J. Holmgreen, County,Judge, Absent; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2, Presiding; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Herburt Silusto Ferguson Crossing Emil Ogden Brazos County Resident Commissioner Sims gave the invocation and led the pledge of allegiance. Commissioner Wilcox opened the meeting and stated that PAG E--LT Commissioners' Court meeting February 3, 1992 the Court would consider item number nine on the agenda, the denying of over weight permits in excess of 58,420 pounds during inclement weather, first, because of the number of people interested in this matter. Commissioner Wilcox asked that anyone wishing to speak give their name, the name of the company they represent and give a brief statement of concern. He then asked if any other Commissioner had anything they would like to say. Commissioner Sims stated that this was not a public hearing but merely a way to enumerate the concerns of the members of the Court. He asked that those wishing to make comments limit themselves to two or three minutes and to identify themselves and the company they represent. Commis- sioner Norton informed the group that over sixty inches of rain had fallen in the area and the roads were just gone. He went on to say that the county could not afford this kind of devastation and that the 58,420 pound weight limit had to be enforced on loads that could be broken down. The Court heard numerous comments from the members of the oil industry, attorneys and Brazos County residents. Each stressed the positive and/or negative impact of such an action. After considerable discussion, Commissioner Sims moved to table action on the matter to allow time to consider the rest of the items on the agenda. Commissioner Norton seconded the motion. Commissioners Norton, Sims and Turner voted "Aye" and Commis- sioner Wilcox voted "No". The Court next considered approval of the minutes of the Commissioners' Court meetings held September 30, 1991, October 1, 1991, October 2, 1991, October 3, 1991, October 7, 1991 and October 11, 1991. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the minutes as submitted. The Court next considered Budget Amendment #91/92-08, which would reallocate funds budgeted for the Sheriff's Department and transfer funds from the County Extension Agent's department to Non-Departmental'. On motion by Commissioners' Court meeting February 3, 1992 • • is W Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered three requests by GTE Southwest. The first to place buried cable beginning at the intersection of Sebesta Road along the north right-of-way of Fox Fire Drive to the intersection of Frost Drive under Frost Drive to the north right-of-way of Frost Drive and east to the intersection of Frost Drive and Freneau Drive in Fox Fire Subdivision in Precinct 1. The second to place a buried cable on Old Bundick Road in Precinct 2 and the third request to place buried cable under Dick Elliott Road in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Wilcox, seconded by Commissioner Turner, the Court voted unanimously to approve all the request of GTE Southwest. A copy of each request is attached hereto. . The Court next considered the request by Wickson Creek Special Utility District to make two (2) road bores across Deer Run and Antler circle for the installation of water lines in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next- considered the request by Ferguson Crossing Pipeline Company to install a 8" gas steel pipeline within the right-of-way of Grassburr Road Precinct 3. The question was raised about the location of the bore as it appeared to be in the intersection. The County Engineer stated that after looking at the drawing that it was a 30 degree bore and not going across the intersection. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Ferguson z I' I ' Commissioners' Court meeting February 3, 1992 Crossing Pipeline Company and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county right-of-ways for the enhancement of county road projects. The Road and Bridge Department requested permission to enter the private property of Lebon Agnello on Bird Pond Road to straighten a creek channel to allow the stream to flow more directly through box culverts under the road. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to authorize the work. The Court proceeded to consider the change of status of the following employees. Traf. Task Force Claims-02308-thru-02315- On motion by Commissioner Sims, seconded by Commissioner i Turner, the Court voted unanimously to approve the Claims as submitted. The Court then reconsidered agenda item number 4, the denying overload permits in excess of 58,420 pounds on county roads during inclement weather. If there is a problem, then a meeting will be held to find a solution. 2. Drilling sites will be addressed on an individual basis with each commissioner. 3. After a drilling rig has been removed from the site, the producer will go back and shape up the road. The motion was seconded by Commissioner Norton. Commissioners Norton, Sims and Turner voted "Aye", Commissioner Wilcox abstained. The members of the oil industry were asked to call the office of the Commissioner or Constable Pittman during times of inclement weather to see if the roads are open. At 11:10 a.m. Commissioner Wilcox announced the meeting closed to the public so that the Court could meet in closed 4xecutive session to discuss personnel as allowed under Section (6252-17(2)(g) Vernon's Texas Civil Statutes. At 11:14 a.m. Commissioner Wilcox announced the meeting open to the public. On motion by Commissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of the District Attorney to hire Cherie Davis at a Pay Group 6 Step 2 position with no six (6) month step increase. Incorporated LINE INSTALLATION t DATE January 23. 1992 TO THE COMMISSIONER'S COURT OF Brazos COUNTY ATTENTION COUNTY JUDGE: C~ Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line within the right-of-way of a County Road in Brazos County, Texas as follows: On Old Bundick Road 2200 feet South of Ransom Rd, a buried Cable will be placed 3' in the Ease R.O.W. 30" deep and extending south for a distance of 2,575 feet. The location and description of this line and associated appurtenances is more fully shown by four (4) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any e4isting utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of way in accordance with governing laws. • 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all roads' be bored to forty feet (40') on either aide of the centerline of the right-of-way or cased for such distance. 8. That all sites will be barracaded during construction period. 9. That the normal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985.
