted unanimously
to adopt the Orders, all of which are attached to and made a
part of these minutes.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to appoint the following
persons as presiding judge and alternate judge for the current
voting year at the following voting precincts:

It was noted that there were some vacancies but that those
will be filled shortly.
On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to appoint ion
Miller, Jim James, Brooks Cofer and Ann Braniff to the Law
Library Committee. This committee will review the volumes in
the library and make recommendations on which to continue and
which to discontinue.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to participate in the

activities of the High-Speed Rail Committee of the Count
Judges and Commissioners Association of Texas and appoin

Randy Sims as the representative of this county to serve on
the committee.
The Court next considered a request from Justice of th
Peace Precinct 7 Place 1, George Boyett, for a computer syste
to automate dockets, files, cash receipts correspondence
warrants and required reports. The approximate cost of th
system will be seven thousand dollars ($7,000.00). The
Director of Data Processing informed the Court that the
software had been requested in the 1993 budget. On motion by
the County Judge, seconded by Commissioner Wilcox, the Court
voted unanimously to approve the request of the Justice of the
Peace.
The Court next considered the designation of the County
Judge as a representative for the Texas Community Development
Program and adoption of a Resolution authorizing application
for a grant to provide first time water service to the Cawthon
Community in southwest Brazos County. Such grant to be in the
total amount of $210,867 all to be state funded. Wellborn
Water Supply Corporation will provide $22,100 in-kind
services. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the County Judge to make application on behalf of Brazos
County to the Texas Department of Housing and Community
Affairs and accept on behalf of Brazos County such grant funds
as may be tendered. A copy of the resolution is attached
hereto.
The Court next considered awarding the following bid:
Bid No. 92-632 - Vehicle Lease Agreement
Cheryl Turney, Purchasing Agent, recommended _
acceptance of the bid submitted by Capps Van & Car
Rental. On motion by Commissioner Norton, seconded
by Commissioner Turner, the Court voted unanimously
to accept the recommendation of the Purchasing
Agent and award the contract to Capps Van & Car
Rental. A copy of the bid is attached hereto.
The next matter for consideration was approval to

Commissioners' Court meeting August 31, 1992
advertise for bids for one (1) standard one half ton pickup

truck for the Sheriff's Office - Bid No. 91-603. Both Commis-
sioners Norton and Wilcox suggested the Purchasing Agent
modify the specifications and request bids for a three quarter
ton pickup truck. On motion by commissioner Norton, seconded
by Commissioner Wilcox, the Court voted unanimously to
authorize the Purchasing Agent to advertise for bids on a
three quarter ton pickup truck.
The Court next considered two requests by GTE Southwest.
The first one, to install buried cable within the right-of-way
of McCullough Road beginning at its intersection with FM 2154
and continuing in a northeasterly direction for a distance of
1,976.0 feet to replace existing cable in the route. The site
is in Precinct 1. The second one, to install buried cable
within the right-of-way of walnut Road beginning at its
intersection with Dowling Road and continuing for a distance
of 979.0. The site is in Precinct 1. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to approve the
request of GTE Southwest and authorized the installation. A
copy of the request is attached hereto.
The Court next considered entering into a lease agreement
with Robert Henry Moore for land to be used for a citizen's
collection station for non hazardous waste material in
accordance with Section 325.21-325.24, Texas Department of
Health, Municipal Solid Waste Management Regulation. The site
is located approximately 300 feet east of the intersection of
Dilly Shaw Tap and FM 2038 on the southwest side of FM 2038.
Brazos County agrees to pay the lessor one thousand two
hundred dollars ($1,200) annually in advance. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court
voted unanimously to enter into a lease agreement between
Brazos County and Robert Henry Moore. A copy of the lease
agreement is attached.

Commissioners' Court meeting August 31, 1992
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department submitted two (2)
requests. The first for permission to enter the private
property of Lee Widdison off Hollow Heights Drive in Hollow
Heights Subdivision for the purpose of cleaning out an
existing channel to improve drainage from a culvert under the
roadway. The site is located in Precinct 3. The second
request was for permission to enter the private property of
Sammy Catalena off Chick Lane to clear the fence line and a
sight distance and to stock pile materials (gravel) for Chick
Lane. The site is located in Precinct 4. on motion by
Commissioner Wilcox, seconded by Commissioner Turner, the
Court voted unanimously to authorize the work.
The Court proceeded to consider the change of status of

ORDER RELOCATING ONE TEMPORARY EARLY VOTING POLLING PLACE

WHEREAS, the Commissioners Court of Brazos County, Texas
has established four temporary branch early voting polling places
in various locations in Brazos County; and
WHEREAS, the Commissioners Court is desirous of coming in
early compliance with Senate Bill 1234 requiring locating one
temporary branch early voting polling place in each Commissioner;
and
WHEREAS, the Commissioners Court is desirous of
relocating the temporary branch early voting polling place from the
Santa Teresa Catholic Church located at 1212 Lucky Street in Bryan
to the Arena Hall located at 2904 Tabor Road in Bryan to become in
compliance with Senate Bill 1234;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, THAT:
Pursuant to section 85.062(d)(2) as amended by Senate
Bill 1234 that one temporary branch early voting polling place be
established in each Commissioner Precinct in Brazos County; and
THAT there shall be four temporary branch early voting
polling places established in Brazos County to wit:
(1) THAT the temporary branch early voting polling place
located in the Santa Teresa Catholic Church located at 1212 Lucky
Street, Bryan, Texas be relocated in the Brazos County Arena Hall,
2904 Tabor Road in Bryan, Texas; and
(2) THAT the temporary branch early voting polling place
located in Galilee Baptist Church located at 804 North Logan
Street, Bryan, Texas remain as established on September 10, 1990;
and

(3) THAT the temporary branch absentee early voting
polling place located in the Memorial Student Center located on the
Texas A&M University campus, College Station, Texas remain as
established on December 18, 1989; and
(4) THAT the temporary branch early voting polling place

Building located at 1812 Welsh Street, College Station, Texas
remain as originally established on December, 1989; and
(5) THAT early voting at the for early voting polling
places is to be conducted Monday through Friday from 8:00 A.M. to
5:00 P.M. beginning on October 14, 1992 and ending on October 30,
1992; and
(6) THAT submission be made to the Assistant Attorney
General, Civil Rights Division, Voting Section, Department of
Justice, Washington D. C. requesting the preclearance of this order
pursuant to Section 5 of the Federal Voting Rights Act.

ORDER AUTHORIZING MOBILE VOTING IN THE 1992 GENERAL ELECTION
WHEREAS, Jim James representing the Democratic Party of Brazos

County has officially requested that the Commissioners Court of Brazos
County authorize Mobile Voting during the period for early voting for
the citizens of Brazos County; and
WHEREAS, Jim James requested that three temporary Mobile
Voting locations be established in Brazos County, Texas; and
WHEREAS, Jim James requested that temporary mobile voting locations
be established and early voting be conducted in the Appletree Grocery
Store located at 2000 State Highway 21 East, Bryan, Texas, in the
Walmart Store located at 3113 Texas Avenue,. Bryan, Texas and in the
Post Oak Mall located at Harvey Road and State Highway 6 By-pass in
College Station, Texas; and
WHEREAS, Jim James has requested that Mary Ann Ward the County
Clerk establish the dates and hours for conducting early voting in the
Appletree Grocery Store, the Walmart Store and the Post Oak Mall; and
WHEREAS, Mary Ann Ward has designated the dates and time for
early voting at Appletree Grocery Store located at 2000 State Highway
21 East to be Thursday, October 15, 1992 and Friday October 16, 1992
between the hours of 9:00 A.M. and 4:00 P.M. and Wednesday, October 28,

for early voting will encourage greater voter participation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF
BRAZOS COUNTY, TEXAS, THAT:
Pursuant to sections 85.061, 85.062, 85.063, 85.064 and 85.065
of the Texas Election Code that there shall be three temporary mobile
voting locations be established in Brazos County for the purpose of
conducting early voting to wit:
(1) THAT one temporary mobile voting location be established
in the Appletree Grocery Store, located at 2000 State Highway 21 East,
Bryan, Texas; and
(2) THAT one temporary mobile voting location be established
in the Walmart Store located at 3131 Texas Avenue, Bryan, Texas; and
(3) THAT one temporary mobile voting location be established

ORDER COMBINING CERTAIN VOTING PRECINCTS AND POLLING PLACES
WHEREAS, the Commissioners Court of Brazos County, Texas
As charged by Section 42.001 of the Texas Election Code to divide
the county into convenient election precincts; and
WHEREAS, the Commissioners Court by order dated December
16, 1991 divided the county into seventy-five election precincts to
conform to the newly adopted county commissioner and justice of the
peace and constable precincts and the newly adopted congressional
boundary line; and
WHEREAS, this action created a number of election
precincts which contain few or no registered voters; and
WHEREAS, House Bill No. 2 (Acts of the 72nd Legislature,
3rd called Special Session) Section 3(a) authorizes the
Commissioners Court to consolidate election precincts with less
than two hundred registers voters or twenty-five percent of the
maximum number of registered voters prescribed by the Texas
Election Code Section 42.006; and
WHEREAS, Section 3(a) of House Bill No. 2 has been
precleared by letter dated March 10, 1992;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, THAT:

(1) Pursuant to House Bill No. 2, section 3(a) as passed
by the 72nd Legislature certain election precinct that contain less
than 200 registered voters or a maximum of twenty-five percent of
those allowed by the Texas Election Code be combined to wit:

(a) Election precincts 2 and 82 be consolidated
and will vote at the Wellborn Community Center
located at 4119 Greens Prairie West, College
Station;
(b) Election precincts 4 and 79 be consolidated
and will vote at Kemp school located at 1691 West
Mumford Road, Bryan;

and will vote at the Courthouse Annex, 202 East

(k) Election precincts 42, 60 and 77 be
consolidated and will vote at Wesley Methodist
Church, 4205 North Texas Avenue, Bryan;
(1) Election precincts 45, 19, 66 and 81 be
consolidated and will vote at the Arena Hall, 2904
Tabor Road, Bryan;
(m) Election precincts 53, 54, and 55 be
consolidated and will vote at the Brazos County
Courthouse, 300 East 26th Street, Bryan;
(n) Election precincts 28, 58, 59, 71, 73, and 83
be consolidated and will vote at Holly Cross
Lutheran Church, 1200 Fox Fire Drive, College
Station;
(2) THAT all other election precincts will vote at the
location designated at the time the new election precincts were
formulated by order dated December 16, 1991 to conform to the newly
adopted commissioner precincts, justice of the peace and constable
precincts and the newly adopted congressional boundary lines, and;
(3) THAT submission be made to the Assistant Attorney
General, Civil Rights Division, Voting Section, Department of
Justice, Washington D. C. requesting the preclearance of this Order

RESOLUTION
C
WHEREAS, the State of Texas has created the Texas High-Speed
Rail Authority and granted it broad authority to implement the
high-speed rail project; and
WHEREAS, the proposed route of this project will have a
substantial impact upon the citizens and property of this county
and the essential services provided by the county; and
WHEREAS; there is great concern whether the interests of this
County and its citizens will be appropriate considered by the
Authority and the State of Texas; and
WHEREAS, the County Judges and Commissioners Association of
Texas has proposed the creation of a special committee of affected
counties to insure the proper consideration of these issues; and
WHEREAS, participation on this committee would be beneficial
to the County and its citizens; now
Therefore be it resolved and Ordered that Brazos County shall
participate in the activities of the High-Speed Rail Committee of
the County Judges and Commissioners Association of Texas and
RANDY SIMS is hereby designated as the
representative of this County to serve on the Committee.

A RESOLUTION OF THE COUNTY COMMISSIONERS OF THE COUNTY OF BRAZOS
AUTHORIZING THE SUBMISSION OF A TEXAS COMMUNITY DEVELOPMENT PROGRAM
APPLICATION TO THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS
FOR THE COMMUNITY DEVELOPMENT FUND; AND AUTHORIZING THE COUNTY JUDGE
TO ACT AS THE COUNTY'S EXECUTIVES OFFICER AND AUTHORIZED
REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE COUNTY'S
PARTICIPATION IN THE COMMUNITY DEVELOPMENT PROGRAM.
WHEREAS, the County Commissioners of the County of Brazos desire to
develop a viable rural community, including decent housing and a
suitable living environment and expanding economic opportunities,
principally for persons of low/moderate income; and
WHEREAS, certain conditions exist when represent a threat to the
public health and safety; and
WHEREAS, it is necessary and in the best interest of the County of
Brazos to sponsor an application on behalf of the Wellborn Water
Supply Corporation for funding under the 1992 Texas Community
Development Program;
NOW THEREFORE BE IT RESOLVED:
1. That a Texas Community Development Program application for
the Community Development Fund is hereby authorized to be
filed on behalf of the Wellborn Water Supply Corporation
with the Texas Department of Housing and Community Affairs.
2. That the County's application be placed in competition for
funding under the Community Development Fund.
3. That the application be for $ 210,867 of grant funds to
carry out Wellborn Water Supply Corporation water system
improvements and water distribution expansion.
.4. That the County Commissioners Court directs and designates
the County Judge as the County's Chief Executive Officer and
Authorized Representative to act in all matters regarding
this application and the County's participation in the Texas
Community Development Program.
5. That is further be stated that the Wellborn Water Supply
Corporation is-committing $ 22,100 of in-kind services as a
contribution toward the construction activities of this
water distribution system project.

Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
Texas as follows:
Beginning at the junction of McCullough Road and FM 2154, 1976'
of buried cable will be placed northeast at approximately 5'
within the northern right-of-way of McCullough Road. This replaces
existing cable in the route.
The proposed cable will be buried to a minimum depth of 30".
The location and description of this line and associated appurtenances is more fully shown
by four copes of drawings attached to this notice. The ' -i- will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is exprt, ;Iy understood that tender of this nonce
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may

THIS LEASE AGREEMENT, made and entered into this 10th day of
August , 1992 , with effective date of August 10, 1992 , by
and between Robert Henry Moore, "Lessor", and BRAZOS COUNTY, "Lessee".
That for and in consideration of the covenants, agreements and
stipulations herein contained, Lessor does hereby lease unto Lessee and
Lessee does hereby take, rent, and buy from Lessor for the term and upon the
terms and conditions hereinafter set out, location for Citizens' Collection
Station for non-hazardous waste material in accordance with Section 325.21-
325.24, Texas Department of Health, Municipal Solid Waste Management
Regulations, Exhibit "A" (attached).
Site is located approximately 300 feet in an easterly direction
along the southwest right-of-way line of FM 2038 from the most southerly
right-of-gray line of Dilly Shaw Tap Road and is lying and situated in the E.
Seale Survey, Abstract No. 224, Tract No. 8 and being approximately one (1)
acre tract of land.
Lessee agrees to pay to Lessor upon receipt of statement and without
twelve hundred
deduction for setoff whatsoever, the sum of UM(XE("(1Xdc1Xf(XXK% dollars
($1200.00)annually in advance.
It is agreed and understood that this lease may be terminated by
either party by the giving to either party written notice of intention to do
so, in which event the term of this lease shall end.
IN WITNESS WHEREOF, Lessor and Lessee have caused this lease to be

SUBCHAPTER B. Municipal Solid Waste Storage.
{ 325.21 Applicability. This subchapter shall be applicable to all public and
private storage systems. Additional requirements for storage of hazardous wastes
are contained In 325.271 • 325.350 -of this title (relating to Hazardous Waste .
Management).
{ 325.22 Storage Requirements. All solid' waste shall be stored is such a manner....
that it does not constitute a fire, safety, or health hazard or provide food or
harborage for animals and vectors, and shall, be contained or bundled so as not to, `
result in litter. It shall be the responsibility of the occupant of a residence or the
owner or manager of an establishment to utilize storage containers of an
adequate size and strength, and In sufficient numbers,'to contain all solid waste
that the residence or other establishment generates in the period of time between
collections.

{ 325.23 Approved Containers. All solid waste containing food wastes shall be
stored in covered or closed containers which are leakproof, durable, and designed
for safe handling and easy cleaning.
(1) Nonreusable Containers. Nonreusable containers shall be of suitable
strength to minimize animal scavenging or rupture during collection operations.
(2) Reusable Containers. Reusable containers shall be maintained in a .
clean condition so that they do not constitute a nuisance and to retard the'
harborage, feeding, and propagation of vectors.
(A) All containers to be emptied manually shall be capable of being.
serviced without the collector coming Into physical contact with the solid waste.
(B) Containers to be mechanically handled shall be designed to
prevent spillage or leakage during storage, handling, or transport.
{ 325.24 Citizens' Collection Stations. Citizens' collection stations should be
provided with the typo and quantity of containers compatible with the areas to
be served. Rules should be posted governing the use •of the facility .to include "
who may use it, what may or may not be deposlted, eta The responsible county
or municipal government shall provide for the eollection'of deposited waste on a
scheduled basis and supervise the facility In order to maintain It In a sanitary-
condition.
