JANUARY 13, 1992
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, January 13, 1992, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to set the rate for
mileage reimbursement at ;.275 per mile.
On motion by Commissioner Sims, seconded by Commissioner
Turner, the Court proceeded to set the holidays to be observed
by Brazos County for 1992:

Commissioners' Court meeting January 13, 1992
The Court proceeded to the selection of the Salary
Grievance Committee for 1992 in accordance with the law. The
•
following names were drawn from the list of persons who served
on the Grand Jury during the previous twelve months:

Alternates - 1. John Godfrey
2. Vince Anastasi
The County Judge announced that he waived his right to
sign pay authorizations for the Road and Bridge Department.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to approve the waiver.
The Court next heard a report from the Election
Committee. The County Judge reported that it was the
consensus of the committee to remain with Texas Voting
Systems' punch card system. Commissioner Sims voiced the

opinion that he felt that the county was working with an
antiquated system and that the county needed to look at the
economics of it. Commissioner Norton stated that remaining
with the punch card system would be the smartest thing to do
unless the counting equipment is not certified by the
Secretary of State's office. On motion by the County Judge,
seconded by Commissioner Sims, the Court voted unanimously to
remain with the punch card system providing approval of the
new county equipment is received from the Secretary of State's
office within the next two (2) weeks.
The next matter for consideration was a tax refund for
Resolution Trust Corporation, Receiver for Occidental Nebraska
Federal. In a Court settlement it was agreed that the
appraised value for 1990 should be $1,200,000.00 instead of
• $1,717,540.00. On motion by the County Judge, seconded by
Commissioner Norton, the Court voted unanimously to refund
$2,134.50 in county taxes for 1990 to Resolution Trust
Corporation, Receiver for Occidental Nebraska Federal.
The Court next considered entering into agreement with

Commissioners' Court meeting January 13, 1992
the College Station Independent School District for permission
to park various pieces of heavy equipment and stockpile
materials (for a short period of time) to be used by the
County in the area on the College Station Independent School
District Athletic Department workout fields. The County would,
in exchange for the above stated privileges, make certain
improvements as agreed to by both parties by providing fill
soils and maintain fields and surrounding sidelines in the
immediate proximity to said athletic fields on an "as needed
basis." The agreement will be in effect for the duration of
time necessary for the completion of work in the area and may
be terminated by either party upon a thirty (30) day notice.
On motion by Commissioner Norton, seconded by Commissioner
Turner, the Court voted unanimously to enter into agreement
with the College Station Independent School District
Transportation for parking privileges on the College Station
Independent School District Athletic Department work out
fields and authorized the County Judge to execute the
Agreement on behalf of Brazos County. A copy of the Agreement
is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to receive, approve and
ordered filed as submitted the Certification of the Juvenile
Detention Facility. A copy of the Certification is attached
hereto.
The Court next considered the purchase of a Mini Van for
Juvenile Services. Cheryl Turney, Purchasing Agent, informed
the Court that a van could be purchased through the State
Purchasing Program and a cost of $12,540.76 and that the cost
of the vehicle and insurance will be cheaper than the payment
of mileage expense to an employee. The Purchasing Agent told
the Court that she had preliminary quotes from other vendors
but that the quotes were likely to change in the sealed
competitive bid process due to fleet incentives from the
manufacturer. On motion by Commissioner Norton, seconded by
Commissioners' Court meeting January 13, 1992
Commissioner Turner, the Court voted unanimously to purchase
the vehicle at $12,540.76 through the State Purchasing
Program.
The next matter for consideration was approval to
advertise for bids for an Intercom Control System for the jail
facility - Bid No. 92-615. On motion by Commissioner Norton,
seconded by Commissioner Turner, the Court voted unanimously
to authorize the Purchasing Agent to advertise for bids for
the purchase of an Intercom Control System.
The Court next considered a request from Constable
Precinct 7, Winfred Pittman, for a full time deputy and
clerk. Constable Pittman stated that a major increase in work
prompted the request for the staff positions. Commissioner
Sims asked if he would be requiring another car. Constable
•
Pittman told him no. Commissioner Sims continued by saying
that he saw no problem with a full time deputy but did not see
the need for an additonal clerk. Commissioner Norton asked
about the need for a computer. Constable Pittman replied that
a computer would help, but still need a clerk to use it.
Commissioner Sims asked if a part time clerk would solve some
of the problem. Constable Pittman answered that it would. On
motion by Commissioner Wilcox, seconded by Commissioner
Turner, the Court voted unanimously to table consideration
until a later date.
The Court next considered the request by GTE Southwest to
install a buried cable line along Zweifel Road and Locke Road
in Precinct 2. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Turner, seconded by Commissioner Norton, the
Court voted unanimously to approve the request of GTE
Southwest. A copy is attached hereto.
The Court next considered the request by GTE Southwest to
install a buried cable line along Emily Road and Lynette
Circle in Precinct 4. The County Engineer stated that all
appeared to be in order and recommended approval. On motion

Precinct 4. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Turner, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of GTE Southwest. A
copy is attached hereto.
The Court acknowledged receipt of the Extension Service
reports for December 1991 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
The Court proceeded to consider the change of status of

Agent and the A.T.C. Ball check. On motion by Commissioner
Turner, seconded by the County Judge, the Court voted
• unanimously to approve the Claims with the exception of those
noted above.
At 10:46 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 11:09 a.m. the County Judge announced the meeting open
to the public. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to deny the
request submitted by J. D. Langley, Judge of the 85th District
Court.
There being no further business to come before the Court,
the meeting was adjourned.

AGREEMENT
WHEREAS the College Station Independent School District (C.S.I.S.D.) has granted
to Brazos County Road and Bridge Department permission to park various pieces of
heavy equipment and stockpile materials (for a short period of time) to be used by the
County in the area on the C.S.I.S.D. Atheletic Department work-out fields.
It is hereby agreed to by both parties, C.S.I.S.D. and Brazos County that in
exchange for the above stated privileges, Brazos County will do certain improvements as
agreed to by both parties by providing fill soils and maintain fields and surrounding
sidelines in the immediate proximity to said atheletic fields on an "as needed basis".
This Agreement to be in effect for the duration of time necessary for the completion
of work in the area.
This Agreement may be terminated by either party upon a thirty (30) day notice.

It is understood that C.S.I.S.D. and its Administration assume no responsibility for
liability where the County's equipment and materials are concerned.

We, the undersigned, hereby certify to the Commissioner's Court of
Brazos County, Texas, that we have personally inspected the detention facilities at the
Courthouse located in Bryan, Brazos County, Texas, to determine whether the facility
Is suitable for the detention of children as provided by Section 51.12(c) of the Texas
Family Code.
We hereby find that:
1. Children in detention are not detained in or committed to a
compartment of a jail in which adults are detained or committed;
2. Children in detention are not permitted contact with adults who
are detained or committed to jail;
3. The detention facility meets the requirements of Article 5115,
Revised Civil Statutes of Texas, 1925, as amended, defining "safe
and suitable jails";
4. The detention facility meets the "Standards for Juvenile Detention
Facilities" as required by Section 75.041, Texas Human
Resources Code, and as adopted by the Texas Juvenile Probation
Commission, effective the 11 th day of November, 1986.
THEREFORE, the Brazos County Juvenile Detention Center is hereby
certified as a suitable facility for children until the next annual onsite inspection due
one year from the above personal visit, The Commissioner's Court of Brazos County,
Texas, shall be provided copies of said certification, and the original copy shall be filed
with Juvenile Records in the County Clerk's Office.

Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road In Rra7na County,
Texas as follows:
Beginning at the intersection of Emily Drive and Leonard Rd., FM1688 in the
West R.O.W. of Emily Drive and GTE Station 0+00 and Bury telephone cable 3
feet within and parallel to the West R.O.W. of Emily Drive North to GTE
station 8+90 and bore east across Emily Dr. from ditch line to ditch line
approximately 55' and place 2" PVC in bore. Continuing at GTE sta. 14+23
where GTE will place cable in existing 2" pipe under Opal Dr. to a dedicated
utility easement.

Formal notice Is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in nr8get n County,
Texas as follows:
A road bore and buried cable will be placed under Pleasant Hill Road.
The location is 1.5 miles North of Hwy 21 West.
The location and description of this line and associated appurtenances Is more fully shown
by four (4) copies of drawings attached to this notice. The Fne will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein. It is expm:isly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after FPhrllArV 1992
