VOL --,PAGE -717- COMMISSIONERS' COURT SPECIAL MEETING OCTOBER 28, 1991 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, October 28, 1991, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The Court next considered Budget Amendment #91-030, which I would transfer funds between departments to balance the budget for the end of the fiscal year closeout. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to recommend the following persons be appointed presiding judge and alternate judge for the elections conducted by the county: 1 1 • Ate: ~ p .~rCr Vol. Precinct # Presiding Judge Alternate Judge 21 Georgia E. Trapp 31 Jean McDermott Joy Howze The Court next considered the request of the Brazos Maternal and Child Health Clinic, Inc. to be allowed to purchase health insurance coverage for their employees through the County's employee health care program. This item had been previously tabled for further consideration. There are four (4) full time employees and one 3/4 time employee that they request be included in the insurance coverage. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to deny the request of the Brazos Maternal and Child Health Clinic, Inc. to be allowed to purchase health insurance coverage for their employees through the County's employee health care program. The next matter for consideration was the Redistricting Plan for Commissioners and Justice of the Peace Precincts in Brazos County. The County Judge announced the matter would be tabled until Wednesday, October 30, 1991 at 10:00 a.m.. On motion by Commissioner Norton, seconded by Commis- sioner Turner, the Court voted unanimously to change the name of Woodlake Estates Subdivision, Section Three to Woodlake Subdivision Section II, Phase 2-B. The Court next considered the request by Ferguson Crossing Pipeline Company to install nine (9) welded steel pipelines, three running parallel to and crossing within the right-of-way of Dew Road in Franklin Estates Subdivision, three (3) within the right-of-way of Twelve Oaks Road in Franklin Estates Subdivision and three (3) crossing the right- of-way of River Road in Franklin Estates Subdivision all in • Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commis- sioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Ferguson Crossing Pipeline Company and authorized the installations. A copy of each request is attached hereto. The Court next considered authorizing work outside of VOL V county rights-of-way for the enhancement of county road projects. The Road and Bridge Department requests permission to enter the private property of Perry W. Shirley on Shirley Road to excavate an outlet channel into a pasture for the purpose of improving drainage patterns and for the safety of public travel. The Road and Bridge Department also request permission to enter the private property of Jimmy Kurten on Kurten Lane to cut back underbrush along the fence row to promote better visibility for safe traffic conditions and to enter the private property of Dudley Smith on Fountain Road to clean and reshape an existing outlet channel to allow water to drain in a southeasterly direction. On motion by Commissioner Wilcox, seconded by Commissioner Sims the Court voted unanimously to authorize the work. The Court proceeded to consider the change of status of the following employees. At 10:21 a.m. the County Judge announced the meeting open to the public. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to nominate Tom Borski to the Appraisal Board subject to his acceptance of the nomination. The County Judge recessed the meeting until 10:00 a.m. Wednesday October 30, 1991 at which time the Court would consider the Redistricting Plan for Commissioners and Justice of the Peace Precincts in Brazos County. Day Brazos County Resident i t The County Judge turned the meeting over to Mr. Greg Hudson, representative of Bickerstaff, Heath and Smiley, who outlined the various plans drawn for Commissioner Precincts and Justice of the Peace Precincts. He stated that the i purpose of this meeting was to review the plan favored by the f t court so that a submission can be made to the Justice Department for approval. He continued by saying that to date the Congressional and Legislative lines have not been approved. He then passed out a chart showing new figures r arrived at by using the legislative and congressional lines. He stressed the need to have a plan approved prior to the candidate filing deadline. t The County Judge then opened the discussion to the r I members of the assembled group for questions. i n Rodriguez - stated he would prefer something the local f citizens had worked on and agreed. f Commissioner Turner moved to accept the plan EB. The t, motion was seconded by Commissioner Norton. Ramiro Quintero - agreed with Rodriguez that a more acceptable plan would be one developed by local citizens. Commissioner Norton - stated he felt that we should stay with what we have. Carey Cauley - stated he had no problem with the proposed plan but would like an amendment to the motion saying that the Court will follow legislative lines if approved. Commissioner Sims - told Mr. Cauley that he appreciated his looking at the economic side of adopting the legislative lines. Commissioner Turner amended his motion to include the statement stating that the Court will follow legislative lines if approved. Commissioner Turner indicated that he felt that the local plan as agreed upon by the citizens is better than the plan submitted by Southwest. The Court voted unanimously to approve plan EB. The Court next considered the plan for the Justice of the Peace precincts. Commissioner Norton gave a summary of the Justice of the Peace precincts. He explained the concern involving Justice Precincts 1 and 2. Commissioner Norton read a statement to the Court requesting that precincts 1 and 2 remain the same. Commissioner Norton then recommended Justice V 0 P," G Eg2y - ~J a 4 L +r. of the Peace Plan III be amended to leave precincts 1 and 2 without change. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to adopt Plan III as amended by Commissioner Norton. The Court then directed Mr. Greg Hudson to proceed with their submission to the Justice Department. Copies of the Orders adopting the Commissioners Precincts and Justice of the Peace Precincts are attached. There being no further business to come before the Court, the meeting was adjourned. ! TO FUND BUDGET $0 E ) 1 1 i I I I 1991 Year End Budget Amendments • 0 Lf 1 (4 lc~r e .rrJy STATE OF TEXAS COUNTY OF BRAZOS ORDER ADOPTING COUNTY COMMISSIONER PRECINCTS WHEREAS, The 1990 decennial census disclosed that existing county commissioner precincts in Brazos County, Texas are substantially unequal in population; and WHEREAS, The Commissioners Court of Brazos County has undertaken to redraw county commissioner precincts for the convenience of the people and to equalize population and assure compliance with applicable requirements of state and federal law; and WHEREAS, through a series of public hearings and meetings, the Commissioners Court of Brazos County has received and considered oral testimony and written evidence regarding the need for new county commissioner precincts and an appropriate configuration of those precincts; and WHEREAS, the Commissioners Court of Brazos County finds that the attached maps of the new county commissioner precincts reflects the division of Brazos County into four (4) such precincts for the convenience of the people; THEREFORE, BE IT ORDERED by the Commissioners Court of Brazos County, pursuant to Article V, Section 18 of the Texas Constitution, that Brazos County, Texas be divided into four (4) county commissioner precincts in accordance with Exhibit "A" to this order, which are maps accurately depicting the new county commissioner precincts, and is incorporated by reference into and is made a part of this order.
