IN THE COMMISSIONERS' COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS. 1. Invocation. 2. Pledge of Allegiance. 3. Consider and take action on budget amendments. 4. Consider and take action on the approval of the extension of the following lease agreements: a. Brazos Valley Art League b. Junior League of Bryan-College Station c. Brazos Valley Museum 5. Consider and take action on exemption from competitive bidding requirements of local government code, Section 262.024(a)(2) for waste removal and sanitation services. 6. Consider and take action on request from Ferguson Crossing to place pipeline in county right-of-way of Hopes Creek Road in Precinct 1. 7. Consider and take action on request from State Department of Highways and Public Transportation to install Railroad Signal Gates at Butte Drive and Schehin Road in Precinct 1. 8. Consider and take action on request from City of Bryan to install utility lines in county rights-of-ways of Stousland Road and Straub Road in Precinct 1. 9. Consider and take action on work outside of county rights- of-ways for the enhancement of county road projects. 10. Acknowledge receipt of Treasurers report. 11. Consider and take action on personnel change of status. 12. Consider and take action on payment of claims. 13. Adjourn. L COMMISSIONERS' COURT SPECIAL MEETING APRIL 22, 1991 • A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, April 22, 1991, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: is Ruth McLeod Carol Palmer Bea Green Rosalie Todaro Cheryl Turney A. H. Winder Jim Hiney W. H. Ritchey Executive Assistant Admin. Asst. to County Judge Secretary to Commissioners Auditor's Office Auditor's Office County Engineer Bryan/College Station Eagle Brazos Valley Museum ~I Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendment #91-010, which would reallocate funds budgeted for the County Clerk and the office of Constable Precinct 4. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the extension of lease • agreements between Brazos County and the Brazos Valley Art League, the Junior League and the Brazos Valley Museum. Term of the lease for the Junior League will be from February 1, 1991 through September 30, 1991. Term for. the lease for the Brazos Valley Museum will be on a month to month basis. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to renew the lease agreements for the previously stated periods of time. The Court next considered a Wavier of Competitive Bidding Requirements as provided in Section 262.024 (a) (2) of the Local Government Code for the performance of waste removal and sanitation services with Texas Commercial Waste. This was made necessary to preserve and protect the public health of the residents of the county. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the Waiver of Competitive Bidding Requirements. The Court next considered the request by Ferguson Crossing to install a welded steel pipeline, across the right- of-way of Hopes Creek Road in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Ferguson Crossing and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by State Department of Highways and Public Transportation for approval to install railroad signal gates at Butte Drive and Schehin Roads in Precinct 1. The installation of the signal gates will be at no cost to Brazos County. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of the State Department of Highways and Public Transportation and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by the City of Bryan to install two (2) poles and two (2) guy wires within the right-of-way of Straub Road Lane in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of the City of Bryan and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road P,P UL r9y VOL X Commissioners' Court meeting April 22, 1991 • projects. The Road and Bridge Department requested permission to enter the private property of Shirley Ethridge to construct an outlet ditch from the driveway culvert to maintain drainage and prevent erosion. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to • authorize the work. The court received, approved and ordered filed as submitted the Treasurer's report for March 1990. A copy of which is attached to and made a part of these minutes. The Court proceeded to consider the change of status of the following employees. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any eXisting utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of way in accordance with governing laws. 1 • 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. I 7. That all roads be bored to forty feet (40') on either side of the centerline of the right-of-way or cased for such distance. 8. That all sites will be barracaded during construction period. 9. That the normal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985.
