J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The Court first heard from James Oliver, Landscape Architect, who referred to a drawing of the entry plaza of the Courthouse showing the placement of new benches, a trash receptacle and a Chinese Pistachio tree. He commented that Mrs. Dozier previously distributed the price list. Commis- sioner Wilcox asked if the installation of new benches would 1 i u 7 disturb the roots of the existing Cedar tree. Mr. Oliver assured him that it would not. Commissioner Wilcox also J f~ i 1 1 1 i Commissioners' Court meeting December 17, 1990 inquired if proper drainage would be installed in the area. Again he was assured that it would be. The County Judge thanked Mr. Oliver for the information and said the Court would take the plans under consideration. The next matter for consideration by the Court was a request submitted by Jim Mazurkiewitz, Extension Agent requesting approval for out of state travel for himself. Mr. Mazurkiewicz would be traveling to Denver, Colorado to super- vise producers in purebred cattle selection from January 12 through the 16, 1991. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to grant the request from the Extension Agent and approved I payment of out of state travel expense for Mr. Mazurkiewicz. The Court next considered renewal of an extension of the u ~ ~ -PT'T'--,.-'.-..~.,..-.-_~.-,, .w9r-.. r• tw-~r :v.-v~.- _ ~ _ _ _ _ _ _ agreement between Brazos County and the Brazos Valley Art League for rental of space in the Brazos Center. This would' extend the current lease agreement ending on September 30, 1990 to continue on a month to month basis until a construc- tion schedule is firmly established by the Brazos Valley Museum or until February 1, 1991 which ever comes first. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to extend the lease agreement for the period stated above. A copy of the lease agreement is attached. On motion by Commissioner Wilcox, seconded by Commis- sioner Norton, the Court voted unanimously to acknowledge and approve the assessment of fees by the Second Administrative Judicial Region of Texas in the amount of $3,587.20 and authorized the payment thereof. It was the consensus of the Court to table consideration of the awarding of a contract for the delinquent ad valorem tax collection service for Brazos County. The Court next considered the request by Wellborn Water Supply to install a water line, within the right-of-way of Cherokee Drive, Precinct 1. On motion by Commissioner Norton, VOL PAGE ley-- r~~ f J' Q Commissioners' Court meeting December 17, 1990 seconded by Commissioner Sims, the Court voted unanimously to approve the request of Wellborn Water Supply and authorized the installation. A copy of the request is attached hereto. On motion by Commissioner Turner, seconded by Commis- sioner Sims, the Court voted unanimously to temporarily close Britten Road in Precinct 4 for the purpose of reconstructing Structure No. 001. The project would be done under the cooperative effort of Brazos County and the State Department of Highways and Public Transportation in the 80/20 Off System Bridge Replacement Program in which the state pays for 80% of the cost and the county pays 20% of the cost. The road will be closed for approximately three (3) to four (4) months. On motion by Commissioner Turner, seconded by Commis- sioner Sims, the Court voted unanimously to forward to the State Department of Highways and Public Transportation verification that all of the right-of-way has been obtained for the construction of the new bridge on Mumford Road. The Court next considered improvements to Andert Road in Precinct 3. Holland Winder, County Engineer, proposed using Road & Bridge crews to do all the improvements along the 3/4 mile stretch except to process the base material. Young Brothers, Inc. will perform that service under contract. Estimated total cost of the improvements will be $77,750.00. Commissioner Sims explained that there are twenty five (25) f houses along the road so this was not merely to accommodate E the salt water treatment plant but an attempt to upgrade the road to make it easier to maintain. Commissioner Wilcox asked if this is the same type of road that is needed on Jones Road. The County Engineer answered that it was. Commissioner Wilcox then asked how much Jones Road was going to cost. commis- sioner Sims added that there were 415 cars a day using Andert Road while Jones Road had 183 cars using it daily. Commis- sioner Sims then moved for approval to improve Andert Road using State Lateral Road Funds to pay for the expense. Com- missioner Norton seconded the motion. Commissioner Wilcox yol___, PAG E r r 4• r r l' L S' w 4 4 i P c. +r l I 'r Commissioners' Court meeting December 17, 1990 declared that this was too expensive and suggested Commis- sioner Sims seek financial assistance in the amount of $50,000.00 from the owners of the salt water plant. He continued saying that the tax payers did not have funds to build this road. The County Judge asked for a vote. Commissioners Norton, Sims and Turner and the County Judge voted "Aye." Commissioner Wilcox voted "No." Commissioner Turner asked for a guarantee that he would be able to build the same kind of road on Jones Road and that payment be made from State Lateral Road funds. The consensus of the Court was that it would be so. The Court next considered authorizing work outside of i county' rights -of -ways for the enhancement of county road projects. The Road and Bridge Department requests permission to enter the property of Lela Mae Jeffrey on Matt Wright Road to stock pile gravel in order to save time and money in retrieving the gravel from a more remote location; to enter the property of Gene Roznos on Frieda Lane for the purpose of creating a cul-de-sac for county vehicles and to enter the property of Harold R. White on Reed Road for the purpose of creating a cul-de-sac for county vehicles. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. Task Force-----Claims 173664 thru 173684 On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. At 6:34 p.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel as allowed under Section (6252-17(2)(g) Vernon's Texas Civil Statutes. At 7:30 p.m. the County Judge announced the meeting open to the public. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request submitted by Judge Delaney of the 272nd District Court, requesting a 4% increase in the supplement payment to Mary Ann Wolman and Susan Cuthbertson pending confirmation of the legality of such a move. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to correct a clerical error in the budget of the 361st District Court. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to deny the request of the County Attorney to hire a new employee, Paul Martin, at a group 6 step 4 position. Instead the employee may be hired at a group 6 step 2 position with no six (6) month step increase. On motion by the County Judge, VOL PAG~9.1 Commissioners' Court meeting December 17, 1990 seconded by Commissioner Sims, the Court voted unanimously to give a 4% step increase to Pam Raymond beginning January 1, 1991 pending confirmation of the legality of such a move. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request submitted by Judge Claude Davis of County Court at Law I to pay Charles Vincent $6.00 per hour until funds for that position run out. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Constable Garcia to transfer part time deputy, Gayla Butler, to part time clerk and hire Isaac Butler, Jr. as a part time deputy constable.
