SPECIAL MEETING
MARCH 2, 1992

A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, March 2, 1992, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #91\92-10,
which would reallocate funds budgeted for the office of the
Commissioners' Court, the County Clerk, the Maximum Security
Jail and the Minimum Security Jail with no increase to the
General Fund Budget. On motion by Commissioner Sims, seconded
by Commissioner Norton, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered an Order appointing James A.

Amis, Jr. to sit as Special Judge in County Court at Law II
from March 4, 1992 through March 6, 1992 to allow Judge Ryan
to attend a Probate Law Seminar. On motion by Commissioner
Wilcox, seconded by Commissioner Sims, the Court voted unani-
mously to approve the order naming James A. Amis, Jr. as
Special Judge for County Court at Law II for the dates of
March 4, 1992 through March 6, 1992. A full copy of the Order
is attached to and made a part of these minutes.

Commissioners' Court meeting March 2, 1992
On motion by Commissioner Wilcox, seconded by Commis-
sioner Norton, the Court voted unanimously to approve the
request from Sheriff Ron Miller to appoint Robert Bethel Dean,
Jr. a Reserve Deputy Sheriff for Brazos County.
The Court next considered three requests by GTE
Southwest. The first to install a buried cable at the
intersection of Highway 21 and Kurten Lane with a bore under
Kurten Lane. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and recom-
mended approval of the request. On motion by Commissioner
Sims, seconded by Commissioner Norton, the Court voted
unanimously to approve the request of GTE Southwest and
authorized the installation. A copy of the request is
attached hereto. The second, to install buried cable under
Old Reliance Road then down Old Reliance and continuing down
Carrabba road. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and recom-
mended approval of the request. On motion by Commissioner
Sims, seconded by Commissioner Norton, the Court voted unani-
mously to approve the request of GTE Southwest and authorized
the installation. A copy of the request is attached hereto.
The third, to install buried cable within the right-of-way of
Fazzino Lane off State Highway 21 West. The site in located
in Precinct 4. The County Engineer stated that all appeared
to be in order and recommended approval of the request. On
motion by Commissioner Turner, seconded by Commissioner Sims,
the Court voted unanimously to approve the request of GTE
Southwest and authorized the installation. A copy of the
request is attached hereto.
The Court next considered the request by Wickson Creek
Special Utility District to install a 1 inch water line inside
a 1 1/2 inch road bore across the right-of-way of Roans Chapel
Road in Precinct 3. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Sims, seconded by Commissioner Turner, the
Commissioners' Court meeting March 2, 1992

Court voted unanimously to approve the request of Wickson
Creek Special Utility District and authorized the install-
ation. A copy of the request is attached hereto.
The Court next considered the request by Clajon Gas
Company to install a 6" natural gas pipeline within the right-
of-way of Deerfield Drive in Precinct 3. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by the County Judge, seconded by Commis-
sioner Turner, the Court voted unanimously to approve the
request of Clajon Gas Company and authorized the install-
ation. A copy of the request is attached hereto.
The Court next considered authorizing work outside of
county right-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of Willis Hicks on Goodson Bend
Road to clear out a channel to allow the culverts under the
roadway to drain properly. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to authorize the work.
The Court proceeded to consider the change of status of
the following employees.

On this the 3rd day of March 1992 at a special meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on March 3, 1992, the Court heard and approved
a budget amendment for the 1991-1992 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be '
reasonably included in the original budget adopted September 3,
1991, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

Court of Brazos County, Texas, convened in Regular Session at the
Special Term of the Court, at the Brazos County Courthouse, in the
City of Bryan, Texas, with the following members present, to-wit:
R. J. Holmgreen, County Judge
Gary Norton, County Commissioner, Precinct No. 1
Walter Wilcox, County Commissioner, Precinct No. 2
Randy Sims, County Commissioner, Precinct No. 3
Milton Turner, County Commissioner, Precinct No. 4.
.Among other proceedings had, the following proposed order was
submitted:
WHEREAS, the Honorable Sarah Ryan, Judge of the County Court
at Law No. 2 of Brazos County, Texas, having made known to the
Commissioners Court of Brazos County, Texas, that on March 4, 5,
and 6 1992, she will be traveling to and attending a Probate Law
seminar; and
WHEREAS, she has requested the appointment of the Hon. James
A. Amis, Jr. to sit as Special Judge of the County Court at Law
No. 2 of Brazos County, Texas on the March 3, March 4, and March 5
1992 in all matters that are, or may be, docketed on the Court's
dockets for those days, and to have and exercise all powers of a
Special Judge in relation to matters involved, it is therefore:
ORDERED, ADJUDGED AND DECREED, pursuant to the authority of
Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.
James A. Amis, Jr., sit and hear all matters that are, or may be,
docketed on any of the Court's dockets on the above-mentioned days
and shall have and exercise all powers of such Special Judge in
relation to the matters involved;
WHEREAS, the Court having considered the proposed order and
deeming that it should be approved; it is therefore:

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in BRAZOS County,
TEXAS as follows:
At the intersection of Hwy. 21 and Kurten Lane a bore will be placed under
Kurten Lane. The cable will be in a private easement at this location.
The location and description of this line and associated appurtenances is more fully shown
by fur (4) copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after March 1, 1992

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
Texas as follows:

Beginning in the Southern most R.O.W. of Old Reliance Road and bury cable
North to cross said road to GTE Sta. 0+45 and begin a bore under said road
at a minimum depth of five feet and place 4" PVC pipe in bore to GTE Sta.
1+15 and'plow cable to North R.O.W. of Old REliance Road to GTE Sta. 1+30
thelproceed West parallel to and three feet within North R.O.W. and co11-
tinuing to follow R.O.W. onto Carrabba Road to GTE Sta. 5+75 and stop.
This cable is to be buried a minimum of 30" deep.

The location and description of this line and associated appurtenances is more fully shown
by four (4) copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.

road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way:
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after the 24th day of
February , 1992 .

Formal notice is hereby given that (Applicant) Clajon Gas Company, L. P.
proposes to place a (type) 6 inch natural as
pipeline within the right-of-way of Road Deerfield Drive
in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.
(Applicant) Clajon Gas Company, L. P. , understand and agree that:
1. The County Engil.neer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way respoasible for any damage that might
occur to any eAisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either aide of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
Construction of this line will begin on or after (date) February 20, 1992.
