TEXAS COMMISSIONERS' COURT SPECIAL MEETING JUNE 29, 1992 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, June 29, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Carol Palmer Bea Green Rhonda Seaton Cheryl Turney A. H. Winder Ron Huddleston Jim Hiney Anne Friedenberg Tom Riehm Robert L. Payne, Jr. Charles Brenton III Fred Patterson Executive Assistant Admin. Holster and Associates, Inc. Patterson Architects Commissioner Sims gave the invocation and led the pledge of allegiance. The Court first considered Budget Amendment 191/92-20, which would transfer funds from the Unreserved Fund Balance to the Appellate Judicial Fund in order to pay the County's assessed cost the Appellate Court and transfer funds from the budget of the Justice to the Peace Precinct 4 Place 2 to Justice of the Peace Precinct 7 Place 1. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered an Order appointing James A. Amis, Jr. to sit as Special Judge in County Court at Law II on July 6, 1992 and on August 17, 1992. Judge Ryan has requested personal leave time in July and she will be in mandatory VOL 7- P GA-& • i i i Commissioners' Court meeting June 29, 1992 continuing legal education in August. on motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the Order naming James A. Amis, Jr. as Special Judge for County Court at Law II for the dates of July 6, 1992 and August 17, 1992. A full copy of the Order is attached to and made a part of these minutes. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(7)(A). This is for the purchase of Saber walkie- talkies, mobile radio and radio adaptor from Motorola. The Commissioners' Court determined that this was a single source supplier. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for said cost not to exceed the amount of $16,350.00. The Court next reconsidered action taken at the Commissioners' Court meeting of June 22, 1992 in which Ferguson Burleson County Gas Gathering System had requested permission to install a pipeline in the county right-of-way of Linda Lane in Precinct 3. Commissioner Sims expressed concern about having an 8" steel pipeline going through a highly populated area when there were alternate routes available. He also stated that the road, Linda Lane, was not made to handle the traffic that would travel the road to do the installation. He then suggested sending Ferguson Burleson County Gas • Gathering System a letter requesting that they find an alternate route. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to rescind the prior approval of the request of Ferguson Burleson County Gas Gathering System. Commissioner Wilcox then asked for the cost on the complete rebuilding of the road. The County Engineer asked if he was to include that portion that was within the city limits of College Station. Commissioner Sims said yes. On motion by Commissioner Sims, seconded by PAGE .2-7- t T, Commissioners' Court meeting June 29, 1992 Commissioner Norton, the Court voted unanimously to reject the request of Ferguson Burleson County Gas Gathering System and return their draft no. 3884 in the amount of $3,103.20. The Court next considered the request by Union Pacific Texas Gathering, Inc. to install an 8" P.V.C. saltwater pipeline within the right-of-way of Jones Road in Precinct 4. The request is accompanied by draft no. 116118 in the amount of $1,785.45 representing payment for paralelling the right- of-way 44.64 rods. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Union Pacific Texas Gathering, Inc. and authorized the installation. A copy of the request is attached hereto. The Court next considered plans for the vacated museum space at the Brazos Center. Fred Patterson, Architect, presented drawings for the space and explained the need to increase the mechanical equipment and the electrical system so that equipment can be run simultaneously. Also included would be floor covering in the new area. Commissioner Sims mentioned that two (2) other areas needed recarpeting. The County Judge said he felt that could all be done at one time and that this could be an alternate bid. The County Judge then moved to proceed with the plans and to go out for bids on the project. Commissioner Sims seconded the motion and it carried unanimously. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to enter into contract with Patterson Architects for the renovation of the museum space at the Brazos Center. A copy of the contract is attached. The Court next considered the request by Ferguson Burleson County Gas Gathering System to install an 8" steel gas pipe line across the right-of-way of High Prairie Road approximately 1.4 miles south of its intersection with FM 2154 in Precinct 1. The request is accompanied by draft no. 3927 V O L__7_ wAG E__9_U Commissioners' Court meeting June 29, 1992 in the amount of $500.00 representing payment for road • crossing only. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Ferguson Burleson County Gas Gathering System and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by GTE Southwest to install a buried cable within the right-of-way of Turkey Creek Road beginning at the intersection with FM 60 going north to include two (2) road bores under Turkey Creek Road and to extend along the right-of way of F&B Road ending' at the College Station city limits in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, • seconded by Commissioner Norton, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court proceeded to consider the change of status of the following employees. Contractor to Provide Performance and Payment Bonds. The County Engineer must be notified prior to the beginning of construction in order that they night be on hand to designate the actual location of the installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. That BRAZOS COUNTY reserves the right to require Applicant to relocate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-Nay. 4. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any eAisting utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of way in accordance with governing laws. 6. At this point, GTE will bore West under Turkey Creek Rd. from ditch line to ditch line for 68' minimum of 5' under road bed and place cable from ROW to ROW to GTE STA 9+03. Then proceeding North 5' within and parallel to the Western most ROW to GTE STA 25+60. Then proceeding North 5' within and parallel to the Eastern most ROW to GTE STA 30+58.
