VOL-I-PAG E.~_.- COMMISSIONERS' COURT SPECIAL MEETING JULY 29, 1991 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, July 29, 1991, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The Court first considered and order appointing James A. Amis, Jr. to sit as Special Judge in County Court at Law 11 on August 5, 1991 and August 19, 1991 to allow Judge Ryan to be absent from the bench on personal leave. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the Order naming James A. Amis, Jr. as Special Judge for County Court at Law II for the dates of August 5, 1991 and August 19, 1991. A full copy of the Order is attached to and made a part of these minutes. Celia Goode Darlene Nichols The Court tabled consideration until further study can be made, of a request from Brazos Maternal and Child Health Clinic for health insurance coverage. The Court next considered the proposed implementation of load limits of 30,000 pounds on Oak Lake Drive from FM 2038 to Democrat Road and on Democrat Road from State Highway 21 East to the Northeast right-of-way line along Plagens Road in Precinct 3 pursuant to article 6701-2, Subchapter D, Vernon's Civil Statutes. The Court held a Public Hearing on July 22, 1991 to hear commentary for and against the proposed implementation. On motion by Commissioner Sims, seconded by commissioner Norton, the Court voted unanimously to implement the maximum load limit of 30,000 pounds on Oak Lake Drive from FM 2038 to Democrat Road and on Democrat Road from State Highway 21 East to the Northeast right-of-way line along Plagens Road. Such regulation to become effective immediately. The next matter for consideration was a request from Dana Dickens, developer of the Country Meadow Subdivision, for Brazos County to accept for maintenance the roads in that subdivision and for the County to release the $1,200.00 Maintenance Bond being held at Homestead Savings and Loan Association. When asked if the roads met County specifi- cation, the County Engineer answered that they did. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to accept for maintenance the roads in the Country Meadow Subdivision in Precinct 1 and agreed to release the bond. Commissioners' Court meeting July 29, 1991 The Court next considered approval of the final vacating and replat of the Quail Run Estates Phase I and the Oak Lake Estates lots 11-R and 12-R formerly lots 11 and 12 Block 1 in Precinct 1. Commissioner Norton explained his concern with the verbiage in the law. Chris Galindo, representative of Galindo Engineers and Planners, explained that he had obtained the signatures of the affected landowners. He then asked that the variance be granted. Commissioner Norton stated he had no objections to the variance on the set back line. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court unanimously approved the final vacating and replat of the Quail Run Estates Phase I and the Oak Lake Estates lots 11-R and 12-R formerly lots 11 and 12 Block 1 and to grant the variance on the set back line. The Court next considered the request by Fergusson Crossing Pipeline Company to install a welded steel connection across the right-of-way of Kemp Road in Precinct 4. The County Engineer stated everything was in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Fergusson Crossing Pipeline Company and authorized the installation. A copy of the request is attached hereto. The Court proceeded to consider the change of status of the following employees. That the line will be constructed and maintained on the county right- of way in accordance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all roads be bored to forty feet (40') on either side of the centerline of the right-of-way or cased for such distance. 8. That all sites will be barraeaded during construction period. 9. That the normal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985.
