SPECIAL MEETING
OCTOBER 29, 1990
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, October 29, 1990, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered Budget Amendment #19, which
would increase the funds budgeted for the Environmental
Protection Department by $16,230.00. On motion by Commis-
pioner Norton, seconded by Commissioner Turner, the Court
voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
' On motion by Commissioner Wilcox, seconded by Commis-
sioner Norton, the Court voted unanimously to approve and
authorized the County Judge to execute an agreement on behalf
of Brazos County with the City of Bryan and the City of
College Station for the operation of the Brazos County Health
Department fiscal year October 1, 1990 through September 30,
1991 on the following pro rata basis:

On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to table
consideration of the committee report for the use of the Rodeo
Arena.
The next matter for consideration was a utility easement
along the old I&GN Railroad line. On motion by Commissioner
Norton, seconded by Commissioner Sims, the Court voted
unanimously to grant to the City of College Station a non-
perpetual easement for the limited purpose of installing and
attaching equipment, guy wires and anchors necessary and
incident to the uses of the Easement Area. A copy of the
Utility Easement is attached hereto.
Commissioner Sims moved to designate the office of
Constable Precinct 7 as the Brazos County Traffic Department
and that such office authorized to issue permits for oversized
and overweight vehicles. He further moved to remove the
responsibility for issuing oversize and overweight permits
from the Road and Bridge Department. Such action to become
effective November 19,1990. The motion was seconded by
Commissioner Norton with Commissioners Sims, Norton, Wilcox
and Turner voted "Aye". The County Judge voted "No" whereupon
the County Judge announced the motion carried. A copy of the
Order is attached hereto.

recommended acceptance of the low bid
submitted by Texas Copy. On motion by
Commissioner Sims, seconded by Commis-
sioner Norton, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Texas Copy.
Bid No. 90-572 - Annual Fence Building Contract
Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Mike Earp on item #1 and the
bid on item #2 submitted by Corgey &
Sons. Commissioner Wilcox questioned the
specifics of the special applications on
item #2. Due to lack of specific inform-
ation, Commissioner Wilcox moved to award
the contract on item #1 to Mike Earp and
to table consideration on item #2. The
motion was seconded by Commissioner
Norton and carried unanimously. A copy
of the bid tabulation is attached hereto.

The Court next considered the exchange of property
adjacent to Jones Road to allow a smooth right-of-way line for
the reconstruction of the Jones Road Project. Rex S. Jackson
et ux will convey 0.405 acres to Brazos County in exchange for
0.052 acres to be Quit Claimed to Rex S. Jackson et ux. On
motion by Commissioner Norton, seconded by Commissioner Sims,
the Court voted unanimously to authorize the County Judge to
execute a Quit Claim Deed to Rex S. Jackson et ux. The net
taking by Brazos County will be 0.353 acres.
The Court next considered the request by General
Telephone Company to install a communication line, across and
along the right-of-way of Marino Road in Precinct 2 and within
the right-of-way of Carraba Road in Precinct 3. There was
considerable confusion as to the extent of work being done by
General Telephone on Marino Road. On motion by Commissioner
Wilcox, seconded by Commissioner Sims, the Court voted
unanimously to table consideration of the request of General
Telephone Company to do work on Marino Road until more
information could be gathered. On motion by Commissioner
Sims, seconded by Commissioner Wilcox, the Court voted
unanimously to approve the request of General Telephone
Company to install a communication line within the right-of-
way of Carraba Road in Precinct 3 and authorized the
installation. A copy of the request is attached hereto.
On motion by Commissioner Turner, seconded by Commis-
sioner Sims, the Court voted unanimously to recommend the
following persons be appointed presiding judge and alternate
judge for the elections conducted by the county:

On motion by Commissioner Wilcox, seconded by Commis-
sioner Sims, the Court voted unanimously to approve the Claims
as submitted.
At 10:23 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 10:26 a.m. the County Judge announced the meeting open
.to the public. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the County Attorney to move Irvin Price to the budgeted
salary.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 29th day of October 1990 at a special meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on October 29, 1990, the Court heard and
approved a budget amendment for the 1990 budget year for Brazos
County, Texas.
WHEREAS, an,expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 22,
1989, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

CITY-COUNTY PUBLIC HEALTH AGREEMENT
THE STATE OF TEXAS
( KNOW ALL MEN BY THESE
( PRESENT:
COUNTY OF BRAZOS
WHEREAS, the City of Bryan, the City of College Station and Brazos
County, have created an administrative agency named the Brazos County
Health Department for the public purpose and objective of administering and
enforcing all federal and state health laws and city health ordinances in
the respective jurisdictions of each of the participating governmental
entities; and
WHEREAS, Article 4413(32c), V.A.T.C.S., authorizes intergovernmental
contracting at the local level including contracts between counties and
cities; and
WHEREAS, the City of Bryan, the City of College Station and Brazos
County, subject to the limitations set forth herein, intend to share in the
cost on a percentagq basis with the County to collect and disburse the
funds;
NOW, THEREFORE, THE UNDERSIGNED MUTUALLY AGREE AS FOLLOWS:
1.
That the matters set forth in the preamble are true and correct and
are made a part of this agreement.
2.
In consideration of the benefits to be received by the City of Bryan,
the City of College Station, and Brazos County, by reason of the joint
venture, the parties herein agree to pay, and Brazos County agrees to
collect and disburse funds for the operation of the Brazos County Health
Department, Fiscal Year October 1, 1990 - September 30, 1991, on the
following pro rata basis:

This contract is for a period of one year and all payments shall be
made from current revenues of each of the parties. Payments shall be made
by the City of College Station and the City of Bryan to Brazos County at
the Brazos County Courthouse prior to the tenth day of each month with each
monthly share representing one-twelfth (1/12) of the respective total share
of the cities. If credit is due any of the parties, Brazos County shall
make the necessary reimbursement no later than the end of the first (1st)
quarter of the next fiscal contract year. Reimbursement due to overpayment
shall be made in the amount overpaid by the entity. All non-encumbered
funds at the close of the contract year shall be deposited into the Public
Health Account (see Section 5) to be designated for use for Public Health
Services mutually beneficial to each party. No appropriation of the money
in this Agreement shall be made unless unanimously approved by the City of
Bryan, the City of College Station and Brazos County.
4.
The Brazos County Judge shall have the authority to make expenditures
as budgeted. Authority for non-budgeted items shall come only from the
approval of the governing board known as the Brazos County Board of Health.
5.
The Brazos County Health Department shall maintain records of all
income and disbursements of the Public Health Account. Such records shall
be brought before the governing board each quarter for approval. No
appropriation of money in this account shall be made unless unanimously
approved by the governing board.
6.
The Brazos County Health Department shall maintain records of usage of
the facilities and services by the citizens of each city and citizens of
the county who live outside the two cities. Such records shall be used to
determine the percentage of costs to be charged to the participating
entities for the following contract year.
7.
The Brazos County Health Department will be under the supervision of
the governing board consisting of one representative from each of the
three participating governmental entities.
8.
This contract can be renewed on an annual basis by resolution.

The Director of the Brazos County Health Department shall submit
financial and activity reports for both Health Department and Public Health
Accounts upon request by members of the governing board; but in no event
shall such financial and activity reports be submitted less frequently than
quarterly. The Director shall submit the annual financial and activity
report no later than the close of the first quarter of the next fiscal
year.
10.
Brazos County agrees to procure and maintain public liability
insurance in the amount of not less that $1,000,000.00, insuring against
risks and claims arising out of the operation of the Health Department
(except for professional liability claims against medical doctors, who
shall provide their own professional liability insurance). The cost of
liability insurance shall be included in the annual budget of the Brazos
County Health Department.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to
be executed as the 1st day of October, 1990.

UTILITY EASEMENT

COUNTY OF BRAZOS §
THAT, the COUNTY OF BRAZOS, TEXAS, a Political Subdivision of the State
of Texas, GRANTOR for and in consideration of the payment of TEN AND N01100
DOLLARS ($10.00), and other good and valuable consideration, in hand paid to
GRANTOR by the CITY OF COLLEGE STATION, TEXAS, the receipt of which is
hereby acknowledged, has GRANTED, SOLD and CONVEYED and by these presents
does GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a
Texas Municipal Corporation, non-perpetual EASEMENT for the purposes hereinafter set
forth on and through the following described property:
Being an easement twenty feet (20') in width through that 170 foot wide tract
in the Crawford Burnett League in College Station, Texas, acquired by the
I&GN Railroad by Condemnation Judgment recorded in Volume 3, Page
529, of he Civil Minutes of the County Court of Brazos County, Texas, and
conveyed to Brazos County by Quitclaim Deed recorded in Volume 272, Page
425, of the Deed Records of Brazos County, Texas (herein the "Property").
Provided, however, that this conveyance shall grant the rights herein specified only

as to that portion of the Property more particularly described by course, width, and
centerline on the attached Exhibit "A", known as the "Easement Area", and any additional
area outside the Easement Area necessary to install and attach equipment, guy wires, and
anchors necessary and incident to the uses of the Easement Area.
The Easement herein granted is for the limited purpose of erecting, constructing,
installing, and thereafter using, operating, inspecting, repairing, maintaining, reconstructing,
modifying, and removing the following:
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines, access facilities, and
related equipment;
Storm sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes, and all other drainage structures, surface
and sub-surface;

upon, over, and across the Property and any ways, streets, roads, or alleys abutting same;
and to cut, trim and control the growth of trees and other vegetation on and in the
Easement Area or on adjoining property of GRANTOR, which might interfere with or
threaten the operation and maintenance of any public utility equipment, accessories, or
operations. It is understood and agreed that any and all equipment and facilities placed
upon said property shall remain the property of GRANTEE.

GRANTOR expressly subordinates all rights of surface use incident to the mineral
estate to the above-described uses of said surface by GRANTEE.
It is expressly understood that the GRANTOR or future Owners of this Property,
including the mineral estate therein, reserve the right to use this EASEMENT for all
purposes which do not interfere with or prevent its use by the GRANTEE.
GRANTEE, its successor and assigns, agree that should GRANTEE, its successors
and assigns, cease to use the easement for the purposes set forth herein, this easement shall
be of no further force and effect and upon written request of the GRANTOR, the
GRANTEE shall within thirty (30) days of such request provide to GRANTOR, in
recordable form, a fully execued release and abandonment of easement.
GRANTEE agrees to indemnify and save harmless GRANTOR from any and all
liability, damages, costs, attorney's fees, expenses, causes of action, suits, claims or
judgments of any kind or character for injury to third parties or properties of third parties
arising out of Grantee's use of the Easement Area and all operations thereon. GRANTEE
shall and will, at its own expense, defend any and all suits in with GRANTOR may be a
parry, upon any such above mentioned claim, and shall and will satisfy, pay and discharge.
any and all judgments that may be recovered against GRANTOR in such action or actions.
TO HAVE AND TO HOLD the rights and interests herein described unto the
CITY OF COLLEGE STATION, TEXAS, and its successors and assigns, so long as the
rights and easements herein granted or any one of them shall be used by or useful to the
GRANTEE for the purposes herein granted upon the Property; and, except as herein
limited, the GRANTOR does hereby bind itself, its successors and assigns, to warrant and
forever defend, all and singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every person whomsoever
lawfully claiming, or to claim same, or any part thereof by, through or under Grantor but
not otherwise.

Page 529 of the Civil Minutes of the County Court of Brazos County, Texas, and conveyed to Brazos County by
Quitclaim deed recorded in Volume 272, Page 425 of the Deed Records of Brazos County, Texas, and lying ten
feet (10) each side of the following described centerline:
Commencing at the Intersection of the northwest line of Dowling Road and the southwest right-of-way line of
FM 2818 which Is also the most easterly corner of that 6.44 acre tract conveyed to Edsel G. Jones dba Manitou
Limited by deed recorded In Volume 619, Page 232 of the Official Records of Brazos County, Texas.
Thence along the southwest and southeast right-of-way line of FM 2818 as follows:
N 85' 50' 03• W • 396.1 feet to a concrete right-of-way marker found;
N 88.54' 18' W - 292.4 feet to a concrete right-of-way marker found;
S 23' 07' 50' W - 200.0 feet to a concrete right-of-way marker found;
N 75' 48'04"W - 165.5 feet to tho Point of Beginning of this easement;
Thence S 21149'48' E - 685.5 test through the said old I&GN Railroad right-of-way tract to the northwest line
of Dowling Road and the end of this easement at a point located S 42.25' 31' W - 114.5 feet from a 1/2' pipe
found at the most southerly corner of that 0.059 acre tract conveyed to Wellborn Water Supply Corp, by deed
recorded In Volume 269, Page 452 of the Deed Records of Brazos County, Texas.

BE IT REMEMBERED, at a regular meeting of the Commissioners'
Court of Brazos County, Texas, held on the 29th day of October
1990 on a motion made by Randy Sims , Commissioner Prenct
3 and seconded by Gary Norton Commissioner Precinct
1 the following Action was adopted:
WHEREAS, Pursuant to the provisions of Article 670ld-11,
Section 2 of the Civil Statutes of the State of Texas, the
Commissioners Court, may issue permits limited to periods of 90
days or less for the operation over county roads of vehicles which
exceed the weights authorized for those vehicles under Section 5
1/2 of the Act, and
WHEREAS, The Commissioners' Court of Brazos County on this
date by authorization of this action reassigns the duties of the
Brazos County Permit Department from the Brazos County Road and
Bridge Department to Precinct 7 Constable Office, also designated
as the Brazos County Traffic Department, and
IT IS THEREFORE DEEMED, That the Precinct 7 Constable Office,
also designated as the Brazos County Traffic Department, be
authorized by this action to issue permits for oversized vehicles
and over weight vehicles in the name of the County Judge of the
Commissioners court and fulfill all the responsibilities of that
duty and with the effective date of this action to be the 19th day
of November, 1990.

TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-oi-way of a County Road in
BRAZOS County, BRYAN, TX as follows:
From the Intersection of Hwy 21E b Carraba Road, going south of Carraba Road
approximately,three tenths of a mile, we propose to place a road boare with
a buried drop under Carraba Road at GTE pedistal marked "PED. 3".
The location and description of this line and associated appurtenances is
more fully shown by two copies of drawings attached to this notice.
The line will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that tender of this notice by the General Telephone Company of the
Southwest does not constitute a waiver, surrender, abandonment or impairment of
any property rights, franchise, easement, license, authority, permission,
privilege or right now granted by law or may be granted in the future and any
provision or provisions so construed shall be null and void.
Construction of this line will begin on or after October 20 19 90
