Consider and take action on Andert Road improvements in Precinct 3. 7. Consider and take action on award of bid for Boonville Ceme- tary Fence - Bid Request No. 90-569 - for the Road and Bridge Department and authorize the payment thereof. 8. Acknowledge receipt of Treasurers Report. 9. Consider and take action on-personnel change of status. 10. Consider and take action on payment of claims. 11. Adjourn. V0L--~,_PAr2E___J- COMMISSIONERS' COURT SPECIAL MEETING OCTOBER 22, 1990 is A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, October 22, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Absent; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2, Presiding; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: is Ruth McLeod Carol Palmer Bea Green Rosalie Todaro Cheryl Turney A. H. Winder Candy Cochran Rick Jahn Jim Mazurkiewicz Jim Hiney Linda Tucker John Edd Tucker Bob Reese Shawn Riley Executive Assistant Admin. Asst. to County Judge Secretary to Commissioners Auditor's Office Auditor's Office County Engineer County Clerk's Office County Extension Agent County Extension Agent Bryan/College Station Eagle 4-H 4-H Candidate for County Clerk Candidate for Co. Comm. Commissioner Sims gave the invocation and led the pledge of allegiance. The first matter for consideration by the Court was a written request submitted by the Extension Agent requesting approval for out of state travel for County Extension Agent Rick Jahn. Mr. Jahn would be traveling to Denver, Colorado to chaperon the Brazos County Meats Judging Team at the National Western Round-Up Meats Judging Contest during the week of October 25 through the 28, 1990. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to grant the request from the Extension Agent and approved payment of out of state travel expense for Mr. Rick Jahn. The Court next heard from dlr. John Edd Tucker, Commissioners' Court meeting October 22, 1990 representing the 4-H Equestrian Club. Mr. Tucker reminded the Court of his previous appearance before them when he had requested use of the Rodeo Arena for the Equestrian Club practice sessions. He stated he was back today to present a Memorandum of Agreement and a monthly estimate of facilities usage for the Court's consideration. Commissioner Norton stated no action would be taken at this meeting due to having just received the information and not having had a chance to review it. Commissioner Sims reminded him that speed was of the essence and that they would have it ready for action by the next Commissioners' Court meeting. On motion by Commissioner Sims, seconded by Commissioner ~ Norton, the Court voted unanimously to recommend the following persons be appointed presiding judge and alternate judge for the elections conducted by the county: Precinct # Presiding Judge Alternate Judge 2 Jose Ugarte 21 John Schmid 33 Wayne Todd 39 Patti Urbina 40 Gene Clark The next matter for consideration was the proposed improvements to Andert Road in Precinct 3. Commissioner Wilcox moved to table consideration until the County Judge is present. The motion was seconded by Commissioner Turner. Commissioners Turner and Wilcox voted "Aye" and Commissioners Norton and Sims voted "No". Commissioner Sims requested that the Court vote now to authorize the use of State Lateral Road funds for the project. He went on to explain that since the last request, the cost of the road had been reduced. Commis- sioner Wilcox stated the County had other roads where the users helped with repair and up keep. He went on to say that those companies that exceed the 58,420 pound weight limit help maintain the roads that they use. He objected to the use of State Lateral Road funds for this purpose. Commissioner Norton moved to use the State Lateral Road funds to pay for the improvements to Andert Road. The motion was seconded by Commissioner Sims. Commissioners Norton and Sims voted "Aye" 51 II Commissioners' Court meeting October 22. 1990 i i • r 01 Commissioners Turner and Wilcox voted "No". The motion did not carry. The Commissioners continued discussing the matter. Commissioner Sims stated that Del Rio had given $6,000.00 to fix the road originally when the plant was put in. He continued saying that the majority of the traffic came from the plant and he felt it was better to put in a better road for the tax payers in Brazos County. Commissioner Wilcox suggested that Del Rio needed to financially assist with upgrading the road. Commissioner Turner asked how much money was in the State Lateral Road fund. He was told that it was approximately $180,000.00. Commissioner Turner said he would like to delay the action because he could use some of the money on his roads. Commissioner Sims moved to accept the alternate bid of $107,845.00 and to pay for it from State Lateral Road funds. Commissioner Norton seconded the motion. Commissioners Norton and Sims voted "Aye". Commissioners Turner and Wilcox voted "No". Commissioner Wilcox stated the motion did not carry. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Cen-Tex Specialties. The Court received, approved and ordered filed as submitted the Treasurer's report for September 1990. A copy of which is attached to and made a part of these minutes. Commissioner Sims noted that at the last Commissioners' Court meeting, check #67938 to the National Rifle Association was for personal memberships and that the county does not pay for personal memberships. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to rescind payment to the National Rifle Association for personal membership fees.
