NOVEMBER 11, 1991
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, November 11, 1991, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1, Absent;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first item on the agenda was to canvas the results of
the General Election held November 5, 1991 to vote on 13
propositions. The totals are as follows:

On motion by Commissioner Sims, seconded by Commissioner

Norton, the Court voted unanimously to accept as true the
cumulative county-wide totals and ordered the results be
certified to the Secretary of State and recorded in the
Official Election Records of Brazos County.
The Court next considered Budget Amendment #91-031 which
would reallocate funds budgeted for the County Attorney's
Department and the department of Constable Precinct 4. On
motion by Commissioner Turner, seconded by Commissioner Sims,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered an Order- appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law II
from November 25, 1991 through November 26, 1991 to allow

Judge Ryan to take personal leave. On motion by Commissioner
Sims, seconded by Commissioner Turner, the Court voted
unanimously to approve the order naming James A. Amis, Jr. as
Special Judge for County Court at Law I for the dates of
November 25, 1991 through November 26, 1991. A full copy of

the order is attached to and made a part of these minutes.
The Court next considered the request by Fairview Water
Supply Corporation to place a road bore across the right-of-
way of Old Spanish Trail Road in Precinct 4. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Turner,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Fairview Water Supply Corporation and
authorized the installation. A copy of the request is
•
attached hereto.
The Court next considered the request by Ferguson
Crossing Pipeline Company to install a 6" steel pipe across
Prospect Lane at the intersection of Short Stuff Road in
Precinct 3. The County Engineer stated that all appeared to
Commissioners' Court meeting November 11, 1991
be in order and recommended approval. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court
voted unanimously to approve the request of Ferguson Crossing
Pipeline Company and authorized the installation. A copy of
the request is attached hereto.
The Court next considered traffic control and load
posting on the following county roads:

Frost Drive 4-way stop condition
WILCOX LANE

Recommended speed limit 40 mph
Recommended/install "Slow Children at Play"

Recommended speed limit 45 mph
Curve No. 1 - 0.1 mi. west of Prospect Lane 35 mph
Curve No. 2 - 0.1 mi. east of Scasta Road 45 mph
Curve No. 3 - Intersection of Riley Road
Recommended safe speed 25 mph
on motion by Commissioner Turner, seconded by Commissioner
Wilcox, the Court voted unanimously to set a Public Hearing on
November 21, 1991 at 10:00 a.m. to hear commentary for or
against the proposed traffic controls and load posting on the
previously named county road.
The Court next considered the annual renewal fee of sixty
dollars (;60.00) for a Professional Land Surveyor's License
for A. H. Winder, County Engineer. The members of the Court
asked how many times the seal had been used for county
business and for filing a document. Mr. Winder answered that
at least four time on county business in the last year and one
time for filing documents in the County Clerk's office. On
motion by the County Judge, seconded by Commissioner Sims, the
Court voted unanimously to pay the annual renewal fee of sixty
dollars ($60.00) for a Professional land Surveyor's License
for A. H. Winder.

On this the 11th day of November 1991 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:

THAT WHEREAS, on November 11, 1991, the Court heard and
approved a budget amendment for the 1991 budget year for Brazos
County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to

meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted October 1, 1990,
the following amendment(s) to the original are hereby authorized,
as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 11th day of November 1991

On this the 11th day of November , 1991, the Commissioners
Court of Brazos County, Texas, convened in Regular Session at the
Special Term of the Court, at the Brazos County Courthouse, in the
City of Bryan, Texas, with the following members present, to-wit:
R. J. Holmgreen, County Judge
Gary Norton, County Commissioner, Precinct No. 1
Walter Wilcox, County Commissioner, Precinct No. 2
Randy Sims, County Commissioner, Precinct No. 3
Milton Turner, County Commissioner, Precinct No. 4.
Among other,proceedings had, the following proposed order was
submitted:
WHEREAS, the Honorable Sarah Ryan, Judge of the County Court
at Law No. 2 of Brazos County, Texas, having made known to the
Commissioners Court of Brazos County, Texas, that on November 25,
1991 and November 26, 1991 she will be absent from the bench for
the purpose of personal leave; and
WHEREAS, she has requested the appointment of the Hon. James
A. Amis, Jr. to sit as Special Judge of the County Court at Law
No. 2 of Brazos County, Texas on the above mentioned dates in all
matters that are, or may be, docketed on the Court's dockets for
those days, and to have and exercise all powers of a Special Judge
in relation to matters involved, it is therefore:

ORDERED, ADJUDGED AND DECREED, pursuant to the authority of
Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.
James A. Amis, Jr., sit and hear all matters that are, or may be,
docketed on any of the Court's dockets on the above-mentioned days
and shall have and exercise all powers of such Special Judge in
relation to the matters involved;
WHEREAS, the Court having considered the proposed order and
deeming that it should be approved; it is therefore:
ORDERED, ADJUDGED AND DECREED by the Commissioners Court of
Brazos County, Texas, that the order as submitted having been read,
it was moved and seconded that same should be approved. Thereupon,
the questions being called for, the following members of the Court

1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any eAisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing lave.
•
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
