THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,

SPECIAL MEETING
APRIL 6, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 8:30
a.m. on Monday, April 6, 1992, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The County Judge read aloud a Proclamation designating
• the week of April 6 through April 12, 1992 as "Harvey Mitchell
Founders Week". The Court joins with the Brazos Heritage
Society in honoring this founding father of Brazos County. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court moved to proclaim the week of April 6 through April
12, 1992 as "Harvey Mitchell Founders Week" throughout Brazos
County. The County Judge then presented the signed
Proclamation to Mrs. Jody Bates, representing the Brazos
Heritage Society.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held November 4, 1991, November
11, 1991 and November 18, 1991. On motion by Commissioner
Turner, seconded by Commissioner Norton, the Court' voted

unanimously to approve the minutes as submitted. Commissioner
Sims abstained from voting on the minutes of the meeting of
November 4, 1992 because he was not present.
The Court next considered Budget Amendment #91/92-12,
which would reallocate funds budgeted for the Elections
Department and transfer funds from the Non-Departmental
Department to the office of the Treasurer. On motion by
Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered the resale of Courthouse Bond
Securities. Commissioner Norton moved to authorize the County
Judge to negotiate with two (2) companies to purchase and
resell the bonds. Commissioner Sims seconded the motion.
Commissioner Sims then asked if the matter could be brought
back to the Court so that the Court could as a whole approve
the sale and repurchase of the bonds. He then asked
Commissioner Norton to amend his motion to include the
stipulation. Commissioner Norton agreed to amend his motion
and Commissioner seconded the amended motion. The motion
carried unanimously.
The Court next considered entering into an Interlocal
Agreement with the Mental Health and Mental Retardation
Authority of the Brazos Valley (MHMR) and the six (6)
surrounding counties for the appointment of Trustees to the
Mental Health and Mental Retardation Authority of Brazos
Valley to assure compliance with the provisions of state law
as per Article 5547-203 V.T.C.S. as amended by Senate Bill 112
of the 72nd Texas Legislature to be effective September 1,
1991. On motion by Commissioner Sims, seconded by Commis-
sioner Turner, the Court voted unanimously to enter into an
Interlocal Agreement with the Mental Health and Mental
Retardation Authority of the Brazos Valley (MHMR) and the six
(6) surrounding counties for the appointment of Trustees to
the Mental Health and Mental Retardation Authority of Brazos

The Court next considered a Wavier of Competitive Bidding
Requirements as provided in Section 262.024(a)(7)(A) of the
Local Government Code for the purchase of software for
compilation of election results. This was necessitated due to
the fact that Texas Voting Systems, Inc. is a single source
supplier. On motion by Commissioner Turner, seconded by Com-
missioner Sims, the Court voted unanimously to approve the
Waiver of Competitive Bidding Requirements and authorized the
payment of $18,000.00 to Texas Voting Systems, Inc. for the
necessary computer software and hardware.
The next matter for consideration was approval to
advertise for bids on Roadside Mowing - Bid No. 92-624. The
Purchasing Agent stated that she had used the bidders list of
the State Department of Highways and Public Transportation.
On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to authorize the Purchasing
Agent to advertise for bids on Roadside Mowing.
The Court next considered four (4) requests by Ferguson
Burleson County Gas Gathering System. The first, to place an
8" steel gas pipeline across the right-of-way of Steep Hollow
Road. The second, to place an 8" steel gas pipeline within
the right-of-way of Elmo Weedon Road paralleling Elmo Weedon
Road a distance of 67.27 rods. The third, to place an 8"
steel gas pipeline across the right-of-way of Elmo Weedon Road
at the intersection with Dyess Road. The forth (4), to place
an 8" steel gas pipeline across the right-of-way of Elmo
Weedon Road approximately, 1.7 miles northeast of the
intersection with State Highway 30. All requests are in
Precinct 3. The County Engineer stated that all appeared to
be in order and recommended approval with the stipulation that
the right-of-way be returned to its original condition. On
motion by Commissioner Sims,,seconded by Commissioner Norton,
the Court voted unanimously to approve the request of Ferguson
Burleson County Gas Gathering System and authorized the

The Court proceeded to consider the change of status of

On motion by Commissioner Wilcox, seconded by Com-
missioner Turner, the Court voted unanimously to approve the

Claims as submitted.
At 8:50 a.m. the County Judge announced the meeting
closed to the publib so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 9:10 a.m. the County Judge announced the meeting open
to the public. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve
the request of the head of Data Processing for the
transferring of two employees within the department with the
stipulation that the additional funds to increase the salary
of Pam Raymond are to be taken from the vacated job position.
On motion by Commissioner Norton, seconded by Commissioner
Turner, the Court voted unanimously to approve the request of
the County Treasurer to increase the salary of Dianne Lawson
to the budgeted amount of $16,359.00. On motion by Commis-

voted unanimously to approve the request of the Sheriff to

create the position for the Crime Stopper Secretary.
Commissioner Sims moved to authorize the creation of a new
prosecutor position for the office of the District Attorney.
Commissioner Norton, seconded the motion. Commissioners
Norton, Sims and Turner voted "Aye" Commissioner Wilcox voted
"No", suggesting that it be considered at budget time. The
motion carried.
There being no further business to come before the court,
the meeting was adjourned.

THAT WHEREAS, on April 6, 1992, the Court heard and approved
a budget amendment for the 1991-1992 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 3,
1991, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

INTERLOCAL AGREEMENT
In accordance with the Texas Interlocal Cooperation Act, Article
4413 (32c) V.T.C.S., the undersigned representatives of the
organizational combination of the seven county Commissioners'
Courts responsible for jointly appointing the Board of Trustees of
the Mental Health and Mental Retardation Authority of the Brazos
Valley ("MHM ABV"), hereby formalizes and clarifies the existing
apointment process to assure compliance with the provisions of
state law (Chapter 534 of the Texas Health and Safety Code &
• Article 5547-203 V.T.C.S. as amended by Senate Bill 112 of the 72nd
Texas Legislature to be effective September 1, 1991).
I.
The Board of Trustees of MHM ABV shall continue to consist of nine
(9) jointly appointed members who may either be individually
selected from the membership of each Commissioners' Courts or
individually selected from among the qualified voters of the seven-
county region to be served. The membership terms of the Board of
Trustees shall hereafter be designated as follows:
A. Two (2) year terms as continuing with the period March 1, 1992
through March 1, 1994, or until a successor is appointed;

procedure for appointment to a vacant Trustee position, including
posting notice of filling of such vacancy as required by sec.
534.004 Health and Safety Code, formerly Sec. 3.02(d) (1-3) of Art.
5547-203 V.T.C.S.;

C. An attempt to reflect the ethnic and geographic diversity of the
MHMRABV's seven county local service area as required by Sec.
3.02(b) of Art. 5547-203 V.T.C.S.;
D. The inclusion on the Board of Trustees of one or more persons
who are consumers or family members of consumers of the type of
services provided by MDC ABV as required by Sec. 3.02(b) of Art.

E. The grounds for and procedure for removing a Trustee as required
by Sec. 3.02(d) (4) of Art. 5547-203 V.T.C.S. including the grounds
stated in Sec. 3.02B(g) of Article 5547-203 V.T.C.S.
III.
Although not required by state law, the Commissioners' Courts agree
that the public interest is best served by limiting tenures of
appointed officials. Therefore, a person selected for joint
appointment to the Board of Trustees of MHMRABV may not serve more
than four consecutive and complete two-year terms. This
prohibition shall apply only to terms commencing after September 1,
1991, and any terms served or commenced prior to September 1, 1991
shall not be considered as being applicable to this prohibition.

The Commissioners' Court has determined that there is only one source and hereby grants
an exemption from the competitive bidding requirement for the following items for which

vendor: Texas Voting Systems. Inc., as provided in the Local Government Code, Section
262.024(a)(7)(A). The Court hereby approves payment for said costs to the designated

1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.

3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no coat to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no lees than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barricaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.

1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no coat to BRAZOS COUNTY, should some
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any ei%isting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and ,
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cooed for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
