THE COMMISSIONERS' COURT WILL MEET IN REGULAR SESSION ON MONDAY,
OCTOBER 14, 1991, AT 10:00 A.M. IN THE COMMISSIONERS' COURTROOM

REGULAR MEETING
OCTOBER 14, 1991
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, October 14, 1991, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Absent;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held July 22, 1991, July 22,
1991 1:30 p.m., July 29, 1991, August 5, 1991, August 12, 1991
and August 19, 1991. On motion by Commissioner Norton,
seconded by Commissioner Sims, the Court voted unanimously to
approve the minutes as submitted.
The Court next considered Budget Amendment #91-028, which

would transfer funds from the minimum security jail to the
maximum security jail and the Sheriff's department. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.

Norton, the Court voted unanimously to accept MCI (State
Contract Agreement) as Brazos County's long distance,,carrier
for telephone service and cancel of current contract with ATC.
Such change to become effective November 1, 1991.
The Court next considered the extension of a contract
between the Brazos Valley Development Council and Brazos
County for the administration of the County Indigent Health
Care Program. By mutual agreement the period will cover
October 1, 1991 through September 30, 1992 for an annual cost
of $48,000. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to extend the
contract between the Brazos Valley Development Council and
Brazos County for the County Indigent Health Care Program. A
copy of the contract is attached hereto.
The next matter before the Court was consideration of the
City County Public Health Agreement between the City of Bryan,
City of College Station and Brazos County for the continuation
of the administrative agency known as the Brazos County Health
Department. The County's portion of the Health Department
budget is $124,174.00 plus $175,374.00 in in-kind services.
On motion by Commissioner Turner, seconded by Commissioner
Wilcox, the Court voted unanimously to enter into agreement
with the City of. Bryan, City of College Station for the
operation of the Brazos County Health Department.
On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to participate,
upon determination of legality, in the Sister City Association
and authorized the payment of $600.00 for membership dues for
1991-1992.

The next matter for consideration was approval to
advertise for bids for the lease of the Minimum Security Jail
property for oil and gas exploration. On motion by the County
Judge, seconded by Commissioner Turner, the Court voted
unanimously to retain Bill Thornton to research the property
documents and prepare the bid specifcation to advertise for
Commissioner's Court meeting October 14, 1991

bids to lease the Minimum Security Jail property.
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requests permission
to enter the private property of Cooter Kenny on Kurten Lane
in Precinct 3 to clear right-of-way in the 'S', curve on Kurten
Lane. On motion by Commissioner Sims, seconded by Commis-
sioner Turner, the Court voted unanimously to authorize the
work.
The Court next considered acceptance of the Right-of-Way
easement submitted by Texas A&M University System for the
widening of Kuder and Pitts Roads to a 70' right-of-way. The
site is located in Precinct 4 adjoining the TAMU Riverside
Campus. On motion by Commissioner Sims, seconded by
Commissioner Turner, the Court voted unanimously to authorize
the County Judge to accept the Right-of-Way easement submitted
by Texas A&M University System.
The Court next considered the request by Ferguson
Crossing Pipeline Company to install a 6 5/8" O.D. natural gas
pipeline across Fountain Switch and Silver Hill Roads off
Highway 21 in Precinct 4. Ferguson Crossing Pipeline Company
also requested permission to install a 6" steel pipeline
within the right-of-way on Grassbur Road in Precinct 3. The
County Engineer stated that all appeared to be in order and
recommended approval of both requests. On motion by Commis-
sioner Norton, seconded by Commissioner Turner, the Court
voted unanimously to approve the requests of Ferguson Crossing
Pipeline Company and authorized the installations. This
approval is subject to the equipment staying off the county
roads unless the roads are protected. A copy of the request
is attached hereto.
The Court acknowledged receipt of the Extension Service
reports for September 1991 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those

The Court proceeded to consider the change of status of
the following employees.

Commissioner Sims asked why the jail purchased four (4) dozen
china plates. and salad forks. The Sheriff replied that the
china plates were actually white plastic plates but he did not
know about the salad forks. He said he would check on the
forks. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve
the Claims as submitted.
At 11:00 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 11:10 a.m. the County Judge announced the meeting open
to the public. On motion by the Commissioner Turner, seconded
by Commissioner Norton, the Court voted unanimously to
authorize the application made by C. W. Benson for military
service credit with the Texas County & District Retirement
System and approved the payment of $540.00 in matching funds.
There being no further business to come before the Court,
the meeting was adjourned.

EXTENSION OF COUNTY INDIGENT HEALTH CARE PROGRAM
BETWEEN BRAZOS COUNTY
AND BRAZOS VALLEY DEVELOPMENT COUNCIL
October 1, 1991 - September 30, 1992
The contract between the Brazos Valley Development Council and
Brazos County for the County Indigent Health Care Program has been
extended by mutual agreement to cover the period October 1, 1991 -
September 30, 1992, for an additional $48,000. All other terms
and conditions of the original contract shall remain the same.

WHEREAS, the City of Bryan, the City of College Station and Brazos
County, have created an administrative agency named the Brazos County Health
Department for the public purpose and objective of administering and
enforcing all federal and state health laws and city health ordinances in the
respective jurisdictions of each of the participating governmental entities;
and
WHEREAS, Article 4413(32c), V.A.T.C.S., authorizes intergovernmental
contracting at the local level including contracts between counties and
cities; and
WHEREAS, the City of Bryan, the City of College Station and Brazos
County, subject to the limitations set forth herein, intend to share in the
cost on a percentage basis with the County to collect and disburse the funds;
NOW, THEREFORE, THE UNDERSIGNED MUTUALLY AGREE AS FOLLOWS:

This contract is for a period of one year and all payments shall be made
/rom current revenues of each of the parties. Payments shall be made by the
City of College Station and the City of Bryan to Brazos County at the Brazos
County Courthouse prior to the tenth day of each month with each monthly
share representing one-twelfth (1/12) of the respective total share of the
cities. If credit is due any of the parties, Brazos County shall make the
necessary reimbursement no later than the end of the first (1st) quarter of
the next fiscal contract year. Reimbursement due to overpayment shall be
made in the amount overpaid by the entity. All unencumbered funds at the
close of the contract year shall be deposited into the Public Health Account
(see Section 5) to•be designated for use for Public Health Services mutually
beneficial to each party, or shall be used to reduce local budget
contributions in the following fiscal year. No appropriation of the money
in this Agreement shall be made unless unanimously approved by the City of
Bryan, the City of College Station and Brazos County.

The chairman of the governing board shall have the authority to make
expenditures as budgeted. Authority for non-budgeted items shall come only
from the approval of the governing board (known as the Brazos County Board
of Health).
5.
The Brazos County Health Department shall maintain records of all income
(service fees collected) and disbursements of the Public Health Account.
Such records shall be brought before the governing board each quarter for
approval. No appropriation of money in this account shall be made unless
unanimously approved by the governing board.
6.
The Brazos County Health Department shall maintain records of usage of
the facilities and services by the citizens of each city and citizens of the
county who live outside the two cities. Such records shall be used to
determine the percentage of costs to be charged to the participating entities
for the following contract year.

The Brazos County Health Department will be under the supervision of the
governing board consisting of one representative from each of the three
participating governmental entities.

This contract can be renewed on an annual basis by resolution.

9.
The Director of the Brazos County Health Department shall submit
financial and activity reports for both Health Department and Public Health
Accounts upon request by members of the governing board; but in no event
shall such financial and activity reports be submitted less frequently than
quarterly. The Director shall submit the annual financial and activity
report no later than the close of the first quarter of the next fiscal year.
10.
Brazos County agrees to procure and maintain public liability insurance
in the amount of not less that $1,000,000.00, insuring against risks and
claims arising out of the operation of the Health Department (except for
professional liability claims against medical doctors, who shall provide
their own professional liability insurance). The cost of liability insurance
shall be included in the annual budget of the Brazos County Health
Department.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to be
executed as the 1st day of October, 1991.

occur to any eAisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.

Formal notice is hereby given that (Applicant) Ferguson Crossing Pipeline Co.
proposes to place e (type) 6 5/8 inch 0. D.
pipeline within the right-of-way of (Road) Fmint-.ain Switch Rd.
In Brazos County, Texas as followes
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.
(Applicant) Fera uson ~rossing Pipeli,nanderstand and agree that:
Co.
1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any egisting utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no lees than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
Construction of this line will begin on or after (date) 10-14-91 .

Application for Current Service Credit for Military Service should be completed and submitted only if the follow-
, Ing requirements are met:
(a) The applicant was relieved from active military service under conditions other than dishonorable.
(b) The applicant is not and will not receive military retirement benefits provided by any federal law or reg.
ulation or federal retirement Act for at least twenty (20) years active duty.
(c) The applicant is not and will not be granted credit by any other retirement system or program estab-
lished or governed by the laws of this State for the same military service for which credit is being sought
with the Texas County and District Retirement System.
(d) The applicant's military service was active military service during the period from April 6, 1917 to
November 11, 1919, or from October 16, 1940 to October 31, 1974.
(e) The applicant must be a member of the Texas County & District Retirement System. If applying for mil-
itary service credit of three (3) years or less, the applicant must have been employed at least ten (10)
years by the participating subdivision and have at least ten (10) years retirement credit as an employee.

applicant must have been employed at least fifteen (15) years by the participating subdivision and have
at least fifteen (15) years retirement credit as an employee.
(f) The application must be accompanied by the applicant's contribution and the subdivision's matching
