THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
AUGUST 24, 1992, AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM
OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,
BRYAN, TEXAS.
1. Invocation.
2. Pledge of Allegiance.
3. Consider and take action on budget amendments.
4. Consider and take action on the appointment of Presiding
Election Judges and Alternate Presiding Judges.
5. Consider and take action on final report for medical in-
surance for Brazos County.
6. Consider and take action on Agreement for Administrative
Services between Thompson, Derrig & Slocacek and Brazos
County in regard to Section 125 Cafeteria Plan.
7. Consider and take action on request from Wickson Creek
Special Utility District to install waterlines in the
following county rights-of-ways:.

COMMISSIONERS' COURT
SPECIAL MEETING
AUGUST 24, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, August 24, 1992, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #91/92-26,
which would reallocate funds budgeted for the Sheriff's Office
and transfer money from the Non Departmental Department to the
Data Processing Department to pay for training and software.
On motion by Commissioner Turner, seconded by Commissioner
Norton, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to appoint the following
persons as presiding judge and alternate judge for the current
voting year at the following voting precincts:

It was noted that there were some vacancies but that those

Commissioners' Court meeting August 24, 1992
will be filled shortly.
It was the consensus of the Court to table consideration
on the final report for medical insurance for Brazos County.
On motion by Commissioner Norton, seconded by Commis-
sioner Sims, the Court voted unanimously to enter into an
agreement for administrative services with Thompson, Derrig &
Slovacek P.C. for the administration of the County's Section
125 Cafeteria Plan. The term of the plan is from September 1,
1992 through August 31, 1993. A copy of the agreement is
attached hereto.
The Court next considered two requests by Wickson Creek
Special Utility District. The first request is for a road
bore in the right-of-way of Dilly Shaw Tap Road for the
purpose of providing service to a county resident. The site
is located in Precinct 2. The second request is for a road
bore in the right-of-way of Elmo Weedon Road for the purpose
of providing service to a county resident. The site is in
Precinct 3. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Sims, seconded by Commissioner Turner, the Court
voted unanimously to approve the requests of Wickson Creek
Special Utility District and authorized the installations. A
copy of each request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requests permission
to enter the private property of Mrs. Jim O'Brien at the
corner of Bird Pond Road and Frost Drive to dispose of excess
material from county road right-of-way. The site is located
in Precinct 1. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the work.

On this the 24th day of August 1992 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;

The following proceedings were held:
• THAT WHEREAS, on August 24, 1992, the Court heard and approved
a budget amendment for the 1991-1992 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 3,
1991, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

AGREEMENT FOR ADbUNISTRATIVE SERVICES

This agreement dated June 19, 1992 specifies the services to be provided to Brazos
County, hereinafter referred to as "County" in the ongoing administration of the County's
Section 125 Cafeteria Plan, and the specified responsibilities of the County. The effective
date of this agreement will commence with the Plan year beginning September 1. 1991

The Company shall be the Plan Administrator and Thompson, Derrig & Slovacek,
P.C., hereinafter referred to as the "Administrative Firm" shall be engaged as a
subcontractor in the performance of administrative services for the plan
Administrative services to be provided by Administrative Firm
1. Prepare and conduct one seminar to explain the Cafeteria Plan to the
employees.
2. Provide participant election forms to be used during the enrollment process.
3. Process initial enrollment forms and revocation forms to initiate the
administration function
4. Provide each participant with a Reimbursement Claim Booklet and
instructions for filing claims.
5. Provide reimbursement checks to employees on a bi-weekly
basis.

6. Provide a check register for all checks printed on a bi-weekly basis.
7. Provide each participant a Statement of Account on each flex check
8. Provide bi-weekly worksheets for reconciling payroll amounts redirected to
the Cafeteria Plan
9. Provide forms to the County for use by the County in communicating
participant terminations and changes of family status.
10. Provide annual child care statements of participant.
11. Provide annual preparation of Form 8500.
12. Provide participant election forms at the end of each year for use in making
elections for the following years.

1. Present informational seminar to the employee group.

1. Report participant terminations and changes of family status to
Administrative Firm to be effective 2 weeks after receipt.
2. Reconciliation of payroll amouni redirected to the Cafeteria Plan based on
reports provided bi-weekly by Administrative Firm.
3. Distribution of checks and participant statements of account to County
employees.
4. Provide Administrative Firm with blank check stock for use in preparing
reimbursement checks.
6. Actual signing of reimbursement checks.
6. Initiate any action required in the event plan(s) become discriminatory.
Fees and Terms of Payment
At each reimbursement period we will prepare a check from your "Flex" account
for the amount of our fee for that period. The County will remit that check to the
Administrative Firm upon receipt.
The fee schedule is attached as Exhibit A. The Administrative Firm has the right
to change the fee schedule by giving at least 60 days notice to the County.
Reports and Data
All reports and data remain the property of the County. Administrative Firm will
provide the County all data, upon request, in the electronic or printed format used
by Administrative Firm in its administration procedures.

In the event the County wishes to self-administer the Cafeteria Plan, Thompson,
Derrig & Slovacek, P.C., a professional corporation of Certified Public Accountants
in Bryan, Texas will sell to the County the software written to administer the
Cafeteria Plan at the price in effect at that time. Any time required to train
company personnel will be charged at our normal per diem rates.
Terms of the Agreement
This agreement will be effective from the date both parties execute this agreement
until it is terminated. Either party can terminate this agreement with 60 days written
notice.

Formal notice is hereby given that _Wickson Creek Special Utility
District (Applicant), proposes to place a road bore
the right-of-way of Dilly Shaw Tap Road (name of
road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the 1 ine will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (21) below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after the 24 day of
August , 19
