V'Ol.___4-PAG E_9A- I1 ' 1_'\ I~ 1 1 f COMMISSIONERS' COURT SPECIAL MEETING • MARCH 18, 1992 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Wednesday, March 18, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2, Absent; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Gallagher The Court met to consider the insurance consultant's • report on the proposals submitted for General Liability, Law Enforcement and Errors and omissions insurance coverage for Brazos County. The County Judge stated in his opening remarks that he did not feel it-was the intent of the Court to make a decision today. He outlined the procedures for asking questions then turned the meeting over to Mr. Don Gray, the County's insurance consultant. . Mr. Gray stated that he needed input from the Court before he could make his final recommendation. He talked about funding arrangements, comparing options available, liability maximum coverage, whether the county wanted to lower 1 ~ Commissioners' Court meeting March 18, 1992 it or not, he asked if the county could purchase more auto insurance than allowable. Bob Lemens, attorney for the Texas Association of Counties, stated that the county lacks the authority to purchase coverage over the limits specified by State Statutes. Judge Holmgreen asked who would cover the cost of a claim if it exceeded the limit of coverage. Mr. Lemens answered that he had never heard of a case like that. Mr. Gray went on to discuss the Gallagher program and its many options. The representative from Gallagher showed a slide presentation giving a brief history of his company. Mr. Gray went on to discuss several other aspects of the bids received and asked the court not to make a decision until he had the opportunity to contact the people submitting the proposals and to make contact with the companies for prior acts coverage. There being no further business to come before the Court, the meeting was recessed until 10:00 a.m. on March 26, 1992. COMMISSIONERS' COURT SPECIAL MEETING MARCH 26, 1992 The County Judge reconvened the meeting of the Commissioners' Court of Brazos County, Texas at 10:00 a.m. on March 26, 1992 in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2 Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4, Absent; Mary Ann Ward, County Clerk. The County Judge reconvened the meeting and then turned it over to Mr. Don Gray, the County's insurance consultant. U,n, VV_; L-4 r---qA-z- Commissioners' Court meeting March 18, 1992 • Mr. Gray told the Court that he had reviewed all the proposals and pronounced them to be very good proposals with fair prices. He stated that there were three (3) key decisions to be made by the Court. Those being how much risk the County is willing to assume, what type of policy the County wants and if the County would consider lower general liability limits. Mr. Gray gave an overview of the options presented by Mallard Insurance and A. J. Gallagher plus the pros and cons of those options. The County Judge stated that he did not feel the County was in a position at this time to accept the Gallagher plan. Commissioner Sims stated that the Gallagher Plan could not specify a definite cost to the County and he felt this was necessary for budgeting purposes. He stated he felt it was important at this time to secure the best price and coverage. Commissioner Norton voiced the same opinion stating he favored conventional coverage with a low deductible and $1,000,000.00 limit on coverage. Commissioner • I Wilcox commented that he personally favored self insurance. Mr. Gray said considering the Court's feelings, he recommended the proposal submitted by Mallard Insurance, increasing the boiler/machinery coverage to 7.5 million dollars and keeping the Workers Compensation coverage with the Texas Association of Counties. He further recommended the County change the coverage for General Liability and Law Enforcement from "Claims Made" to "Occurrence" type reporting. On motion by Commissioner Norton, seconded by Commis- 401 sioner Sims, the Court voted unanimously to accept the recommendation of the insurance consultant and accept the bid submitted by Mallard Insurance Company. There being no further business to come before the Court, the meeting was adjourned. VC 3.
