VOL PAGE aro • r� • COMMISSIONERS' COURT REGULAR MEETING FEBRUARY 11, 1991 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, February 11, 1991, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The Court next considered Budget Amendment #91-003, which would reallocate funds budgeted for the 85th District Court and the Boonville Cemetery Fund. It will also transfer funds from the jail to the minimum security jail and provide $40.000.00 maximun as Brazos County support for the Brazos Center Museum grant. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. VOL X -PAGE-3// Commissioners' Court meeting February 11, 1991 The Court next received and opened the Depository Bids for all county funds for the 1991 biennium. The following banks submitted bids: First American Bank $112,000 check attached First City National Bank $112,000 check attached The County Judge announced that only two (2) bids were received. The County Judge then recommended the bids be submitted to the County Auditor for analysis. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to submit the bids to the County Auditor for analysis and recommendation to the Court. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to appoint the firm of Durst, Wood, Milberger and Associates as outside auditors for Brazos County. This is based a proposal submitted by the firm outlining the services to be preformed at an estimated cost of $35,000.00. A copy of the proposal is attached hereto. On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to approve the request of the County Attorney to receive one car, a 1987 Chevrolet Celebrity to be transfered from the Sheriff's vehicle inventory, into the County Attorney's inventory and to delete one car, a 1985 Ford Crown Victoria from the County. Attorney's vehicle inventory. The next matter for consideration was the status of Gopher Lane in Precinct 4. The road is approximately 3/10ths of a mile long with ten (10) families living on it. Commis- sioner Turner stated that he had inspected the road twice and felt that something should be done about it. Commissioner Norton asked if the county currently maintained the road. The County Engineer said no. Commissioner Wilcox informed the Court that it was a private subdivision. Commissioner Sims asked about the width of the right-of-way. Commissioner Turner answered that it was about 60' wide. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court Commissioners' Court meeting February 11, 1991 voted unanimously to table the matter and directed the County Engineer can to do a study and assessment of the road. The Court next considered a request from Western • Geophysical, to lay seismographic cables for approximately five or six hours across the following County roadways: 1. Pitts Road 2. Leonard Road 3. Goodson Bend Road 4. Koppe Bridge Road 5. Straub Road 6. Clay Pit Road 7. Stousland Road 8. Bird Pond Road 9. Weedon Loop 10. Elmo Weedon Road .1 The County Engineer recommended that Western Geophysical forward a letter of intent that holds the County harmless. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Western Geophysical subject to their forwarding the letter of intent. The Court acknowledged receipt of the Extension Service • reports for January 1991. The Court acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. At 10:41 a.m. the County Judge announced the meeting open to the public. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to approve the employment of Michelle Esparza on a temporary basis in the County Attorney's Office. Mrs. Esparza is to be paid out of the Hot Check Fund. Mrs. Esparza will be temporarily replacing an employee who is out on sick leave. when that employee has exhausted her sick leave, extended leave and vacation time, Mrs. Esparza will be transferred into that slot and be paid from the general fund. The employee on sick leave will be transferred to the Hot Check fund until such time as she is well enough to resume normal duties. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to designate Gary Norton to offer Claude Davis, County Court at Law #1 Judge, a position on the Bail Bond Board. We will audit the general purpose financial statements of Brazos County as of and for the year ended December 31, 1990. The County's Annual Report includes statistical data that will be subjected to certain auditing procedures applied in our audit. Our audit will be made in accordance with generally accepted auditing stand- ards and will comply with the requirements of the Single Audit Act of 1984, as supplemented, pertaining to Federal and State assistance awards, will be in accordance with generally accepted government auditing standards, the standards for financial and compliance audits contained in Government Auditing Standards issued by the U.S. General Accounting Office. the provisions of OMB Circular A-128, Audits of State and Local Governments, and will include tests of the accounting records and other procedures we consider necessary to enable us to express an unqualified opinion that the financial statements are fairly presented in conformity with generally accepted accounting principles. We shall prepare all separate reports regarding compliance with laws and regulations, and on reportable conditions, if any. If our opinions are other than unqualified, we shall fully discuss the reasons with you in advance. Our procedures will include tests of documentary evidence supporting the transactions recorded in the accounts and direct confirmation of receivables and certain other assets and liabilities by correspondence with selected individ- uals, creditors, and banks. We will request written representations from your attorneys, and they may bill you for responding to this inquiry. At the conclusion of our examination, we shall also request certain written representations from you and the County Auditor about the financial statements and related matters. An audit is based primarily on the selective testing of accounting records and related data; therefore, our audit will involve judgment about the number of transactions to be examined and the areas to be tested. Because our audit will not be a detailed examination of all transactions, there is a risk that Page 2 January 3, 1991 • material errors, irregularities, or illegal acts, including fraud or defalca- tions, may exist and not be detected by us. However, we shall advise you of any matters of that nature that come to our attention. We understand that the County Auditor's Office will provide us with the financial statements and basic information required for our audit, and that the County is responsible for the accuracy and completeness of that information. We will advise about appropriate accounting principles and their application and will assist in the preparation of your financial statements, but the responsi- bility for the financial statements remains with the County. This responsibility includes the maintenance of adequate records and related controls, the selection and application of accounting principles, and the safeguarding of assets. Our examinations are not specifically designed and cannot be relied on to disclose material weaknesses in accounting controls. However, if we become aware of such material weaknesses or other reportable conditions, we shall communicate t them to you in a separate letter. If you intend to publish or otherwise reproduce the financial statements and make reference to our firm, you agree to provide us with printers' proofs or masters for our review and approval before printing. You also agree to provide us with a copy of the final reproduced material for our review before it is distrib- uted. Any audit working papers shall be available to you for a period of not less than 3 years after the date of the report, or longer if requested by the cognizant agency, to representatives of that cognizant audit agency (or its designee), • other government audit staffs, and the General Accounting Office. Our fees for these services will be based on the actual time spent computed at a discount from our standard hourly rates (the discounts have been substantial in the past), plus out-of-pocket costs such as postage, etc. Our hourly rates vary according to the degree of responsibility involved and the experience level of the personnel. Based on prior years' experience and the belief that there will be some additional efficiencies in the preparation of the County's annual financial statements and related footnotes, we estimate our fee to be $35,000.00. We hope that the discount from standard fees can be reduced. We expect to issue our reports on Brazos County on or about June 15, 1991. We appreciate the opportunity to be of service to Brazos County and believe this letter accurately summarizes the significant terms of our engagement.
