NOTICE OF PUBLIC HEARING
BRAZOS COUNTY COMMISSIONERS COURT
PURSUANT TO ARTICLE 6701-2, SUBCHAPTER D, VERNON'S CIVIL STATUTES
THE COMMISSIONERS COURT WILL HOLD A PUBLIC HEARING TO CONSIDER
tRAFFIC REGULATIONS ON VARIOUS COUNTY ROADS. THE PUBLIC HEARING
JILL BE HELD IN THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET,
SUITE 115, BRYAN, TEXAS. THE DATE OF THE HEARING IS MONDAY, JULY
22, 1991 AND THE TIME OF THE HEARING IS 1:30 P.M.
rHE COMMISSIONERS COURT IS PROPOSING TO IMPLEMENT LOAD LIMITS Of
30,000 POUNDS ON THE FOLLOWING ROADS:
1. Oak Lake Drive from FM 2038 to Democrat Road.
2. Democrat Road from State Highway 21 East to the Northeast
right-of-way line along Plagens Road.

PUBLIC HEARING
JULY 22, 1991
The Commissioners' Court of Brazos County, Texas held a
Public Hearing to consider load limitations on Oak Lake Road
and Democrat Road in Precinct 3 in the Commissioners'
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 1:30 p.m. on Monday, July 22, 1991, with the
following members of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

The Court met in Public Hearing pursuant to article 6701-
2, Subchapter D, Vernon's Civil Statutes to hear commentary
for and against the proposed implementation to load limits of
30,000 pounds on Oak Lake Drive from FM 2038 to Democrat Road
and on Democrat Road from State Highway 21 East to the
Northeast right-of-way line along Plagens Road in Precinct 3.
The County Judge stated in his opening comments that the
notice of the hearing had been posted in accordance with the
law. He outlined the procedures for the hearing and asked
those in attendance for any comments on the subject.
Ricky Bain, Taylor Well Service - asked if any
vehicle in excess of the 30,000 pound limit could
obtain an over load permit.
Commissioner Sims - answered no, not until some
work has been done on the roads to repair the
damage already done.

Bill McCurdy, McCurdy well Service, Inc. - asked if
• this was after the fact or if this was the last
stage before closing the over load limits.
Commissioner Sims - answered a little of both.
Bill McCurdy - stated that a site on Democrat Road
has been in operation for ten (10) years. He asked
how were they to continue productivity when the
equipment weighs in excess of 30,000 pounds when
unloaded. Up until this point they have been
purchasing over weight permits.
Commissioner Sims - stated that the county had
$15,000.00 to fix the road damage to Democrat Road
and were trying to limit the damage being done. He
then asked how many producers were located along
Democrat Road.
Bill McCurdy - answered that there were two (2)
producers, Merit and Chevron.
Commissioner Sims - informed Mr. McCurty that
Robert Matecjek from Merit Energy would be down the
following day to see what could be done.
Bill McCurdy - asked if there would be a moratorium
until the work could be completed or would there be
certain hours when the work could be done.
• Judge Holmgreen - stated that it was not the intent
to put anyone out of business, but that the
companies need to work with the county to solve the
problem.
Commissioner Sims - said that something could be
worked out and he encouraged anyone with a problem
to come sit own with him to work something out. He
went on to say that work would begin in
approximately sixty (60) days.
County Engineer - informed those representatives of
the oil companies that the new load limit would
take effect Monday, July 29, 1991.
There being no further business to come before the Court,
the County Judge thanked all for coming then declared the
public hearing adjourned.
