Consider and take action on request from Bar Association for increase in court filing fees for Law Library. 4. Consider and take action on budget amendments. 5. Signing of a Proclamation designating July 8, 1992 as Brazos County Blood Day. 6. Consider and take action on rescinding Resolution in regard to the increases of filing fees and County Courts at Law salaries in Brazos County. 7. Consider and take action on request from GTE to install cable in the following county rights-of-ways: a. Elmo Weedon Road - Precinct 3 b. Higgs Drive - Precinct 4 8. Consider and take action on request from Fairview Smetana Water Supply Corporation to install waterline in county right-of-way of Fazzino Road in Precinct 2. 9. Consider and take action on Final Plat of Kensail Point, Nantucket Phase II Subdivision in Precinct 1. 10. Consider and take action on personnel change of status. 11. Z- PAGE-.~ ~i I• i COMMISSIONERS' COURT SPECIAL MEETING JULY 6, 1992 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, July 6, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Carol Palmer Bea Green Rhonda Seaton Rosalie Todaro A. H. Winder Karen McQueen Jim Hiney Anne Friedenberg Tom Riehm Tyler Moore Executive Assistant Admin. Asst. to County Judge Secretary to Commissioners Auditor's Office Auditor's Office County Engineer County Clerk's Office Bryan/College Station Eagle KBTX-TV KBTX-TV Bar Association Commissioner Sims gave the invocation and led the pledge r of allegiance. The first matter before the Court was a request by Tyler Moore, President of the Brazos County Bar Association, asking the Court to increase the fee for the Law Library to $20.00 per case from the current $7.50. This is necessary to continue funding the Law Library. . Mr. Moore said that a committee of four (4) local attorneys will do an inventory of the current volumes, see what is used most and determine what can be sold. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the increase to $20.00 on Civil cases effective immediately. The Court next considered Budget Amendment #91/92-21, which would reallocate funds budgeted for the District Clerk's Department. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve i i f • n Commissioners' Court meeting July 6, 1992 the budget amendment as submitted, a copy of which is attached hereto. • The County Judge read aloud a Proclamation designating Wednesday, July 8, 1992 as "Brazos County Blood Day." The Court joins with the local Red Cross Chapter to encourage people to donate so that blood is available in sufficient quantities to meet the needs of all hospital patients. on motion by Commissioner Norton, seconded by Commissioner Turner, the Court moved to proclaim Wednesday, July 8, 1992 as "Brazos County Blood Day" throughout Brazos County. The County Judge then presented the signed Proclamation to Mrs. Rhonda Seaton, representing the local Red Cross Chapter. The Court next discussed the Resolution adopted on May 26, 1992 which would provide the mechanism for judicial salary supplementation and authorized the collection of $20.00 filing fee for Civil cases and $10.00 for each criminal conviction in County Court at Law. The Court received an Attorney General's Opinion stating that the collection of these fees was uncons- titutional. On motion by The County Judge, seconded by Commissioner Norton, the Court voted unanimously to rescind the Resolution increasing the filing fees in the County Courts at law and the salaries of the County Court at Law Judges. The Court next considered two (2) requests by GTE Southwest. The first to install a buried cable within the right-of-way of Elmo Weedon Road beginning 1.0 miles from its t ' S; intersection with Highway 30 for a distance of 177 feet in a southwesterly direction in Precinct 3. The second to install a buried cable within the west right-of-way of Higgs Drive 4- beginning at its intersection with FM 1688 for a distance of 330 feet, then continuing north within the west right-of-way • bore across private asphalt drive and then continue north for a distance of 86 feet in Precinct 4. The County Engineer stated that all appeared to be in order and recommended ,E approval. on motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve Vol. Z T~L x, t Commissioners' Court meeting July 6, 1992 the requests of GTE Southwest and authorized the installations. A copy of each request is attached hereto. The Court next considered the request by Fairview Smetana Water Supply Corporation to bore across the right-of-way of Fazzino Lane to install a 1.5 inch water line in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Fairview Smetana Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the final plat of Kensail Point, a replat of Lot 2, Block 13, Nantucket Subdivision Phase II in Precinct 1. Holland Winder, County Engineer, stated that he had reviewed the plat and it appeared to be in order. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court unanimously approved the final plat of Kensail Point. I understand and agree that: 1. The County Engineer must be notified 72 hours prior to the beginning of construction in order that he or his designated inspector may inspect the actual installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of ;he County Engineer. 3. That Brazos County reserves the right to require Applicant to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That Brazos County will in no way be responsible for any damage which might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the County right- of-way in accordance with governing laws. 6. That the line or lines will be constructed no less than twenty-four inches (24") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all sites will be barricaded during the construction period. Construction of this line will begin on or after the 29th day of June , 19 92.
