INTERGOVERNMENTAL AGREEMENT FOR JAIL SERVICE
This agreement, made and executed by and between the City of Bryan, A Taxes
Home Rule Municipality, hereinafter referred to as 'Bryan', and the County of Brazos,
hereinafter referred to as 'Brazos County', provides as follows:
WHEREAS, Brazos County and the City of Bryan, Texas are political subdivisions
of the State of Texas and bound by the Constitution and laws thereof; and,
WHEREAS, Article 4413 (32c), Texas Vernon's Ann. Civ. Stat., Intergovernmental
Cooperative Act provides that agreements to provide services between governmental
units are permitted; and,
WHEREAS, fail service may be provided by and between home rule municipalities
and counties when such agreements would best serve the interests of the citizens of
each; NOW THEREFORE, for and in CONSIDERATION of the mutual covenants and
promises herein made, Bryan and Brazos County hereby agree as follows:
SECTION 1. USE OF BRAZOS COUNTY JAIL
a) Brazos County hereby authorizes Bryan to deliver to its jail Bryan prisoners
charged with Class C misdemeanors for safekeeping as space is available, until such
prisoners can be brought before a City Of Bryan Municipal Court Judge, as provided by
law. It Is agreed by the parties that the extent of the responsibility of Brazos County shall
be for safekeeping, housing and feeding of such prisoners as prescribed by law, placed
in its custody. Bryan shall be solely responsible for the delivery of, accounting for and
release of its prisoners, as prescribed by law, placed with Brazos County for
Incarceration.

b) Upon delivery of a Bryan prisoner, it shall be the decision of Brazos County
as to whether Brazos County will accept any prisoner for incarceration. It Is agreed that
Bryan shall exercise its best efforts to assure that no ill, physically or mentally, or injured
Bryan prisoner is presented for Incarceration at the Brazos County jail facility. The
"Guidelines' attached hereto as Exhibit 'A' and incorporated herein by this reference for
all purposes shall control the housing of Bryan prisoners. Brazos County shall provide
to the Bryan Police Chief a copy of its jail policy and procedures manual.
c) In the event Brazos County determines that any Bryan prisoner Is ill, Injured
or otherwise in need of medical attention, Brazos County shall notify Bryan to deliver said
prisoner to St. Joseph's Hospital for treatment, except in the event that Brazos County
determines that the Bryan prisoner should require immediate medical treatment. Bryan
shall be responsible for providing a judge at the hospital to bond said prisoner out of
custody if it so desires. In the event that Brazos County is required to transport a Bryan
prisoner, Bryan shall also assume the cost of any necessary ambulance transportation
to St. Joseph Hospital, Bryan.
SECTION 2. COMPENSATION. For any time during each twenty-four (24) hour period

between 12 midnight and 11:59 p.m., in which Brazos County Incarcerates a Bryan
prisoner, Bryan shall pay to Brazos County Thirty Dollars ($30.00) for the incarceration
of that prisoner.
SECTION 3. LIABILITY.
a) Bryan shall be liable and shall indemnify and hold Brazos County harmless
for any decision to incarcerate any Bryan prisoner.

A
b) Bryan will not place In the Brazos County jail facility any III or injured Bryan
prisoner without first providing to Brazos County an approval signed by a medical doctor.
c) Bryan shall be liable and shall pay the cost of any necessary ambulance
transportation to St. Joseph Hospital or any hospital facility for any ill or injured Bryan
prisoner placed In the Brazos County Jail facility.
d) After receiving a Bryan prisoner from Brazos County and while Bryan
maintains the prisoner in its 'custody' while said prisoner is receiving medical treatment,
Bryan shall be liable for the prisoner and shall indemnity and hold Brazos County
1 harmless for any claim by the prisoner until said prisoner Is either released by bond or
returned to Brazos County.
e) Where Bryan has placed a Bryan prisoner in the Brazos County jail facility,
and an injury to the prisoner occurs Bryan agrees to accept responsibility for the cost of
defense of any litigation involving Brazos County, except that in the event that an Injury
has occurred to a Bryan prisoner as a direct result of the sole negligence of Brazos
County with regard to the actual supervision of such Bryan prisoner in its jail facility.
Q Brazos County agrees to abide by all rules and or regulations as prescribed
by the Texas Commission on Jail Standards.

SECTION 4. EFFECTIVE DATE OF AGREEMENT.
a) This agreement shall be in full effect and legally binding at such time as it

court.
b) This agreement may be executed in multiple originals.

SECTION S. TERMINATION OF AGREEMENT. This agreement shall remain In force
and effect for a period of one year from the date of execution, as provided In Section 4.

GUIDELINES FOR HOUSING BRYAN PRISONERS
AT BRAZOS COUNTY JAIL FACILITIES
1. Bryan shall notify Brazos County in advance of arrival that a prisoner(s) Is In route.
2. Bryan Is responsible for obtaining a 10-27, CCH for the County.
3. Bryan shall follow Brazos County normal booking procedures.
4. Bryan shall be responsible for a prisoner's property.
5. Brazos County shall fill out a property form for a prisoner's personal property only
if applicable.
6. Brazos County shall not accept any Bryan prisoners obviously in need of medical
attention.
7. Brazos County shall require a signed physician's release when there is any doubt
as to the physical/mental condition of any Bryan prisoner.
8. Brazos County shall have the sole discretion of the acceptance of any Bryan
prisoners.
9. Brazos County shall notify Bryan when it has determined that a Bryan prisoner in
custody is in need of medical attention.
10. Bryan shall be responsible to deliver a prisoner in need of non-emergency medical
attention, to St. Joseph's Hospital Bryan.
11. Brazos County shall summon the Bryan Fire Department ambulance to transport
any Bryan prisoner to St. Joseph's Hospital who is determined to be in need of
immediate medical attention.
12. Bryan shall be responsible for the release of Bryan prisoners.
13. Brazos County shall not accept any bonds on any Bryan prisoner.
14. Brazos County shall log all Bryan prisoners in the jail log book and place the
abbreviation B.P.D. by the prisoner's name.
15. Brazos County shall be responsible for checking on prisoners regularly and feeding
prisoners at appropriate times.

RESOLUTION NO.
A RESOLUTION OF THE COUNTY COMMISSIONERS OF THE COUNTY
BRAZOS AUTHORIZING THE SUBMISSION OF A TEXAS COMMUNITY
• DEVELOPMENT PROGRAM APPLICATION TO THE TEXAS DEPARTMENT
COMMERCE FOR THE COMMUNITY DEVELOPMENT FUND; AND
AUTHORIZING THE COUNTY JUDGE TO ACT AS THE COUNTY'S
EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE IN ALL
MATTERS PERTAINING TO THE COUNTY'S PARTICIPATION IN THE
COMMUNITY DEVELOPMENT PROGRAM.

WHEREAS, the County Commissioners of the County of Brazos
desire to develop a viable rural community, including
decent housing and a suitable living environment and
expanding economic opportunities, principally for persons
of low/moderate income; and
WHEREAS, certain conditions exist which represent a threat
to the public health and safety; and
WHEREAS, it is necessary and in the best interest of the
County of Brazos to sponsor an application on behalf of
the Wellborn Water Supply Corporation for funding under
the 1991 Texas Community Development Program;
NOW THEREFORE BE IT RESOLVED:
1. That a Texas Community Development Program
application for the Community Development Fund is
hereby authorized to*be filed on behalf of the
Wellborn Water Supply Corporation with the
• Texas Department of Commerce.
2. That the County's application be placed in
competition for funding under the Community
Development Fund.
3. That the application be for $ 198,745 of grant
funds to carry out Wellborn Water Supply Corporation
water system improvements and water
distribution expansion.
4. That the County Commissioners Court directs and
designates the County Judge as the County's Chief
Executive Officer and Authorized Representative
to act in all matters regarding this application
and the County's participation in the Texas
Community Development Program.
5. That it further be stated that the Wellborn Water
Supply Corporation is committing $ 22,100 of
in-kind services as a contribution toward the
construction activities of this water
distribution system project.

The location or description of the proposed inst0 lation is more fully
shown by _1~0 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (240) lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
