SPECIAL MEETING
APRIL 1, 1991
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, April 1, 1991, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Former County Commissioner
Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered a request from Elsa Mazullo,
representative of the League of Women Voters, who presented
the Court with complementary copies of the booklet Know Your
County Government. The County Judge thanked Ms. Mazullo.
Commissioner Sims stated the booklet would be a help with
junior high school and high school students in teaching them
about county government.
The County Judge read aloud a Proclamation proclaiming
the month of April as "Sexual Assault Awareness Month". The

Court joins with the local Rape Crisis Center to promote
awareness in the community and emphasize the need for citizen
involvement in efforts to reduce sexual assault through public
education and changing public attitudes. On motion by
Commissioner Sims, seconded by Commissioner Norton the Court
moved to proclaim the month of April as "Sexual Assault
Awareness Month throughout Brazos County. The County Judge
then presented the signed Proclamation to Ms Paula McCoon,
representing the local Rape Crisis Center.
The County Judge read aloud a Proclamation proclaiming
the month of April as "Child Abuse Prevention Month". The
Court joins with the Child Protective Services, Family
Outreach and the C.A.R.E. Coalition to create greater public
awareness of the needs of children and thus reduce the risk of
child abuse and neglect in the community. on motion by
Commissioner Sims, seconded by Commissioner Norton the Court
moved to proclaim the month of April as "Child Abuse
Prevention Month throughout Brazos County. The County Judge
then presented the signed Proclamation to Ms Topaz Hughes,
Marsy Clarke and Tommy Ramirez, Jr. representing the local
Child Protective Services and Juvenile Services.
The Court next considered Budget Amendment #91-007, which
W7ould reallocate. funds budgeted for the County Attorney's
Office, Constable Precinct 4, Constable Precinct 7, transfer
funds from the Anti DWI Program to the offices of Justice of
the Peace Precinct 7 Place 1 and 2 and reallocate- funds within
the Boonville Cemetery Fund. On motion by commissioner
Turner, seconded by Commissioner Norton, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The Court next considered entering into agreement with
the Brazos County Emergency Communications District 9-1-1 for
the purpose of appointing the emergency communications
dispatching authority for Brazos County for the period October
1, 1990 through and including September 30, 1991. The

district shall be responsible for providing a functioning
computer aided dispatch system to the County. For this
service, the County agrees to pay $113,153.00. On motion by
Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to enter into agreement with the
Brazos County Emergency Communications District for emergency
communications dispatching and authorized the County Judge to
execute the Agreement on behalf of Brazos County. A copy of
the Agreement is attached hereto.
The Court next considered the request by General
Telephone to place a buried cable across the right-of-way of
Walnut Road in Precinct 1. On motion by Commissioner Norton,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Pipe Tech Construction, Inc. and
authorized the installation. A copy of the request is
attached hereto.
The County Judge called Sharon Fairchild, County Auditor,
to the bench and presented her with a plaque honoring Brazos
County's Achievement for Excellence in Financial Reporting.
Mrs. Fairchild told the Court that she appreciated all the
help from the Court, the District Judges and her staff.
Commissioner Norton stated he appreciated Mrs. Fairchild
watching over them closely. Commissioner Sims stated the
staff of the Auditor's office was very accommodating.
The Court next considered the request by Ultramar Oil and
Gas to place a 2" pipeline across the right-of-way of Kuder
Road in Precinct 4. On motion by Commissioner Turner,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Ultramar Oil and Gas and authorized the
installation. A copy of the request is attached hereto.

On motion by Commissioner Norton, seconded by
Commissioner Turner, the Court voted unanimously to approve
the Claims as submitted.
At 10:26 a.m. the County Judge announced the meeting

closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 10:34 a.m. the County Judge announced the meeting open
to the public. Commissioner Turner moved to reconsider action
that would prevent Kyle Davis, of the District Attorney's
office, from receiving a six month evaluation and possible
step increase. Commissioner Norton seconded' the motion.
Commissioners Norton, Sims and Turner voted "Aye". Commis-
sioner Wilcox voted "No". The motion carried. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court

Commissioners' Court meeting April 1, 1991
voted unanimously to approve the request of J. D. Langley,
85th District Court Judge, to hire Michael R. Gentry at a pay
group 8, step 3 with no six month step increase. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the request of the District Clerk
to hire Lisa Clement at a pay group 4, step 2 with no six

month step increase.
There being no further business to come before the Court,
the meeting was adjourned.

Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on April 1, 1991, the Court heard and approved
a budget amendment for the 1991 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted October 1, 1990,
the following amendment(s) to the original are hereby authorized,
as described on the attached 1 page(s).

THIS AGREEMENT is entered into this
day of August,
1990 A.D. by and between BRAZOS COUNTY, Texas (County) and
the Brazos County Emergency Communications District 9-1-1
(District) pursuant to the authority of the Texas Interlocal
government Cooperation Act, Article 4413(32c), V.T.C.S.
WHEREAS, Brazos County is also a political subdivision
of the State of Texas authorized to enter into interlocal
cooperative governmental agreements; and,
WHEREAS, the Brazos County Commissioners in public
meeting find that it is mutually beneficial for the County
and the District to enter into an agreement for the District
to perform for the County, Emergency Communications Services
Dispatching;
NOW THEREFORE; IN CONSIDERATION of the mutual promises
to each other made hereinafter, the undersigned parties agree
as follows:
Effective August 1, 1990 the District is hereby
appointed the emergency communications dispatching authority
for Brazos County for the period October 1, 1990 through and
including September 30, 1991.
The District, shall be responsible for providing a
functioning computer aided dispatch system to the County.

The County agrees to pay and the District agrees to
accept as compensation for the services provided a flat fee
of one hundred thirteen thousand one hundred fifty three
($113,153) and N01100 DOLLARS. The County shall pay the
full amount due within ten days of invoice from the District.
All payments shall be subject to the Texas Prompt Payment
Act. Should there arise any dispute, disputed amounts shall
be deposited in a mutually agreed upon escrow account until a
resolution.
District employees shall not be considered as County

employees.
The County and the District understand and agree to be
subject to all the laws, ordinances and regulations which
govern and affect Emergency Communications Dispatching and
National Crime Information Computer network
telecommunications as promulgated by the State of Texas or
the United States Government or any of its appropriate
Agencies, such as the Texas Department of Public Safety or
the Federal Bureau of.Investigation.
This agreement is made in accordance with the Texas
Emergency Telephone Number Act, Section 772.301 et seq.,
Texas Health and Safety Code.
Each of the parties to this agreement agrees to hold the
other harmless for any and all claims of whatsoever nature or
kind which may arise as a result of that parties' fulfillment
of this agreement.

Each party hereby empowers and authorizes its chief
Administrative Officer to be signatory agents for any
required documentation to implement the intent of this
Agreement.
This agreement contains all of the commitments and
covenants of the parties and any oral or written promises not
contained herein shall have no force or effect to alter any
term or condition of this agreement.
This agreement may only be modified or amended in
writing by the mutual consent of the parties with said
modification being attached to and incorporated into this
agreement by this reference for all purposes.

Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
Texas as follows:
336 South of the intersection of Dowling road and Walnut Road a buried cable will
be placed across Walnut !toad, the cable will be placed in 35' long 2" road bore.
The location and description of this line and associated appurtenances is more fully shown
by 4 copies of drawings attached to this notice. The is will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.

Notwithstanding any other provision contained herein, it is exprt-sly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may

The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.

1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage Is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
