SPECIAL MEETING
OCTOBER 21, 1991

A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, October 21, 1991, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held August 26, 1991 and
September 3, 1991. On motion by Commissioner Turner, seconded
by Commissioner Sims, the Court voted unanimously to approve
the minutes as submitted.
The Court next considered Budget Amendment #91-029, which
would reallocate funds budgeted for the Minimum Security Jail
and Budget Amendment #91-92-01 which would transfer funds from
the Maximum Security Jail to the Sheriff's Office and create

the position of Captain. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to approve the budget amendments as submitted, a copy of each

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to recommend the following

persons be appointed presiding judge and alternate judge for
the elections conducted by the county:

on motion by Commissioner Sims, seconded by Commissioner
Wilcox, the Court voted unanimously to adopt a resolution
imposing a $1.50 fee in addition to the fees required
currently under the Texas Motor Vehicle Registration Act, on
each vehicle registered in Brazos County, Texas on or after
October 1, 1991. The said fee fund will be used for school
crossing guards within the Cities of Bryan and College Station
and for such other child welfare measures as provided by the
Texas Legislature. This is done in accordance with Senate
Bill 460 amending Article 6675a-9b.
The Court next considered entering into an Interlocal
Agreement with the City of College Station for the improvement
and reconstruction of I&GN Road from Dowling Road to FM 2818
in College Station. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to enter into an Interlocal Agreement with the City of College
Station for the improvement and reconstruction of I&GN Road
from Dowling Road to FM 2818 in College Station and authorized
the County Judge to execute the document on behalf of Brazos
County. A copy is attached hereto.
The Court next considered the request by Wickson Creek
Special Utility District to place a road bore across the
right-of-way of Dilly Shaw Tap Road at Fawn Lake Estates in
Precinct 2. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by Commis-
sioner Wilcox, seconded by Commissioner Norton, the Court
voted unanimously to approve the request of Wickson Creek
Special Utility District and authorized the installation with
the stipulation that they stay on the back side of the slope.

Commissioners' Court meeting October 21, 1991
The Court next considered the request by GTE Southwest to
place a road bore under Lynette Circle off of Leonard Road in

Precinct 4. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by Commis-
sioner Turner, seconded by Commissioner Norton, the Court
voted unanimously to approve the request of GTE Southwest and
authorized the installation. A copy of the request is
attached hereto.
The Court -received, approved and ordered filed as submitted
the Treasurer's report for September 1991. A copy of which is
attached to and made a part of these minutes.
The Court proceeded to consider the change of status of

RESOLUTION BY THE COLLEGE STATION CITY COUNCIL REQUESTING
THE BRAZOS COUNTY COMMISSIONERS' COURT TO IMPOSE, BY ITS
ORDER, A $1.50 FEE, IN ADDITION TO THE FEES REQUIRED
CURRENTLY UNDER THE TEXAS MOTOR VEHICLE REGISTRATION ACT, ON
EACH VEHICLE REGISTERED IN BRAZOS COUNTY, TEXAS ON OR AFTER
OCTOBER 1, 1991; SAID FEE FUND TO BE USED FOR SCHOOL CROSS-
ING GUARDS WITHIN THE CITY OF COLLEGE STATION AND FOR SUCH
OTHER CHILD WELFARE MEASURES AS PROVIDED BY THE TEXAS LEGIS-
LATURE AND AS MAY BE ENACTED BY THE COLLEGE STATION CITY
COUNCIL; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the Texas Legislature has authorized counties to
impose, by order, a $1.50 per vehicle fee for vehicle regis-
tration in counties; and
WHEREAS, the monies collected under such an order are to be
remitted to the cities in the County after an administration
charge is deducted along with a deduction in an amount equal
to the money attributable to County residents who do not
live in the incorporated portions of the County; and,
WHEREAS, the monies paid over to the cities in the County
under the law are to be used for school crossing guards in
the cities and for certain other child welfare measures as
may be determined by the City Council; and,
WHEREAS, the City of Bryan has already passed such a resolu-
tion;
WHEREAS, the City of College Station City Council finds that
it is in the best interest of all the citizens of College
Station to request that Brazos County impose such a fee;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF COLLEGE STATION, THAT:

The City Council of the City of College Station, Texas,
hereby requests that the Brazos County Commissioners' Court
impose a $1.50 per vehicle fee, effective on the same date
as for Bryan and the rest of the County but no later than
November 1, 1991, on each vehicle registering in the County,
said fee to be collected and distributed in accordance with
Senate Bill No. 460, amending Article 6675a-9b, Texas Re-

This resolution shall be effective immediately upon its
adoption and passage. The City Secretary is hereby directed

A RESOLUTION REQUESTING THE BRAZOS COUNTY COMMISSIONERS' COURT TO

THIS AGREEMENT, made and entered into by and between BRAZOS
COUNTY, TEXAS (hereinafter referred to as "COUNTY" ) ,
acting herein by and through its County Judge and County
Commissioners, pursuant to a resolution duly passed by the
Commissioners' Court of said County and THE C=TY OF
COLLEGE STATION, TEXAS (hereinafter referred to as
" C=TY'•), a body corporate and politic, organized and existing
under to Home Rule Laws of the State of Texas, acting herein by and
through its Council thereunto duly authorized:

WITr7ESSETH :
WHEREAS, said COUNTY and C=TY, pursuant to the
provisions of the Interlocal Cooperation Act, Article 4413 (32c),
Revised Civil Statutes of Texas, as amended have determined that it
would be in the best interest of the COUNTY and C=TY to the
inhabitants thereof that provisions be made for the improvement and
maintenance of specified roads in city by COUNTY :
NOW, THEREFORE , for and in consideration of the
mutual covenants and agreements herein expressed, the C=TY and
COUNTY agree that COUNTY may from time to time perform
work for C=TY consisting of the improvement /reconstruction of
public roads owned by C=TY, provided huwever, all such work
shall be performed in accordance with the following terms and
conditions:

A. Improvement: Shall include the type of betterment/construction
or reconstruction to be done on said streets and roads to the
standard to which the County is capable of performing. Up to and
including double course seal coat, type of drainage and design to
which said roads and streets shall be finished. If the finished
design is an upgrade over the existing design, the request will so
state.
B. Routine Maintenance: Shall include pothole repair, control of
vegetation, grading/leveling and roadside ditch mowing and
cleaning.

C. C=TY, acting by and through its governing body, may request
COUNTY to perform any improvement project within the scope of
this Agreement. Each such request shall specify the road(s)
designated for improvement, their length, and the standard to which
they will be improved. The time and standard to which the College
Station streets and roads will be improved shall be mutually agreed
upon on a project-by-project basis. The Commissioners' Court may
require C=TY to provide any additional information it shall deem
necessary to evaluate such request, including plans and
specifications for the proposed project. Nothing herein shall be
deemed to require COUNTY to consent to the performance of any
work under this Agreement.
D. Before COUNTY may begin work on any individual improvement
project the Commissioners' Court shall give specific written
approval to such project in a document separate from this
Agreement, which written consent shall describe the type of project
to be undertaken and the location thereof. At COUNTY • s sole
discretion, such consent may be conditioned upon CITY • s prior
approval of the Project cost. Should such consent be so
conditioned, the County Engineer and College Station City Manager
or his delegate, shall confer and mutually agree in writing on an
estimate of the cost of performing such work. No action shall be
taken until such estimate is approved by C=TY.
E. 1. For the fiscal year 1990-1991, COUNTY
agrees to maintain those College Station roads
and streets that are initially designated in
the attached Exhibit A.
2. on an annual basis, the Exhibit may be
reviewed by both parties and they shall
designate the roads and streets for that
particular year which may include additions or
deletions.
3. Maintenance or improvements of designated
roads and streets shall be performed as a
function of the office of the County Engineer.
4. The parties, College Station and COUNTY,
hereby agree that the roads and streets
designated in "Exhibit All are the roads and
streets designated for routine maintenance,
which designation includes their length (from
beginning point to ending point).
5. COUNTY agrees that it will perform
continued routine maintenance work on the
roads and streets designated in "Exhibit A" as
a regular course of its business.
F. C2TY, in consideration of the full and true performance of
such maintenance or improvements by COUNTY, hereby agrees and

binds itself to pay the COUNTY all costs incurred by COUNTY
in performance of the work, including but not limited to the cost
of material, but specifically excluding the cost of labor and
equipment used by COUNTY.

G. within sixty (60) days of approval by the COUNTY of the
Project and the C=TY • S acceptance of the cost estimate, the
COUNTY shall in writing provide a statement estimating the
completion date of the project. COUNTY shall not unreasonably
delay performing improvements and/or maintenance that have been
agreed to by both parties. Likewise, C=TY agrees to recognize
any previous commitments COUNTY may have prior to the request
that would prevent performing the requested maintenance and/or
improvements as quickly as C=TY would like. Upon commencement
of construction CoiJNTY agrees to finish construction in a
timely manner, save and except for delays caused by inclement
weather, unavoidable accidents or other unforeseen events
constituting force majeure.
H. During construction all contact by C=TY with COUNTY
shall be by the College station City Manager or his delegate.
C= TY may inspect the improvements and/or maintenance during
construction. C=TY may also inspect and accept the final
product upon completion. Any punch list problems shall be resolved
by joint inspection of the job site and approval of the work
performed by c=TY and COUNTY • S representatives. The
COUNTY shall correct any problems mutually determined by the
parties hereto to need correction.
I. Nothing herein is intended to require COUNTY to provide any
right of way. It is understood and agreed that the providing of
rights of way, engineering work, and plans, designs,
specifications, and all construction staking shall be at the
expense of C=TY.
J. COUNTY shall have the right and authority, upon reasonable
notice to the proper City official, to block streets and roadways,
park equipment on rights of way, and to do all things reasonably
necessary to perform such maintenance, repairs, or additions.

K. COUNTY, upon completion of such work, shall clear away all
tools, machinery, debris and any materials or things which may be
lying about the work site, and shall do everything necessary to
finish all the work in a complete and workman like manner, both in
appearance and in fact.
L. If during the performance of the work, the cost of a project
appears likely to exceed the estimate of costs by more than twenty-
five percent (25%), the Corm Y shall cease all work until such
cost overrun is approved by the C=TY. Upon completion,
COUNTY shall provide C=TY a statement of costs incurred for
any work performed. C=TY shall remit to COUNTY payment of
such costs within thirty (30) days of receipt of the aforementioned
statement. C=TY hereby represents that funds are available from

the budget for the current fiscal year for payment for work
anticipated to be performed hereunder. Cotmww shall maintain
adequate books, records and accounts regarding the Project, which
shall be open to inspection by the C=TY during normal business
hours.
M. This Agreement shall be effective of and from its date of
execution and its term shall be for one (1) year after the date
hereof and it shall be renewed and deemed renewed annually in the
event neither party hereto gives written notice prior to the
anticipated termination date by certified mail, return receipt
requested.
N. This Agreement may be terminated by thirty (30) days written
notice by either party to the addresses designated herein or as may
be designated by either party in writing to the other party from
time to time.
0. In the event that either party fails to perform under this
Agreement the other party shall send written notice, which notice
shall designate the specific act(s) or omission(s) complained of.
The party receiving said notice shall have thirty (30) days to
correct the default(s). Either party shall be entitled to seek
legal remedies for the enforcement of this Agreement.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
on Leonard Road as follows:
On Leonard Road.go West from FM2818 past Porter Fields duplexes
and Mobile Home Park, turn Right at new dirt road to Right, go
to intersection, turn Right (Lynette Cir.) mobile home on Left (blue).
We propose to place a road bore under Lynette Circle at property
line closest to existing next door neighbor.

The location and description of this line and associated appurtenances is more fully shown
by 2 copes of drawings attached to this notice. The will be constructed and maintained
on the County Road right-of-way in accordance with governing laws
Notwithstanding any other provision contained herein, it is exprc,;sly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after October 7.
