THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,

6. Consider and take action on Resolution in regard to a grant

COMMISSIONERS' COURT
SPECIAL MEETING
JUNE 17, 1991
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, June 17, 1991, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sins, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held March 18, 1991, March 25,
1991 and April 1, 1991. On motion by Commissioner Turner,
seconded by Commissioner Sims, the Court voted unanimously to
approve the minutes as submitted.
The Court next considered Budget Amendment #28 for the
1990 budget, which would transfer funds from the Non Depart-
mental Department to various other departments. The Court
also considered Budget Amendment #91-016 for the 1991 budget,
which would increase the budget of the Judicial Appellate
Fund, increase the budget of the Buildings and Yards
Department, decrease the budget of the Non Departmental
Department and reallocate funds for the Tax Office. On motion
by Commissioner Norton, seconded by Commissioner Sims, the

Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered an order appointing L. J.
Krueger to sit as Special Judge in County Court at Law II on
June 20, 1991 to allow Judge Ryan to pursue continuing legal
education. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve
the Order naming L. J. Krueger as Special Judge for County
Court at Law II on June 20, 1991. A full copy of the order is
attached to and made a part of these minutes.
The Court next considered adopting a Resolution from the
Wellborn Water Supply Corporation requesting the County to
make application for a Community Development Grant to support
the Wellborn Water Supply Corporation in their efforts to
bring potable water to the residents of the Cawthon area in
Brazos County. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the County Judge to make application on behalf of Brazos
County to the Texas Community Development Program and accept
on behalf of Brazos County any such funds as may be tendered.
A copy of the resolution from the Wellborn Water Supply
Corporation is attached hereto.
The Court next considered correcting an error in the

Northwestern National Life Insurance Company group insurance
plan for Brazos County. On September 1, 1991, out patient
surgery expenses were no longer to be paid at 100%. On page
five (5) of the group insurance health booklet it states that
out-patient surgery expenses will be paid at 100%. To date
seven (7) out patient surgeries have been paid as regular
claims. On motion by the County Judge, seconded by Commis-
sioner Norton, the Court voted unanimously to leave the
booklet as is, to direct Northwestern National Life Insurance
company to pay out patient surgery expenses at 100% and to pay
the seven previous claims at 100%.

The Court acknowledged receipt of the Order of the
District Courts appointing the County Auditor to a two (2)

year term beginning June 1, 1991 through June 1, 1993. A copy
of the Order is attached hereto.
The Court next considered the request by Baker Explora-
tion Company (BEXCO) to install a 6" low pressure water line,
within the right-of-way of Steep Hollow Road in Precinct 3.
The County Engineer stated he had reviewed the request, that

all appeared to be in order and that he recommended approval.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the request of
a
Baker Exploration Company and authorized the installation. A
copy of the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
'
projects. The Road and Bridge Department requested permission
to enter the private property of Donald Corrier for the
purpose of directing the flow of water under Broach Road to
prevent erosion and flooding across Castenson Road. On motion
by Commissioner Wilcox, seconded by Commissioner Turner, the
Court voted unanimously to authorize the work. The Road and
Bridge Department also requested permission to enter the
private property of David Holmes for the purpose of lowering
a pond spillway allowing water to drain from Gandy Road and
the ditch. This is for the enhancement of a county right-of-
way and for the health and safety of the general public. On
motion by Commissioner Norton, seconded by Commissioner Sims,
the Court voted unanimously to authorize the work.

Special Term of the Court, at the Brazos County Courthouse, in the
City of Bryan, Texas, with the following members present, to-wit:

that are, or may be, docketed on the Court's docket for that day,
and to have and exercise all powers of a Special Judge in relation
to matters involved, it is therefore:

Resolution
A Resolution of the Board of Directors of the Wellborn f
Water Supply Corporation (W.S.C.) requesting sponsorship i
by the Brazos County Commissioners Court of a 1991 Texas
Community Development Program
WHEREAS, the Wellborn Water Supply Corporation (W.S.C.)
provides potable water to residents in Brazos County, and
WHEREAS, the Cawthon area of Brazos County is not
currently served by a central water system, and
WHEREAS, Brazos County is an eligible applicant for Texas
Community Development Program funds.
Now, therefore be it resolved by the Wellborn W.S.C. Board
of Directors:
1. That the Commissioners Court of Brazos County be
is requested to sponsor a grant application under the
Texas Community Development Program on behalf of
the Wellborn W.S.C.
2. That the purpose of this grant application will be
to provide water service to the Cawthon area of
Brazos County.
3. That it is understood by the Board of Directors
that the Brazos County Commissiooners Court must
give final approval to the grant application and
Brazos County will be the grant recipient
organization should the grant be approved by the
State of Texas.

Formal notice is hereby given that (Applicant) BEXCO Operating, Inc.
proposes to place a (type) 6" Low Pressure Water
pipeline within the right-of-way of Road Steen Hnllow_R ad
in Brazos County, Texas as follows: 1.55 miles East of FM 1179 on Steep Hollow Rd.
2.21 miles West of Elmo Weedon Road on Steep Hollow Rd.
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.
(Applicant) BEXCO Operating, Inc. , understand and agree that:
1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
1 location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.

3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
' 4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to an~ existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
Y 7. That all roads be bored to forty feet (40') on either side of the
s centerline of the right-of-way or cased for such distance.
8. That all sites will be barricaded during construction period.

9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
Construction of this line will begin on or after (date) June 20, 1991
