COMMISSIONERS' COURT REGULAR MEETING • JULY 8, 1991 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, July 8, 1991, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Pittman Louis Garcia, Jr. Phyllis Dozier Ron Miller Jim Hiney Richard Rosas Travis Bryan III Martin Riley Executive Assistant Secretary to Commissioners Auditor's Office Auditor's Office County Engineer Treasurer Deputy Constable Pct. 7 Constable Pct. 7 Constable Pct. 4 Brazos Center Sheriff Bryan/College Station Eagle Rosas Trucking Attorney Riley Engineering Commissioner Sims gave the invocation and led the pledge of allegiance. The County Judge read aloud a Proclamation proclaiming Wednesday July 10, 19;91 as "Brazos County Blood Day". The Court joins with the local Red Cross Chapter to encourage the members of the community to donate so that blood is available • in su'ficient quantities to meet the needs of all hospital patients. On motion by Commissioner Norton, seconded by Commissioner Turner the Court moved to proclaim Wednesday, July 10, 1991 as "Brazos County Blood Day" throughout Brazos County. The County Judge then presented the signed Proclamation to Mrs. Rhonda Seaton, representing the local Red Cross Chapter. Vin, Commissioners' Court meeting July 8, 1991 The Court next considered Budget Amendment #91-018, which would reallocate funds budgeted for the Commissioners' Court, the 361st District Court and the Brazos Center. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered awarding the following bid: Bid No. 91-609 - Sale of Brazos County Property 1506 S. College Avenue On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to table consideration until a later date. The next matter before the Court was reconsideration of bid number 91-608 for a 1991 Cargo Van for the Sheriff's Department. Lawrence Marshall Chevrolet had not submitted written confirmation as of the deadline date of May 31, 1991. Cheryl Turney, Purchasing Agent, informed the Court that the company can not meet the delivery date of July 19, 1991 since production for this model will not begin until the 15th of July and there is no guarantee it will be produced. The Sheriff recommended going to the next bidder, Tom Light Chevrolet. On motion by Commissioner Wilcox, seconded by Commissioner Norton, the Court voted unanimously to forward a letter to Lawrence Marshall Chevrolet notifying them that the Court has withdrawn the contract, and to notify Tom Light Chevrolet that the bid had been awarded to them. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to change long distance carriers for six (6) pay telephones in the Courthouse and outlying buildings from ATC to MCI due to MCI paying a higher rate of commission of 23%. The County Judge also requested that ATC be notified of the change. The Court next considered a request from Constable Precinct 4, Louis Garcia, in which he asked the Court to transfer three (3) vehicles from the Sheriff's Department to Vol, --)L-v I Commissioners' Court meeting July 8, 1991 • • his department. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to transfer the vehicles from the Sheriff's inventory to the Constable's inventory. Commissioner Sims commented that he would like to see the vehicles sold at auction as soon as possible. He then asked the Purchasing Agent to check with the cities of Bryan and College Station to see if these vehicles could be included in their auctions. The next matter for consideration was a request from Constable Precinct 7, Winfred Pittman, for authorization to appoint the following individuals as Reserve Deputies: Kevin P. Kelley James M. Meadows David E. Horton, Sr. Constable Pittman informed the Court that the previously named individuals had completed the necessary and required training for the position. On motion by Commissioner Wilcox, seconded by.Commissioner Norton, the Court voted unanimously to approvo the request of Constable Pittman and authorized him to appoint the afore mentioned individuals as Reserve Deputies. The Court next considered two (2) Special Warranty Deeds conveying property to Pleasant Grove Baptist Church and Joyce Pena. Commissioner Norton commented that there was nothing attached to either deed showing proof of title search, notice to previous property owner or the amount of taxes owed. He recommended tabling consideration until the necessary material is supplied. It was the consensus of the Court to table consideration until the Tax Assessor/Collector could be called to corm to the meeting and show the necessary paper work. The County Judge announced that there would be a public hearing on July 22, 1991, at the Brazos County Courthouse, in the Commissioners' Courtroom beginning at 1:30 p.m. to hear commentary for or against reducing the load limits on Democrat Road and Oak Lake Road in Precinct 3. The Court next considered three requests by Ferguson Pipeline Company for pipeline installations. The locations A C-" . I i f Commissioners' Court meeting July 8, 1991 are across Hopes Creek Road, across Dogwood Trail and running parallel to the road and across River Road. The County Engineer stated that all appeared to be in order. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the three requests of Ferguson Pipeline Company and authorized the installations. A copy of each request is attached hereto. The Court next considered three requests by GTE Southwest Incorporated to place a buried communication line in the following locations. Along and across the right-of-way of Macey Road in Precinct 2 making two (2) bores under the road at two different locations, running parallel with a road bore across Elmo Weedon in Precinct 3 and parallel and across Old Reliance Road in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the three requests of GTE Southwest Incorporated and authorized the installations. A copy of each request is attached hereto. The Court next considered approval of the final plat of the Tall Timbers Subdivision in Precinct 1. Holland Winder, County Engineer, stated that he had reviewed the plat with the recommended changes and it appeared to be in order. Commissioner Wilcox asked about the curve on Timberwild Road; if it was a 90 degree curve. Martin Riley, the Surveyor, stated that it was very close to it. Commissioner Wilcox recommended that it be redesigned. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court unanimously approved the final plat of the Tall Timbers Subdivision and that a note appear on the plat and each deed stating that the County has no responsibility for maintenance, construction or drainage on the roads. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requested permission to enter the private property of Tom Mahoney on Fawn Lake V O L____~-r.e-~° Y Commissioners' Court meeting July 8, 1991 • Drive for the purpose of constructing an outlet channel into the Mahoney property to allow water to drain from Fawn Lake Drive. The road and Bridge Department also requested permission to enter the private property of Dr. Gary Cole on Woodlake Drive to install two (2) driveway culverts and clean out the channel downstream for erosion and flood control. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court acknowledged receipt of the Extension Service reports for June 1991 and acknowledged receipt of reports from County and Precinct offices showing revenues collected and remitted to the County Treasurer. Task Force-----Claims 12950 thru 12958 On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. At 10:34 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed SO: Commissioners' Court meeting July 8, 1991 executive session to discuss personnel as allowed under Section (6252-17(2)(g) Vernon's Texas Civil Statutes. At 11:18 a.m. the County Judge announced the meeting open to the public. The Tax Assessor/Collector, Buddy Winn, appeared before the Court to answer questions concerning the Special Warranty Deeds conveying property to the Pleasant Grove Baptist Church and to Joyce Pena. Commissioner Norton asked Mr. Winn for copies of the title search. Mr. Winn informed Mr. Norton that University Title had done the title work for the hearing before the District Judge, that Mr. Albert Walker, former delinquent tax collection attorney was in possession of the paperwork and that he would get a copy of it. Commissioner Norton also requested that backup work be produced on the sale of all property before the county executes the deeds. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to execute the Warranty Deeds transferring the property. On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to deny the request of County Court at Law I Judge, Sarah Ryan and 85th District Judge, J. D. Langley, to pay Mr. Walter Vance for the time he served as temporary bailiff prior to being placed on the county payroll. The decision was based on an Attorney General's Opinion not allowing for retroactive pay. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to deny the request of the Director of the Brazos Center to pay Mr. Delfino Sandoval the increase in ~r salary that was approved in the 1991 budget but not actually paid to him due to a clerical error. The decision was based on an Attorney General's opinion not allowing for retroactive pay. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to deny the request of the head of Data Processing to promote Linda Albritton to the position of Operations Supervisor.
