SPECIAL MEETING
JANUARY 22, 1991
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 6:00
p.m. on Monday, January 22, 1991, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment 026 to the
1990 budget, which would reallocate funds budgeted for the
County Clerk's Department. on motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.

Commissioners' Court meeting January 22, 1991
On motion by Commissioner Wilcox,. seconded by
Commissioner Sims, the Court voted unanimously to appoint
those named on the attached list to the Brazos County
Historical Commission for 1991-1992 term.
The Court next considered designating a smoking area on
the third floor of the courthouse. Commissioner Sims
suggested finding an air handling system and that he would
check in to it. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to restrict
smoking on the third floor to the break area.
The next matter for consideration was the selection of a
delinquent tax collection attorney for Brazos County.
Commissioners Sims and Norton explained the process by which
they reached 'their conclusion. commissioner Sims then
recommended the law firm of Calame, Linebarger & Graham.
Commissioner Wilcox stated he had not seen a status report.
from the meeting with the other entities. He also stated that
many of the taxing entities saw no reason for a change and
then moved to stay with the firm of Walker and Young.
Commissioner Turner seconded the motion. Commissioners Turner
and Wilcox voted "Aye". Commissioners Norton and Sims and the
County Judge voted "No". Commissioner Sims then moved to
select the firm of Calame, Linebarger & Graham. Commissioner
Norton seconded the motion. Commissioners Norton, Sims and
Wilcox and the County Judge voted "Aye". Commissioner Turner
voted "No". The motion carried and the firm of Calame,
Linebarger & Graham were appointed the delinquent tax
collection attorneys for Brazos County. A copy of the
contract setting down the terms is attached hereto.
On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court voted unanimously to approve the
reconstruction of 0.80 miles of Jones Road beginning at
Leonard Road (FM 1688).
The Court next considered approval of the final plat of
Mesquite Flats in Precinct 4. Holland Winder, County

Commissioners' Court meeting January 22, 1991
Engineer, stated that he had reviewed the plat and it appeared
to be in order. On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court unanimously approved the final
plat of the Mesquite Flats Subdivision.
The Court next considered approval of the preliminary
plat of the Mustang Hills Subdivision. Commissioner Norton
asked if the access right-of-way from the Quarter Horse Ranch
Subdivision met County specifications. Holland Winder, County
Engineer, stated it did not. The Engineer then read a list of
specifications that had not been met. Those included the lack
of a drainage study with recommendations, lack of a profile of
the roads, the profile must appear on the plat, plat must show
all drains and water courses, and the contours shall be on two
foot intervals. Commissioner Norton then suggested tabling
consideration because the only access through the subdivision,
Olympia Buddy Road, did not meet county standards.
Commissioner Sims asked if this was the only access to the
subdivision through unacceptable roads. Bill Cooley,
developer, stated he merely wanted the preliminary plat
approved for the utility easements and lot alignment right-of-
way. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court unanimously approved the
preliminary plat of the Mustang Hills Subdivision. Approval of
the final plat will be withheld until such time as Tommy
Arhopolus, owner of the Quarter Horse Subdivision, upgrades
Olympia Buddy Road to county specifications.
The Court next considered approval of the preliminary
plat of Sunset Estates in Precinct 4. Holland Winder, County
Engineer, stated that he had reviewed the plat and it appeared
to be in order subject to eight (8) recommendations that he
noted. The Engineer then read the following list of
specifications that had not been met.
1. Subdivision within City of Bryan's
E.T.J., plat must be submitted to the
City of Bryan.
2. Building set -back lines on O.S.R. shall

be 50'.
3. Public Utility Easement along Rye School
Road and OSR shall be 20 '.
4. Note #3 on Plat leaves only an effective
50'width.
5. Lacking drainage study with recommen-
dations.
6. Show natural drainage courses, contours
on 2' intervals.
7. Profile of roads.
8. Section IV, Paragraph C, Line, Page 8,
Brazos County Subdivision Regulations
requires 70' wide right-of-way (Rye
School Road).
On motion by Commissioner Turner, seconded by Commissioner
Sims, the Court unanimously approved the preliminary plat of
the Sunset Estates Subdivision subject to the recommended
additions to the plat.
The Court received, approved and ordered filed as
submitted the Treasurer's report for December 1990. A copy of
which is attached to and made a part of these minutes.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
At 6:29 p.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 6:47 p.m. the County Judge announced the meeting open

to the public. On motion by Commissioner Sims seconded by

Commissioner Norton, the Court voted unanimously to promote
four jailers to corporal upon inauguration of the new jail.
The County Judge moved to authorize Judge J. D. Langley to
z offer an incoming secretary a group 8 step 2 position. The
motion was seconded by Commissioner Sims. After brief
s
discussion the County Judge and Commissioner Sims withdrew
c their motion and second. On motion by Commissioner Wilcox,
seconded by Commissioner Sims, the Court voted unanimously to
authorize Judge J. D. Langley to hire a Denny Bollinger at a
group 8 step 6 position.
There being no further business to come before the Court,
the meeting was adjourned.

BUDGET AMENDMENT(S) FOR THE 1990 BUDGET YEAR
NO. 26
On this the 22nd day of January 1991 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on January 22, 1991, the Court heard and
approved a budget amendment for the 1990 budget year for Brazos
County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 22,
1989, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 22nd day of January 1991

THIS CONTRACT is made and entered into by and between BRAZOS COUNTY,
acting herein by and through its governing body, hereinafter styled First Party, and the law
firm of CALAME, LINEBARGER & GRAHAM, 1949 South I. H. 35, Austin, Texas
78701, hereinafter styled Second Party.
I.
First Party agrees to employ and does hereby employ Second Party to enforce by
suit or otherwise the collection of all delinquent taxes, penalty and interest owing to First
Parry and all other taxing jurisdictions whose taxes are collected by First Party. Current
taxes falling delinquent within the period of this contract shall become subject to its terms
when placed in litigation or on the first day of July of the year in which the taxes become
delinquent, whichever date is sooner.

Second Party is to call to the attention of the collector or other officials any errors,
double assessments or other discrepancies coming under its observation during the progress I
of the work, and is to intervene on behalf of First Party in all suits for taxes hereafter filed 1
by any taxing unit on property located within its corporate limits.
III.
Second Party agrees to provide First Parry with reports regarding litigation and
collection activities on a quarterly basis. Second Party also agrees to provide oral reports
semi-annually. Second Party agrees to report as frequently as requested to Bryan {
Independent School District, College Station Independent School district, the City of Bryan
and the City of College Station.
IV.
First Party agrees to pay to Second Party as compensation for the services required
hereunder fifteen percent (15%) of all delinquent taxes, penalty and interest subject to this
Contract, actually collected and paid to the collector of taxes during the term of this
contract, as and when collected. All compensation above provided for shall become the
property of Second Parry at the time payment of the taxes, penalty and interest is made to
the collector. 71he collector shall pay over said funds monthly by check.

Second Party fully incorporates into this contract all terms and conditions presented
to First Party in its "Proposal for the Collection of Delinquent Taxes" on December 17,
1990.
VI.
Second Party agrees to maintain a level of delinquent collection amounts equal to
or greater than the collected amounts from the period beginning January 23, 1990 and
ending January 22, 1991.
VII.
This contract is drawn to cover a period of two years beginning January 22, 1991.
Thereafter, this contract will continue on a month to month basis until such time as First
Party notifies Second Party that it does not wish to continue the agreement. This
agreement may be terminated at any time by First Party by the giving of thirty (30) days
written notice thereof to Second Party, during which notice period Second Party shall not
file any suits to collect delinquent taxes. Second Party shall have six months following
termination of the contract, whether that termination is by notice or pursuant to its own
terms, to reduce to judgment all suits filed prior thereto. In consideration of the terms and
compensation herein stated, Second Party hereby accepts said employment and undertakes
the performance "of said contract as above written.
This contract is executed on behalf of First Party by the presiding officer of its
governing body who is authorized to execute this instrument by order heretofore passed
and duly recorded in its minutes.
WITNESS the signatures of all parties hereto in duplicate originals, this the day
of 1991, Brazos County, Texas.
