SPECIAL MEETING
JUNE 29, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, June 29, 1992, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered Budget Amendment 191/92-20,
which would transfer funds from the Unreserved Fund Balance to
the Appellate Judicial Fund in order to pay the County's
assessed cost the Appellate Court and transfer funds from the
budget of the Justice to the Peace Precinct 4 Place 2 to
Justice of the Peace Precinct 7 Place 1. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered an Order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law II on
July 6, 1992 and on August 17, 1992. Judge Ryan has requested
personal leave time in July and she will be in mandatory

continuing legal education in August. on motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the Order naming James A. Amis,
Jr. as Special Judge for County Court at Law II for the dates
of July 6, 1992 and August 17, 1992. A full copy of the Order
is attached to and made a part of these minutes.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(7)(A). This is for the purchase of Saber walkie-
talkies, mobile radio and radio adaptor from Motorola. The
Commissioners' Court determined that this was a single source
supplier. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to approve the
Exemption of Competitive Bidding Requirements and authorized
the payment for said cost not to exceed the amount of
$16,350.00.
The Court next reconsidered action taken at the
Commissioners' Court meeting of June 22, 1992 in which
Ferguson Burleson County Gas Gathering System had requested
permission to install a pipeline in the county right-of-way of
Linda Lane in Precinct 3. Commissioner Sims expressed concern
about having an 8" steel pipeline going through a highly
populated area when there were alternate routes available. He
also stated that the road, Linda Lane, was not made to handle
the traffic that would travel the road to do the installation.
He then suggested sending Ferguson Burleson County Gas
•
Gathering System a letter requesting that they find an
alternate route. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to rescind
the prior approval of the request of Ferguson Burleson County
Gas Gathering System. Commissioner Wilcox then asked for the
cost on the complete rebuilding of the road. The County
Engineer asked if he was to include that portion that was
within the city limits of College Station. Commissioner Sims
said yes. On motion by Commissioner Sims, seconded by

Commissioner Norton, the Court voted unanimously to reject the
request of Ferguson Burleson County Gas Gathering System and
return their draft no. 3884 in the amount of $3,103.20.
The Court next considered the request by Union Pacific
Texas Gathering, Inc. to install an 8" P.V.C. saltwater
pipeline within the right-of-way of Jones Road in Precinct 4.
The request is accompanied by draft no. 116118 in the amount
of $1,785.45 representing payment for paralelling the right-
of-way 44.64 rods. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the request of Union
Pacific Texas Gathering, Inc. and authorized the installation.
A copy of the request is attached hereto.
The Court next considered plans for the vacated museum
space at the Brazos Center. Fred Patterson, Architect,
presented drawings for the space and explained the need to
increase the mechanical equipment and the electrical system so
that equipment can be run simultaneously. Also included would
be floor covering in the new area. Commissioner Sims
mentioned that two (2) other areas needed recarpeting. The
County Judge said he felt that could all be done at one time
and that this could be an alternate bid. The County Judge
then moved to proceed with the plans and to go out for bids on
the project. Commissioner Sims seconded the motion and it
carried unanimously.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to enter into contract with
Patterson Architects for the renovation of the museum space at
the Brazos Center. A copy of the contract is attached.
The Court next considered the request by Ferguson
Burleson County Gas Gathering System to install an 8" steel
gas pipe line across the right-of-way of High Prairie Road
approximately 1.4 miles south of its intersection with FM 2154
in Precinct 1. The request is accompanied by draft no. 3927

in the amount of $500.00 representing payment for road

crossing only. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of Ferguson Burleson
County Gas Gathering System and authorized the installation.
A copy of the request is attached hereto.
The Court next considered the request by GTE Southwest to
install a buried cable within the right-of-way of Turkey Creek
Road beginning at the intersection with FM 60 going north to
include two (2) road bores under Turkey Creek Road and to
extend along the right-of way of F&B Road ending' at the
College Station city limits in Precinct 4. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Turner,

seconded by Commissioner Norton, the Court voted unanimously
to approve the request of GTE Southwest and authorized the
installation. A copy of the request is attached hereto.

Attorney General's opinions. The County Judge said we had
not. On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to approve the
Claims as submitted.
There being no further business to come before the Court,
the meeting was adjourned.

Commissioners' Court, the following members were present:

THAT WHEREAS, on June 29, 1992, the Court heard and approved
a budget amendment for the 1991-1992 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 3,
1991, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

WHEREAS, the Honorable Sarah Ryan, Judge of the County Court
at Law No. 2 of Brazos County, Texas, having made known to the
Commissioners Court of Brazos County, Texas, that on July 6, 1992
she wishes to take personal leave and on August 17, 1992 she will
be in mandatory continuing legal education; and
WHEREAS, she has requested the appointment of the Hon. James
A. Amis, Jr. to sit as Special Judge of the County Court at Law
No. 2 of Brazos County, Texas on July 6, 1992 and August 17, 1992
in all matters that are, or may be, docketed on the Court's dockets
for those days, and to have and exercise all powers of a Special
Judge in relation to matters involved, it is therefore:
ORDERED, ADJUDGED AND DECREED, pursuant to the authority of
Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.
James A. Amis, Jr., sit and hear all matters that are, or may be,
docketed on any of the Court's dockets on the above-mentioned days
and shall have and exercise all powers of such Special Judge in
relation to the matters involved;
WHEREAS, the Court having considered the proposed order and
deeming that it should be approved; it is therefore:

5.6 Subject co the provisions of the Contact Documrnts, the amount of each progress payment shall be computed as follows:

FINAL PAYMENT

Final payment, constituting the entire unpaid balance of the Contract Sum, shall be made by the owner to the Contractor when (1)
the Contract has been fully performed by the Contractor
-Work as provided In Subparagraph 12.2.2 of the General Conditions and to satisfy other acquirements, if any, which necessarily
survive final payment; and (2) a final Certificate for Payment has been Issued by the Architect such final payment shall be made by
the owner not more than 30 days after the issuance of the Architect's final Cerdricate for Payment, or as follows: *and approved

" in no event shall final payment be required to be made prior to thirty (30) days
after all work on the Contract has been fully performed. Defects in the work
discovered prior-to final payment shall be treated as non-conforming work and
shall be corrected by the Contractor prior to final payment and not trued as

ADDENDUM TO AIA DOCUMENT
A101 (1987 EDITION)

Article 7.3.1. Contractor to Provide Performance and Payment Bonds. WITHIN FIVE (5)
DAYS AFTER EXECUTION OF THE CONTRACT DOCUMENTS AND PRIOR TO
THE COMMENCEMENT OF ANY OF THE WORK, Contractor shall furnish to Owner
and keep in force throughout the effectiveness of this Contract a statutory performance
bond and statutory payment bond in the amount of the Contract Sum set forth,in Article
4 hereof, covering faithful performance of this Contract and the payment of all obligations
arising in connection therewith, free of liens upon the Project. The bonds shall name
Owner as an obligee and shall be in such form and with such sureties as Owner may
reasonably approve. Should the surety on such bonds become insolvent or be put into
receivership during the term of this Contract, Contractor shall promptly notify Owner
thereof and shall be obligated to obtain replacement bonds within ten (10) days after
receiving notice of such event, at Contractor's cost, provided that Contractor shall be
entitled to receive any rebate-in premium from the prior surety, if any, and Owner shall
receive credit therefor, unless and to the extent such rebate exceeds the cost of the
replacement bonds.
Article 7.3.2. Notices. Any notice provided or permitted to be given under the Contract
Documents must be in writing and may be served by depositing same in the United States
mail, addressed to the party to be notified at the address set forth on page one (1) hereof,
postage prepaid, registered or certified, return receipt requested, or by delivering the same
in person to such party, or by private receipted courier guaranteeing same-day or next-day
delivery. Notice given by mail as herein provided shall be deemed given and received on
the earlier to occur of (i) actual delivery t a ess of the named addressee, whether
or not refused or receipted for, or (ii) the• lay following deposit with the United
States Postal Service, postage prepaid, packaged and properly addressed as herein provided.

2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves tits right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should some
become necessary due to widening or lowering, or other alteration of tits
roadway or right-of-way.
4. That BRAZOS COUNTT is in no way responsible for any damage that might
occur to any eyisting utility lines in tits right-of-way.
5. That the line will be constructed and maintained on tits county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below tits center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling tits roadway established by tits Commissioners' Court on

ATTENTION COUNTY JUDGE:
Formal notice Is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road In Brazos County,
Texas as follows:
Beginning at the intersection of FM_60 and Turkey Creek Rd., GTE STA0+00 in
the Eastern most ROW of Turkey Creek Rd and plow cable North 5' within and
parallel to the ROW to GTE STA8+03. At this point, GTE will bore West under
Turkey Creek Rd. from ditch line to ditch line for 68' minimum of 5' under
road bed and place cable from ROW to ROW to GTE STA 9+03. Then proceeding
North 5' within and parallel to the Western most ROW to GTE STA 25+60. At
this point GTE will bore East under Turkey Creek Rd. from ditch line to ditch
line for 66' a minimum of 5' under road bed and place cable from ROW to ROW
to GTE STA 26+60. Then proceeding North 5' within and parallel to the Eastern
most ROW to GTE STA 30+58. Then turning in a Northern direction on to F&B
-Road in the Eastern most ROW of F&B Road then proceed North 5' within and
parallel to said ROW to GTE STA 48+23 and stop at City of College St City Limits.
The location and description of this line and associated appurtenances is more fully shown
by four copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice
by the GTE Soutnwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after July 5. 1g_2
