TEXAS AGENDA BRAZOS COUNTY COMMISSIONERS COURT MEETING THE COMMISSIONERS COURT WILL MEET IN SPECIAL SESSION ON TUESDAY, SEPTEMBER 3, 1991, AT 10:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS. 1. Invocation. 2. Pledge of Allegiance. 3. Consider and take action on an Agreement between Brazos County and the Brazos County Emergency Communications District 9-1-1 appointing the 9-1-1 as the emergency dispatching authority for Brazos County beginning October 1, 1991 through September 30, 1992. 4. Consider and take action request from Wickson Creek Special Utility District to bore across the following county roads for the installation of water lines: 1. Dilly Shaw Tap Road (.02 miles west of Reed Road) in precinct 2 2. Deer Run Road in Deerfield Estates in precinct 3. 5. Consider and take action on personnel change of status. 6. Consider and take action on payment of claims. 7. Adjourn • COMMISSIONERS' COURT SPECIAL MEETING SEPTEMBER 3, 1991 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, September 3, 1991, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: • Ruth McLeod Executive Assistant Bea Green Secretary to Commissioners Rosalie Todaro Auditor's Office A. H. Winder County Engineer Sandie Walker Treasurer Anne Friedenberg KBTX-TV Joe Larger KBTX-TV Commissioner Sims gave the invocation and led the pledge of allegiance. The first matter before the Court was consideration of an agreement between Brazos County and the Brazos County Emergency Communications District 9-1-1. This agreement would appoint the 9-1-1 district as the emergency dispatching authority for Brazos County beginning October 1, 1991 through September 30, 1992. Brazos County will pay one hundred seven thousand six hundred twenty three dollars ($107,623) and • no/100 as compensation for the services provided by the district. On motion by Commissioner Norton, seconded by Com- missioner Sims, the Court voted unanimously to enter into agreement with the Brazos County Emergency Communications District 9-1-1 to appoint the district as the emergency dis- patching authority for Brazos County. A copy of the agreement is attached hereto. The Court next considered the request by Wickson Creek Special Utility District to bore under the right-of-way of , Commissioner's Court meeting September 3, 1991 Deer Run Road in Deerfield Estates in Precinct 3 and to bore under the right-of-way of Dilly Shaw Tap Road in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the installation. A copy of each regriest is attached hereto. The Court proceeded to consider the change of status of the following employees. WHEREAS, Brazos County is also a political subdivision of the State of Texas authorized to enter into interlocal cooperative governmental agreements; and, WHEREAS, the Brazos County Commissioners in public • meeting find that it is mutually beneficial for the County and the District to enter into an agreement for the District to perform for the County, Emergency Communications Services Dispatching; NOW THEREFORE; IN CONSIDERATION of the mutual promises to each other made hereinafter, the undersigned parties agree as follows: Effective October 1, 1991 the District is hereby appointed the emergency communications dispatching authority for Brazos County for the period October 1, 1991 through and including September 30, 1992. The District, shall be responsible for providing a functioning computer aided dispatch system to the County. r i 4 The County agrees to pay and the District agrees to accept as compensation for the services provided a flat fee of one hundred seven thousand six hundred twenty three 1($07,62 and N01100 DOLLARS. The County shall pay the full amount due within ten days of invoice from the District. All payments shall be subject to the Texas Prompt Payment Act. Should there arise any dispute, disputed amounts shall be deposited in a mutually agreed upon escrow account until a resolution. District employees shall not be considered as County employees. The County and the District understand and,agree to be subject to all the laws, ordinances and regulations which govern and affect Emergency Communications D13patching and National Crime Information Computer network telecommunications as promulgated by the State of Texas or the United States Government or any of its appropriate Agencies, such as the Texas Department of Public Safety or the Federal Bureau of Investigation. This agreement is made in accordance with the Texas Emergency Telephone Number Act, Section 772.301 et seq., Texas Health and Safety Code. Each of the parties to this agreement agrees to hold the other harmless for any and all claims of whatsoever nature or kind which may arise as a result of that parties' fulfillment of this agreement. y Ai • Each party hereby empowers and authorizes its Chief Administrative officer to be signatory agents for any required documentation to implement the intent of this Agreement. This agreement contains all of the commitments and covenants of the parties and any oral or written promises not contained herein shall have no force or effect to alter any term or condition of this agreement. This agreement may only be modified or amended in • writing by the mutual consent of the parties with said modification being attached to and incorporated into this agreement by this reference for all purposes. That the line will be constructed and maintained on the County right- of-way in accordance with governing laws. 6..
