Adjourn. . f i i VO PAG E-y~ COMMISSIONERS' COURT SPECIAL MEETING MARCH 16, 1992 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 8:30 a.m. on Monday, March 16, 1992, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Asst. to County Judge Rosalie Todaro Auditor's Office Cheryl Turney Auditor's Office Sandie Walker Treasurer Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered an order appointing James A. Amis, Jr. to sit as Special Judge in County Court at Law I on March 16, 19 and 20, 1992 to allow Judge Davis to take vacation time. Commissioner Turner moved for approval. Commissioner Norton seconded the motion. Commissioners Norton, Turner and Wilcox and the County Judge voted "Aye". Commissioner Sims voted "No". The Court approved the Order naming James A. Amis, Jr. as Special Judge for County Court at Law I for the dates of March 16, 19 and 20, 1992. A full copy of the order is attached to and made a part of these minutes. The Court next considered adopting a Resolution authorizing application to purchase Juvenile Services for a grant to provide special services for juvenile offenders. The program is administered by the Juvenile Services Department. Such grant to be in the total amount of $5,060.00 to be fully funded by a federal grant. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously P Vol. A to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. The Court next considered adopting a Resolution authorizing application for a grant to support the Brazos County Victim Advocacy Project/6 that is administered by the District Attorney's office. Such grant to be in the total amount of $57,692; sixty percent (60%) or $34,088.00 to be funded by the County, forty percent (40%) or $23,604.00 to be state funded. Commissioner Norton moved to adopt the Resolution. The motion was seconded by Commissioner Turner. Commissioners Norton, Sims and Turner and the County Judge voted "Aye". Commissioner Wilcox voted "No." The motion carried to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. The Court next considered renewal of a lease agreement between Brazos County and the Junior League of Bryan/College Station for rental of space at the Brazos Center. This extends the existing lease agreement extension ending on January 1, 1992 to continue on a month to month basis until renovation of vacated museum space is completed or until September 1, 1992, whichever comes first. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to renew the lease agreement for the period stated above. A copy of the lease agreement is attached. The Court next considered the request by Clajon Gas Company to install a natural gas pipeline across Lacy Well Road in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Clajon Gas Company and authorized the installation. A copy of the request is attached hereto. r, 4 1j d~ N VOL P~'aG FOY Commissioners' Court meeting March 16, 1992 The Court next considered the request by Ferguson Crossing Pipeline Company to install a 6" steel pipe within the right-of-way of Elmo Weedon Road in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval with the stipulation that all damages done prior to this date be corrected to the satisfaction of the Commissioner and the County Engineer. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Ferguson Crossing Pipeline Company and authorized the installation with the afore mentioned stipulation. A copy of the request is attached hereto. The Court next considered the two requests by Union Pacific Texas Gathering Inc.. The first to place an 8" P.V.C. saltwater pipeline within the right-of-way of Stewart's Meadow and crossing McAllester Lane and Old Jones Road in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval with the stipulation that Union Pacific must repair all damages to the satisfaction of Commissioner Turner and the County Engineer. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Union Pacific Texas Gathering Inc. and authorized the installation with the afore mentioned stipulation. The first two were to place buried cable across the right-of-way of Straub Road and Woodlake Drive in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The third request was to place several buried cable locations under Smetana Road in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requests permission to enter the private property of Lovell Rand on Matt Wright Road to clear out brush and trees from the road ditch and excavate :.he ditch to drain to the southeast. On motion by Commissioner Wilcox, seconded by Commissioner Norton, the Court voted unanimously to authorize the work. The Court proceeded to consider the change of status of the following employees. On this the day of March , 1992, the Commissioners Court of Brazos County, Texas, convened in Regular Session at the regular term of the Court, at the Brazos County Courthouse, in the City of Bryan, Texas, with the following members present, to-wit: R. Davis, Judge of the County Court at Law No. 1 of Brazos County, Texas, having made known to the Commissioners Court of Brazos County, Texas, that on March 16, 19, and 20, 1992, he will be absent from the bench due to vacation time with his granddaughters. WHEREAS, he has requested the appointment of James A. Amis, Jr. to sit as Special Judge of the County Court at Law No. 1 of Brazos County, Texas on the above mentioned date in all matters that are, or may be, docketed on the Court's dockets for this day, and to have and exercise all powers of a Special Judge in relation to matters involved, it is, therefore, ORDERED, ADJUDGED AND DECREED, Pursuant to authority of Article 30.03, Section 2, Code of Criminal Procedure, that James A. HO GREEN County Judge 01 ATTEST: Mary Ann and County C erk r VO PAGE/.r' STATE OF TEXAS I COUNTY OF BRAZOS 1 A RESOLUTION AUTHORIZING APPLICATION FOR GRANT TO PURCHASE JUVENILE SERVICES WHEREAS, the Governor of Texas, through the Criminal Justice Division, under the provisions of the Juvenile Justice and Delinquency Prevention Act and within the authority of the Texas Family Code, has set forth a program to provide special services for juvenile offenders; and WHEREAS, in implementing the aforementioned program, the Governor is making grant funds available for the purchase of needed service for juvenile offenders; and WHEREAS, the Juvenile Court serving Brazos County has continuing need for a wide range of services to be provided to selected juveniles. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S COURT OF BRAZOS COUNTY at its meeting on the 16th day of March, 1991, that: 1. The County Judge of Brazos County be authorized to make application to the Criminal Justice Division, Office of the Governor, for grant funds to be used for the purchase of services for selected juvenile offenders; 2. J. mgreen, C my Judge Brazos County, Texas ATTEST: ~"a4n A44-1~- VOL 6 • THE STATE UE ItxA5 COUNTY OF BRAZOS A RESOLUTION • ~J FOR GRANT .rr„rTeurr nnnnnAu WHEREAS, the Criminal Justice Division, Office of the Governor, has indicated a need for programs aiding victims of crime, and has supported the establishment of such; and WHEREAS, the U.S. Department of Justice has supported programs for aiding victims of crime by establishment of a National Victims' Resource Center; and WHEREAS, among the several programs included in the 1992 Goals and Strategies for Texas is one which is designed to provide crisis services for victims of crime; and WHEREAS, there presently being no other agency primarily responsible for offering services to victims of crime; and WHEREAS, there exists a continued need for an agency designed to provide crisis intervention, victim advocacy, referrals, education and support services for victims of felony crimes in Brazos County; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS, at its meeting on the _ day of 1992, that: 1. The County Judge is authorized to make application on behalf of Brazos County to the Criminal Justice Division for grant funds to provide for the continuation of a Victim Assistance Program in Brazos County, Texas. I* 0 u • Brasos SWD Right-of-Way Status Report Karch 9, 1992 Segment A - SWD, Inc. to the Ferguson Crossing Compressor Station County Road Crossing permits for Lacey Well Road and Stewarts Meadow Road are on todays agenda at the Brazos County Commissioners meeting. We have met with the County Engineer and the permits should be approved and ready for pickup today. Mr. Goodwin's attorney is reviewing the ROW Agreement and we should have an answer today regarding this tract. Mr. Palasota, owner of the Gravel Pit Area, is reviewing the ROW Agreement and has expressed concern about our line being laid in the berm surrounding his property. We have told him that by using the County Road (Stewarts Meadow) right-of-way and the State Highway (FM 60) right-of-way for work space we can install our line without disturbing the berm. He will give us an answer this week. In order to be prepared in case Mr. Palasota elects to not sign the ROW Agreement, we have already talked with the County Engineer and State Highway Department about laying the line within their right-of-ways. We have even filed a permit with the County for this segment of right-of-way if needed and the State says they will grant a permit as soon as they see the T-4A permit showing Union Pacific Texas Gathering, Inc. as a common carrier saltwater line. Segment B - From Bush-Warren #1 and Bush-Stasny 41 to the proposed main line The on the ground survey is complete and we are working on the individual plats, center line descriptions and alignment maps for this segment. All of the landowners were contacted prior to surveying and they have all verbally committed to the right-of-way. We will be making contact with the landowners this week to secure the executed Right-of-Way Agreements. Notes concerning Ferguson Crossing's Right-of-Way: • According To Bob Gouhl, Ferguson Crossing's Landman they have not been able to complete the survey across Turkey Creek because of high water. They need to complete this section of the main line in order to complete their main line alignment sheets. I was in the area on March 5, 1992 and I drove by Turkey Creek and there is no reason why this section could not be surveyed! Turkey Creek appears to rise and fall very quickly depending on the rainfall in the area. We have surveyors in the area and we could easily survey this section this week if needed. If we had copies of Ferguson Crossing's survey crew field notes on each side of Turkey Creek we could tie-in their survey line and not duplicate any work. I spoke with Bob Gouhl again today and Ferguson Crossing has still not surveyed Turkey Creek nor has he sent copies of the ROW Agreements that I have requested weeks ago. He claims that all they need to finish the ROW acquisition is 2 landowners near Turkey Creek and a re-route north of Turkey Creek and the Highway 47 segment of the Main Line.
