TEXAS AGENDA BRAZOS COUNTY COMMISSIONERS' COURT MEETING THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY, NOVEMBER 5, 1990, AT 10:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS. 1. Invocation. 2. Pledge of Allegiance. 3. Consider and take action on the approval of the minutes of the meetings held on September 10, 1990, September 17, 1990, September 24, 1990 (10:00 A.M. and 1:00 P.M.) and October 1, 1990. 4. Consider and take action on request from Texas Municipal Power Agency to install power line in county right-of-way of Tonkaway Lake Road in•Precinct 3. 5. Consider and take action on request from General Telephone Company of the Southwest to install communication line in county right-of-way of Marino Road in Precinct 2. 6. Consider and take action on Special Warranty Deed on Lots 6 and 7, Will Conley Addition #3, City of Bryan, Brazos County, Texas. 7. Consider and take action on personnel change of status. 8. Consider and take action on payment of claims. 9. Adjourn. i ; .11 z. i 1 COMMISSIONERS' COURT SPECIAL MEETING NOVEMBER 5, 1990 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, November 5, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: Bea Green Rosalie Todaro Cheryl Turney A. H. Winder Sandie Walker Candy Cochran Ginny Hamm Jim Hiney Bob Reese Gary Banta Allan Colley Secretary to Commissioners Auditor's Office Auditor's Office County Engineer Treasurer County Clerk's Office County Attorney's Office Bryan/College Station Eagle Candidate for Co. Clerk GTE GTE Commissioner Sims gave the invocation and led the pledge election judge shall complete a training program. He stated that ten (10) judges did not attend the training session this year and are ineligible to serve in the upcoming election. The County Judge assured him that they would contact the Secretary of State's office to resolve the dilemma. Commissioner Sims asked if the election school held by the Republican Party was sanctioned by the Secretary of State's office. Mr. Reese replied that the law states that the County Clerk shall provide the school. The County Judge assured Mr. Reese that the Court would look into the matter. of allegiance. The County Judge deviated from the agenda to allow Bob Reese, candidate for County Clerk, to address the Court on Section 32.114 of the Election Code which states that each 4• !N 4 1 Iplp,•~ i{T 1:• i f' i I, t 1 Commissioners' Court meeting November 5, 1990 The Court next considered approval of the minutes of the Commissioners' Court meetings held September 10, 1990, September 17, 1990, September 24, 1990 and October 1, 1990. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the minutes as submitted. The Court next considered the request by Texas Municipal Power Agency to install a 138 KV overhead electric power line across the right-of-way of Tonkaway Lake Road in Precinct 3. Holland Winder stated he had reviewed the request and had made revisions. He recommend approval of the request. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Texas Municipal Power Agency and authorized the installation. A copy of the request is attached hereto. The Court next considered, the request by General Telephone Company to construct a communication line within the right-of-way of Marino Road in Precinct 2. Consideration of this matter had been tabled at the Commissioners' Court meeting of October 29, 1990 due to questions about the location of the new cable. The Court received the needed information from the County Engineer. On motion by Commis- sioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the request of General Telephone Company and authorized the installation. A copy of the request is attached hereto. On motion by Commissioner Turner, seconded by Commis- sioner Sims, the Court voted unanimously to authorize the County Judge to execute the special warranty deed on two lots in the Will Conley Addition #3, City of Bryan. The lots were struck off to Brazos County Trustee at the last tax sale when no bids were received for them. Mr. and Mrs. Macario Garcia offered a bid of $2,000.00 for the property. On motion by Commissioner Sims, seconded by Commis- sioner Wilcox, the Court voted unanimously to approve the Claims as submitted with the exception of check number 68636. The location or description of the proposed installation is more fully shown by the drawings attached to this notice. It is understood and agreed that: 1. No supporting structures of the line will be placed within County right-of-way. 3. Easements from adjacent landowners include the right for the Applicant to install gates in fences for access from the road to the easement. 4. Any damage to the roadways and rights-of-way as the result of this access will be repaired to their original condition by the Applicant. 4a. Applicant will install drainage culvert pipes at points of ingress and egress to County right-of-way or roads. Drainage culverts will be sized, line and grade established by County Engineer. 5. Brazos County will in no way be responsible for any damage that might occur to any existing utility lines in the right-of-way. 6. The line will be constructed and maintained over the county right-of-way in accordance with governing laws. 7. Minimum vertical clearance of the conductors above the traveled way shall be twenty (22) feet. 8. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws.
