SPECIAL MEETING
FEBRUARY 17, 1992
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, February 17, 1992, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered an order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law II on
March 6, 1992 to allow Judge Ryan to attend a Probate Law
seminar and on March 24 and 25, 1992 to allow Judge Ryan to
take personal leave time. On motion by Commissioner Sims,
seconded by Commissioner Wilcox, the Court voted unanimously
to approve the Order naming James A. Amis, Jr. as Special
Gf
Judge for County Court at Law II for the dates of March 6,
1992 and March 24 and 25, 1992. A full copy of the order is
attached to and made a part of these minutes.
The Court next considered awarding the following bid:

Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the low bid sub-
mitted by Hodges of Huntsville. On
motion by Commissioner Norton, seconded
by Commissioner Turner, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Hodges of Huntsville.
On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to ask the
Purchasing Agent to advertise for bids for the removal of the
old Brazos County Commissioner Precinct 4 maintenance building
at 800 Waco Street. This will not be done as an auction but
on a sealed bid basis.
The Court next considered the request by Clajon Gas
Company to install a natural gas pipe line within the right-
of-way of Jones Road in Precinct 4. The County Engineer

Commissioners' Court meeting February 7, 1992
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court voted unanimously to approve the
• request of Clajon Gas Company and authorized the installation.
A copy of the request is attached hereto.
The Court next considered four requests by Ferguson
Crossing Pipeline Company. The first one to install a 6"
steel pipe across the right-of-way of Elmo Weedon Road in
Precinct 3 and the other three were to install a 10 3/4 inch
O.D. steel natural gas pipe, a 6 5/8 inch O.D. steel natural
gas pipe line and a 3 1/2 inch O.D. steel natural gas pipe
across the right-of-way of Silver Hill Road in Precinct 4.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Turner,
+ seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Ferguson Crossing Pipeline Company and
authorized the installations. A copy of each request is
• attached hereto.
The Court next considered the request by GTE Southwest to
Y
install a buried communication cable within the right-of-way
Warren Ranch Road in Precinct 3. The County Engineer stated

that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to approve the request of GTE
Southwest and authorized the installation. A copy of the
request is attached hereto.
The Court next considered authorizing work outside of
county right-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of R. L. Carroll to clear out an
existing channel east of Hicks Lane in Precinct 3. On motion
by Commissioner Sims, seconded by Commissioner Wilcox, the
Court voted unanimously to authorize the work.
The Court received, approved and ordered filed as
submitted the Treasurer's report for January 1992. A copy of

The Court proceeded to consider the change of status of

On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to approve the
Claims as submitted.
At 10:16 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 10:17 a.m. the County Judge announced the meeting open
to the public. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to approve
the request submitted by the Jail Administrator to promote
Shannon Baker from Clerk, Pay Group 5 Step 2.3 to a Jailer,
Pay Group 8, Step 2 with no six month increase.
There being no further business to come before the Court,
the meeting was adjourned.

she will be at a Probate Law seminar and on March 24 and 25, 1992,
she will be absent from the bench for the purpose of personal
leave; and
WHEREAS, she has requested the appointment of the Hon. James
A. Amis, Jr. to sit as Special Judge of the County Court at Law
No. 2 of Brazos County, Texas on the March 6, 1992, March 24, 1992
and March 25, 1992 in all matters that are, or may be, docketed on
the Court's dockets for those days, and to have and exercise all
powers of a Special Judge in relation to matters involved, it is
therefore:

Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.

4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any eAisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no lees than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barricaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.

TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS

Ferguson Crossing Pipe Line Co. Crossing Xx , Parallel Install.
P.O. Drawer 380 Road: Silver Hill Road
Lyons, Texas 77863 Precinct No.: 4
Formal notice is hereby given that (Applicant) Ferguson Crossing Pipe Line Co
proposes to place a (type) 10 3/411 O.D. steel natural gas
pipeline within the right-of-way of Road silver Hill Road
in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.
(Applicant) Ferguson Crossing Pipe Line Cp.understand and agree that:
1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
It
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no lees than forty-eight.
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
Construction of this line will begin on or after (date) January 31, 1992

Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in RRAMS County,
TEXAS as follows:
Beginning at a point 34 feet northwest of the south end of Warren Ranch
Road, 34 feet of buried cable will be placed southeast at 5 foot within
the northeast right of way of Warren Ranch Roak; then buried cable will
continue southwest for 40 feet.
The proposed cable will be buried to a minimum depth of 30 inches.

The location and description of this line and associated appurtenances is more fully shown
by 4 (four) copes of drawings attached to this notice. The 1-1., will be constructed and maintained
on the County Road right-of-way in accordance with governing laws
Notwithstanding any other provision contained herein, it is expra ;sly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after Fehruaz:y 19 1992_-.
