VOL Z PAGE ,7-06 COMMISSIONERS' COURT SPECIAL MEETING • MAY 26, 1992 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, May 26, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: • Ruth McLeod Carol Palmer Bea Green Rosalie Todaro Cheryl Turney A. H. Winder Sandie Walker Donald Royder Reagan V. Brown Ralph Record Executive Assistant Admin. Asst-'to County Judge Secretary to Commissioners Auditor's Office Auditor's Office County Engineer Treasurer Brazos County Resident Brazos County Resident S&R Farmers Commissioner Sims gave the invocation and led the pledge of allegiance. The first matter before the Court was the presentation of the Charter Membership Plaques to representatives of the Brazos County Adopt A Road Program. Plaques were presented to S & R Farms representative, Ralph Record and Tom Sistrunk, and Smetana Community representative, Reagan Brown. These two • groups represent a total of 3.25 miles that are being cleaned along Woodville Road and Britten Road. The'number of active groups is now seventeen (17) with a total of 39.61 miles being cleaned. The number of chartered groups now totals twenty one (21). The Court next considered approval of the minutes of the Commissioners' Court meetings held March 3, 1992, March 9, 1992 and March 16, 1992. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to - . , . I . Commissioners' Court meeting May 26, 1992 4 approve the minutes as submitted. The Court next considered Budget Amendment #I91/92-16, which would reallocate funds budgeted for the 361st District Court, the Community Support Department and establish a Records Management and Preservation Fund in the amount of $27,000. The new fund required by the State. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. It was the consensus of the Court to table consideration of a Resolution setting new fees to be charged for the licensing of cats and dogs in Brazos County until all the figures are submitted for review. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve i the request of Constable Precinct 4, Louis Garcia for the transfer of vehicle #63 from the inventory of Sheriff's Department to the inventory of Constable Garcia. Constable Garcia is forfeiting a vehicle for this one. The next matter before the Court was the abandonment of a section of Live Oak Street in the Wellborn Community. Commissioner Norton referred to a plat of Wellborn Community dated 1894 or 1899 which shows the section of Live Oak Street that is being considered for abandonment. He explained that this action meets the requirements as set forth in Article 6702-1 note 318 which states a road can be discontinued if "there has been a vacation or non-use for a period of three years". Commissioner Sims asked if the adjoining landowners had access to a road. Commissioner Norton assured him that they did. Commissioner Wilcox recommended getting a letter s from the adjacent landowners agreeing to this action. Commissioner Sims then recommend sending a certified letter, i return receipt requested to the adjacent landowners advising them of the action taken by the Court this day. On motion by i ! The County Judge informed the members of the Commissioners' Court that at the end of today's meeting, he will recess the meeting until 4:00 p.m. when the Court will consider HB66 which provides for the collection of certain court fees to increase the salary of the County Court at Law Judges. Traf. Task Force Claims-10098-thru-10129- On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to approve the Claims as submitted. The County Judge recessed the meeting until Tuesday May 26, 1992, 4:00 p.m. at which time the Court will consider HB66 which will increase County Court at Law Judges' salaries funded by the state and increase filing fees in county courts. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2 Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Asst. to County Judge Bea Green Secretary to Commissioners Sarah Ryan Judge, County Court at Law #2 Patricia Meronoff Bruchez and Goss The County Judge reconvened the meeting and the Court began consideration of HB66 which would increase County Court at Law Judges' salaries to be funded by the state and increase filing fees in county courts. The County Judge briefly explained HB66 in which an additional twenty dollar ($20.00) filing fee in certain civil cases and a ten dollar ($10.00) court cost on conviction of any criminal offense will be used by the state to compensate statutory county court judges according to Sections 25.0005 and 25.0015 of the Government Code. The County Judge asked what would happen if the Court no longer wished to participate. Patricia Meronoff, legal counsel, stated that the Court must annually submit a Resolution stating a wish to participate If at any time the Court no longer wishes to participate in the plan they would simply not submitted a Resolution. After lengthy discussion and on motion by Commissioner Norton, seconded by Commissioner Turner the Court voted unanimously to adopt a Resolution pursuant to HB66 to collect VOA Z PAGE ! is. Commissioners' Court meeting May 26, 1992 for a period of twelve months beginning July 1, 1992, a fee of $20.00 in each civil case filed and $10.00 for each criminal conviction had in a County Court at Law and to increase the • salary of the Judges of the County Courts at Law by $20,000.00. A copy of the Resolution is attached to and made a part of these minutes. The original will be forwarded to the State Comptroller's Office. TEXAS 496114 ~T orr,T~ORDER ON THIS the 26th day of May, 1992, came to be heard a petition from an interested Brazos County resident to abandon live Oak Street in the community of Wellborn, the same lying between and dividing the Adam Royder Lodge, the Wellborn Baptist Church and that property being owned by the Royder family and being used to traverse the distance between Church Street and McCollough Road; and the Court having heard testimony and finding that the abandonment would not deprive abutting landowners of ingress or egress from their property, or would cause a depreciation in value to such abutting property; and it being determined such petition should be granted; it is therefore ORDERED that said request be approved and that the said Live Oak Street be and is hereby abandoned, closed and vacated. IT IS FURTHER ORDERED, pursuant to Article 6702-1 Vernon's Texas Civil Statutes, that title to the property comprising Live Oak Street shall vest, to the center line of said road, in'those persons owning record title to the property abutting said road on the date of this Order. r-A !Y ~s Y EXECUTED THIS 2 t2 day of hdyqr 1992. Holmgreen 07 VOL 7--PAOE !?.s 1 Z - , IN THE CONNISSIONERB COURT • of BRAZOS COUNTY, TEXAS RESOLUTION: WHEREAS, H.B. 66, effective October 1, 1991, provides for an increase in the jurisdiction of all statutory county courts in Texas, including the County Courts at Law of Brazos County; and WHEREAS, H.B. 66, provides a mechanism for judicial salary supplementation by the State of Texas to the County through the collection for a twelve month period of a $20.00 civil filing fee and a $10.00 cost for certain criminal convictions, other than a conviction arising under any law that regulates pedestrians or the parking of motor vehicles; and WHEREAS, H.B. 66 requires adoption of a resolution by Commissioners Court to collect such fees and cost; it is r THEREFORE RESOLVED by the Commissioners Court of Brazos County, Texas that the Clerks of the County Courts at Law of Brazos County, Texas shall, pursuant to H.B. 66, collect for a period of twelve months beginning July 1, 1992, a fee of $20.00 in each civil case filed and $10.00 for each criminal conviction had in a County Court at Law, other than a conviction arising under any law that regulates pedestrians or the parking of motor vehicles; and be it FURTHER RESOLVED that a certified copy of this resolution be filed with the Comptroller of Public Accounts of the State of Texas not later than June 1, 1992.
