THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
MAY 20, 1991, AT 10:00 A.M. IN THE COMMISSIONERS' COURTROOM OF
THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115,

in Seven-Eleven Subdivision in Precinct 1.

COMMISSIONERS' COURT
SPECIAL MEETING
MAY 20, 1991
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, May 20, 1991, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The first matter before the Court was the reconfirmation
of the utility easement at the Brazos Center. Due to the
expansion of the museum, the City of Bryan requested that the
County define the easement. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to authorize the County Judge to execute the public utility
easement document and forward it to the City of Bryan. The
public utility easement is recorded in the Official Records in
the County Clerk's Office.
The next matter for consideration by the Court was a
written request submitted by the County Extension Agent
requesting approval for out of state travel for Rebecca Dimak.
Mrs. Dimak would be traveling to Montana to accompany 38 4-
Her's plus three chaperons to participate in the

Montana/Brazos County Exchange Program during the week of June
25 through July 2, 1991. on motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to grant the request from the County Extension Agent and
approved payment of out of state travel expense for Rebecca
Dimak.
The Court next considered entering into agreement with

the Texas Department of Criminal Justice Pardons and Paroles
Division for the transfer of inmates being held in the Brazos
County Jail on Blue Warrants to Bexar County. Term of the
agreement will become effective upon acceptance and will
continue until August 31, 1991, at which time it may be
extended for additional one year periods upon the mutual
agreement of the Texas Department of Criminal Justice Pardons
and Paroles Division and the County. on motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to enter into agreement with the Texas
Department of Criminal Justice Pardons and Paroles Division
for the transfer of inmates to Bexar County and authorized the
County Judge to execute the Agreement on behalf of Brazos
County. A copy of the Agreement is attached hereto.
The Court next considered awarding the following bids:

Cheryl Turney, Purchasing Agent, recom-
mended tabling consideration to allow her
time to review the bids. Ron Miller,
Sheriff, recommended acceptance of the
low bid submitted by Lawrence Marshall.
Commissioner Norton moved to accept the
recommendation of the Sheriff. Commis-
sioner Turner seconded the motion. Com-
missioners Norton, Turner and Wilcox
voted "Aye" Commissioner Sims voted "No".
The motion carried and the bid was
awarded to Lawrence Marshall.

The Court next considered the request by Wellborn Water
Supply Corporation to install a water line, within the right-
of-way of Timberline Drive in Precinct 1. The County Engineer
stated that all appeared to be in order. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of Wellborn Water
Supply Corporation and authorized the installation. A copy of
the request is attached hereto.
The Court considered a second request by Wellborn Water
Supply Corporation to install a water line, within the right-
of-way of Bird Pond Road in Precinct 1. On motion by
Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve the request of Wellborn
Water Supply Corporation and authorized the installation. A
copy of the request is attached hereto.
On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to authorize the
County Judge to accept on behalf of Brazos County right-of-way
easement deeds from Carol Anderson and Jean Stephens to extend
Greens Prairie Road. In lieu of payment, the County will
replace the fence along the donated right of way.
The Court next considered the request by United Telephone
Company of Texas to install a buried communication cable along
the right-of-way on Westward Ho in the Seven-Eleven
Subdivision in Precinct 1. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request of United Telephone Company of Texas
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered approval of the preliminary
vacating plat and re-plat of Oak Lakes Estates Subdivision
lots 1 and 2 and lots 11 and 12, Block 1 of Quail Run Estates.
Christian Galindo, representative of Galindo Engineers and
Planning explained to the Court they were taking lots 11 and
12 from Quail Run and combining them with lots 1 and 2 of Oak

Lakes Estates. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court unanimously approved the
preliminary vacating plat and the replat of Oak Lakes Estates
Subdivision on the condition that the approval did not violate
the rights of the land owners or the statutes in the Local
Government Code.
The Court next considered authorizing work outside of

county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of Mrs. C. M. Burton on Jones
Road to clean out existing outlet channel from Jones Road to
a pond for adequate drainage and erosion prevention. The Road
and Bridge Department also requested permission to enter the
private property of the Reliance Community Ballpark at the
corner of Church Road and FM 1179 for the purpose of hauling
dirt. On motion by Commissioner Wilcox, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the work.
The Court proceeded to consider the-change of status of

On motion by Commissioner Norton, seconded by Commis-
sioner Sims, the Court voted unanimously to approve the Claims
with the exception of claims numbered 9381, 9382 & 9678 which
will be approved after being reviewed by the Auditor's staff.
At 10:35 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 10:47 a.m. the County Judge announced the meeting open
to the public. Commissioner Norton moved the approve the
request of the Sheriff to promote Wayne Dicky from a group 10
step 3 position to a group 11 step 3 position and to approve
the request of the County Attorney to pay Michele Esparza,
Assistant County Attorney from the clerical position vacated
by Paul Martin and to supplement her check from the Hot Check
Fund for the balance of her salary. Commissioners Norton,
Sims and Turner voted "Aye". Commissioner Wilcox vote "No".
There being no further business to come before the Court,
the meeting was adjourned.

PRISONER CUSTODY AGREEMENT
This Prisoner Cu t dy Agreement (this "Agreement") is
entered into as of D , 194_ by and between
the Commissioners Cour o County ("County")
and the Texas Department o Criminal Justice, Pardons and
Paroles Division.
R E C I T A L S
WHEREAS, the Texas Department of Criminal Justice, Pardons
and Paroles Division ("TDCJ PPD") has an agreement with
Wackenhutt Services, Inc. ("Wackenhut") to operate the Central
Texas Parole Violator Facility ("Facility") as a correctional
center for certain persons described herein who are under the
jurisdiction of TDCJ PPD and in the custody of County
authorities, and who have violated the terms and/or conditions
of their parole;
WHEREAS, TDCJ PPD and the County desire to enter into this
Agreement to which the State of Texas will assume responsibility
for the physical custody and care of certain prisoners
previously incarcerated by County pursuant to the County's
authority to detain prisoners in a detention facility operated
by a private organization under Local Government Code Section
351.101;
1. Assumption of Custody. In accordance with and subject
to the terms o this Agreement, Texas Department of Criminal
Justice, Pardons and Paroles Division shall assume physical
custody, care and control of certain Blue Warrant Prisoners (as
hereinafter'defined) with constructive custody maintained by the
County. Except as otherwise set forth herein, the Texas
Department of Criminal Justice, Pardons and Paroles Division
shall bear all expenses associated with such physical custody,
care and control of Blue Warrant Prisoners.
2. Eligibility Requirements. Prisoners eligible for
transfer to the Facility shall a limited to technical parole
violators incarcerated by County who are under the jurisdictions
of TDCJ PPD by virtue of having had issued against them a Blue
Warrant, which shall remain in effect, and who (a) have violated
their parole, (b) are in reasonably good health, with no current
and/or existing medical problem that could cause hospitaliza-
tion, and (c) have had a specified time of confinement
authorized by TDCJ PPD as a condition of the continuance of
their parole. Such persons are referred to herein as "Blue
Warrant Prisoners". TDCJ PPD or its designee shall be
authorized to refuse to accept for incarceration, or after
incarceration shall be authorized to return to the physical
custody of the County at County's expense, any prisoner who does
not meet the eligibility requirements for incarceration at the
Facility as set forth in this paragraph 2.
