On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the minutes as submitted. ' The Court next considered Budget Amendment #91/92-13, which would reallocate funds budgeted for the Adult Probation + Department. Such grant to be in the total amount of $44,976, one hundred percent (100%) to be state funded. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to authorize the County Judge to make application on behalf of I Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. The Commissioners Court of Brazos County convened in • • regular session, open to the public on April 13, 1992, at the meeting place designated in the notice and the roll was called of the members, to wit: R. J. Holmgreen, County Judge and the following Commissioners: Gary Norton, Walter Wilcox, Randy Sims and Milton Turner. All members of the Court were present constituting a quorum. Whereupon among other business, the following was transacted at the Meeting a written resolution entitled: RESOLUTION AUTHORIZING AND DIRECTING THE SUBSTITUTION OF CERTAIN SECURITIES HELD UNDER AN ESCROW j AGREEMENT AND OTHER MATTERS was duly introduced for the consideration of the Court and read in full. It was then duly moved by the County Judge and seconded by Commissioner Turner f that the Resolution be finally passed and adopted; and after due discussion, such motion, carrying with it the adoption of the Resolution prevailed and carried by the following vote: YES: 5 NOES: 0 ABSTENTIONS: 0 On motion by Commissioner Turner, seconded by Commis- sioner Wilcox, the Court voted unanimously to approve the list F of surplus auction property and unclaimed or abandoned property submitted submitted by the Purchasing Agent. This property is to be sold at the county's second annual auction during the month of May. A copy of the property list is attached. The Court next considered a request from Sheriff Ron Miller to appoint Edwin Odis Wheat as Reserve Deputy Sheriff. PAGE i i Commissioners' Court meeting April 13, 1992 On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request from Sheriff Ron Miller to appoint Edwin Odis wheat as Reserve Deputy Sheriff. The Court next considered the sale of the following items: Bid No. 92-621 - Sale of two (2) wood/metal structures Cheryl Turney, Purchasing Agent, recom- mended acceptance of the bid submitted by Clyde Porterfield. On motion by Commis- sioner Sims, seconded by Commissioner Norton, the Court voted unanimously to accept the recommendation of the Purchasing Agent and sell the two structures to Clyde Porterfield. Bid No. 92-619 - Sale of Sand Silos The County Judge recommended rejecting all bids and rebidding the item. Commissioner Sims asked why the high bid of $24,000.00 was not a good bid and why he thought a bid could be withdrawn. The County Judge moved to reject all bids. Commissioner Norton seconded the motion. The County J'udge, Commissioner Norton and Commissioner Turner voted "Aye." Commissioner Wilcox abstained and Commissioner Sims voted "No." The motion carried to reject all bids. Commissioner Turner seconded the motion. Commissioners Turner and Wilcox voted "Aye", Commissioners Norton, Sims and the County Judge voted "No". The motion failed. On motion by Commissioner Sims, seconded by Commis- sioner Norton, the Court voted unani- mously to accept the recommendation of the Purchasing Agent and award the contract to Appel Ford-Mercury. Bid No. 92-623 - Investigator Vehicle • • ~qq i j 3 r ~ 1 i Appel-Ford Mercury Varsity Ford Brenham, Tx Bryan, Tx Make/Model '92 Ford Taurus 192 Ford Taurus Unit Price $12,195.00 $12,255.00 Subtract $282.24 White Wall Tires if Black Wall Tires not available are acceptable $11,912.76 Tom Light Chevrolet Bryan, Tx Make/Model 192 Chevy Lumina Unit Price $12,962.34 Cheryl Turney, Purchasing Agent, recommended acceptance of the low bid with White Wall tires submitted by Appel Ford-Mercury of Brenham. There is a $60.00 difference between the low bid and the second low bid submitted by Varsity Ford of Bryan, Texas even though Varsity Ford did not bid the White Wall tires. The Appel bid without White Wall tires was $342.24 less than the Varsity Ford bid. Commissioner Norton moved to accept the bid submitted by Appel Ford. The motion was seconded by Commissioner Sims. Commissioners Norton, Sims and Turner voted "Aye", Commissioner Wilcox voted "No", saying he did not feel it was in the best interest of the County. The Court next considered the request by Ferguson Burleson County Gas Gathering System to place a 8" steel gas pipeline and a 4" PVC pipe within the right-of-way of Jones Road in Precinct 4. The 'installation will cross the County right-of-way in two (2) locations. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Ferguson Burleson County Gas Gathering System and authorized the installation. A copy of the request is attached hereto. VOL Z PAG-E6.7 it i Commissioners' Court meeting April 13, 1992 The Court next considered approval of the final plat of i the Mustang Hills Subdivision. Holland Winder, County Engineer, recommended approval since the developer had stated on the plat that all roads are private. Commissioner Norton reminded the Court that approval of the final plat was con- tingent on Olympia Buddy Road, in the Quarter Horse Sub- division adjacent to Mustang Hills Subdivision, being upgraded to County standards and as yet this has not been completed. The developer stated that they had county dedicated easement through the Arhopulus property. Commissioner Wilcox commented that this was a land locked subdivision with no access and it must meet with county subdivision regulations. Commissioner Norton asked the County Engineer if he would inspect the road. The Engineer replied that he had done so already. The Engineer was then asked to do periodic inspections and keep the Court appraised on the status of the Olympia Buddy Road in the Mustang Hills Subdivision. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court unanimously approved the final plat of the Mustang Hills Subdivision under the conditions stated above. The Court next considered authorizing work outside of county right-of-ways for the enhancement of county road pro- jects. The Road and Bridge Department requests permission to E I 4 enter the private property of Tracy Peters on Elmo Weedon Road { to clear existing channels to facilitate drainage and the l ~ private property of Oliver Goen on Bird Pond Road to remove old cattle guards adjacent to the county road. On motion by E 1 Commissioner Sims, seconded by Commissioner Norton, the Court f N voted unanimously to authorize the work. l The Court acknowledged receipt of the Extension Service reports for March 1992. WHEREAS, THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS, have the moral obligation to the citizens and taxpayers of the Brazos County to ensure that the criminal justice system operates in the most efficient and coordinated manner possible; and WHEREAS, the Commissioners' Court is aware there are limited special services available to or provided for the enforcement of drug laws; and WHEREAS, the Commissioners' Court feels that the addition of -the Drug Enforcement Officer Program will materially enhance the administration of Justice in Brazos County, Texas; and, WHEREAS, the opportunity exists to fund vital parts of this program through the Office of the Governor of the State of Texas, Criminal Justice Division; NOW, THEREFORE BE IT RESOLVED, by the Commissioners' Court of Brazos County, Texas at its meeting on the 13th day of April, 1992 that: 1. N.A. (now Ameriuust Texas, N.A., Dallas, Texas) (the "Escrow Agent"); WHEREAS, Section 4.04 of the Escrow Agreement permits the County to deliver a written request with the Escrow Agent to sell, transfer, or otherwise dispose of the Escrowed Securities as described in the Escrow Agreement; WHEREAS, the Commissioners Court of the County has been informed that it would be of benefit to the County to sell certain of the Escrowed Securities and substitute therefor certain other securities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS, THAT the County Judge is hereby authorized to take action required under Section 4.04 of the Escrow Agreement to sell that portion of the Escrowed Securities deemed by him to result in the greatest monetary benefit to the County, but not less than $5,000 net to the County, and to substitute therefor obligations through A.G.
