SPECIAL MEETING

JUNE 15, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, June 15, 1992, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1, Absent;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave
the invocation and led the pledge
of allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held March 30, 1992 and April 6,
1992. On motion by Commissioner Sims, seconded by Commis-
sioner Wilcox, the Court voted unanimously to approve the
minutes as submitted.
The court next considered Budget Amendment #91/92-18,
which would reallocate funds budgeted for the Road and Bridge
Department and transfer money from the Non Departmental
Department and the General Fund Revenue to the office of
• Justice of the Peace Precinct 7 Place 2 and Juvenile Services.

On motion by Commissioner Turner, seconded by Commissioner
Sims, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.

Commissioners' Court meeting June 15, 1992
The Court next considered a request from Data Processing
to purchase hardware for the software conversion. Marijane
Deen, Department Head of Data Processing, recommended
acceptance of the proposal submitted by MicroAge in the amount
of $9,676.00. Although not the lowest proposal submitted,
Mrs. Deen stated it was the best and fastest equipment using
32 bits for transferring information as compared to the lowest
proposal which uses 16 bits. On motion by the County Judge,
seconded by Commissioner Wilcox, the Court voted unanimously
to accept the recommendation of the Head of Data Processing
and accept the proposal submitted by MicroAge. A copy of the
proposal is attached hereto.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to approve the request of
Justice of the Peace Precinct 7 Place 1 to move Barbie Lewis
from the supervision and budget of Justice of the Peace
Precinct 4 Place 2 to that of Justice of the Peace Precinct 7
Place 1 and to be effective with the beginning of the next pay
period. This involves no increase in cost to the county and
better utilizes the position.
The Court next considered a request from Justice of the
Peace Precinct 5 for an increase in his salary. Judge
Dobrovolny stated that with the realignment of Justice of the
Peace Precinct lines he had assumed greater duties. On motion
by Commissioner Turner, seconded by Commissioner Sims, the
Court voted unanimously to approve the request of Justice of
the Peace Precinct 5 and increase his salary to $32,773.00
annually. This will require a budget amendment.
The next matter for consideration was approval to
advertise for bids for a van for jail operations Bid No. 92-
629. On motion by Commissioner Sims, seconded by Commissioner
Turner, the Court voted unanimously to authorize the
Purchasing Agent to advertise for bids for a van for jail
operations.

Commissioner Turner, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Normangee Tractor.
The Court next considered two requests by Clajon Gas
Company. The first to install a 6" natural gas pipeline
within the right-of-way of Bird Pond Road in Precinct 3. The
request is accompanied by draft no. 014358 in the amount of
$5,392.00 representing 134.8 rods. The second to place a 6"
4 road bore under to right-of-way of Bird Pond Road in Precinct

3. The request is accompanied by draft no. 014359 in the
amount of $500.00 representing road crossing only. The

County Engineer stated that all appeared to be in order and
• recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Wilcox, the Court voted unanimously
to approve the request of Clajon Gas Company and authorized
the installation. A copy of each request is attached hereto.
The Court next considered three requests by GTE
Southwest. The first to install a buried cable under and
along the right-of-way of Clear Lake Road in Precinct 3. The
second to install buried cable and to replace existing cable
along the right-of-way of Tonkaway Lake Road beginning
approximately 4, 280' from it intersection with Bird Pond Road

for a distance of 724' in Precinct 3. The third to install
buried cable along the right-of-way of Cotrone Road beginning
from its intersection with FM 50 for a distance of
approximately 1,000' in Precinct 4. The County Engineer
• stated that all appeared to be in order and recommended
approval. On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court voted unanimously to approve the
three requests of GTE Southwest and authorized the
installation. A copy of each request is attached hereto.
The Court next considered the request by Brushy Water
Supply Corporation to install a 1" waterline within the right-
of-way of Kemp Road, 1.4 miles south of its intersection with
State Highway 60. Brushy Water is requesting permission to
open cut the road due to an existing waterline location. The
site is in Precinct 4. The County Engineer explained that a
cut was better because the main was on the shoulder of the
road. He also stated that all appeared to be in order and
• recommended approval. On motion by Commissioner Turner,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Brushy Water Supply Corporation and
authorized the installation with the stipulation that the
contractor compact the road. A copy of the request is
attached hereto.
The Court next considered authorizing work outside of

county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of Jack Horton on Hardy Weedon
Road in Precinct 3 to clear out trees from the right-of-way,
reshape the road back slope and rebuild a fence after the work
is completed. The second request is to enter the private
property of Morgan Cook, Jr. on Hardy Weedon Road in Precinct
3 to dispose of trees removed from the Hardy Weedon road
right-of-way for down stream channel improvements. On motion
by Commissioner Sims, seconded by Commissioner Turner, the
Court voted unanimously to authorize the work.

THAT WHEREAS, on June 15, 1992, the Court heard and approved
a budget amendment for the 1991-1992 budget year for Brazos County,
Texas.

meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 3,

Formal notice is hereby given that (Applicant) Claion Gas Company. L. P.
proposes to place • t e Natural Gas
pipeline within the right-of-way of Road Bird and
in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.
(Applicant) Claion Gas Company, L. P. , understand and agree that:
1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and-rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any egisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
Construction of this line will begin on or after (date) June 8. 1992

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
Kurt en, Texas as follows:
Beginning .3 of a mile northeast of the intersection of Clear Lake Road and
Wickson Lake Road, we propose to bore under Clear Lake Road. We propose
to pull cable through the bore and place a buried line along parallel to •
and 5' inside of the south right-of-way a distance of 3429' in a northeasterly
direction. At this point, we propose to bore under Clear Lake Road and pull
through the proposed cable to the north right-of-way.
The location and description of this line and associated appurtenances is more fully shown
by four copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after August 1, 9 9 2

Formal notice is hereby given that GTE SOUTHWES1 INCORPORATED will construct a communication line

as follows:
Beginning at a point approximately 4280' southeast of the function
of Tonkaway Lake Road and Bird Pond Road, 724' of buried cable will
be placed southeast at 5' within the westerly right-of-way of Tonkaway
Lake Road. This cable is to follow the proposed right-of-way line from
the Brazos County road widening plans to replace existing cable in
the area.
The proposed cable will be buried to minimum depth of 30".
The location and description of this line and associated appurtenances Is more fully shown
by four copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.

I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.

2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
i and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
