Adjourn. i I ' i 1 r I • 11 f COMMISSIONERS' COURT REGULAR MEETING OCTOBER 8, 1990 • A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, October 8, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The Court next considered Budget Amendment #18, which • would reallocate funds budgeted for the Juvenile Services Department, the Treasurer's Office and the County Attorney's Office. Also, increase the budget for the Elections Department and increase the budget for the Community Support Department. That figure will be reimbursed by the State. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by Commissioner Norton, seconded by Commis- sioner Turner, the Court voted unanimously to relocate the polling place for voting precinct 17 from Travis School to the St. Joseph Catholic Church Activity Center. This was Commissioners' Court meeting October 8, 1990 necessary due to the fact that the school building was sold to the church. The area used for a polling place has been completely fenced off and no longer accessible by the public. i A copy of the Order is attached to and made a part of these minutes. On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to appoint the following persons as presiding judge and alternate judge for the elections conducted by the county: Precinct # Presiding Judge Alternate Judge 10 Jeff Brown 32 Steve Parker The Court next considered a lease agreement between Brazos County and the Junior League of Bryan-College Station for rental of a portion of the Brazos Center, on Briarcrest Drive. The term of the lease will extend from May 31, 1990 and continue on a month to month basis until a construction schedule is firmly established by the Brazos Valley Museum or until February 1, 1991 whichever comes first. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the lease agreement between the two for the period stated above. A copy of the lease agreement is attached. The next matter before the Court was a special warranty deed on two (2) parcels of land in the original townsite of Millican. After review by legal counsel it was found that all was in order. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to authorize the County Judge to execute the Special Warranty Deed which quit claims Brazos County's interest in the property but does not warrant title to the property. The Court next considered the acquisition of right-of-way i for Jones Road in Precinct 4. On motion by Commis- sioner Sims, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Brushy Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. On motion by Commissioner Wilcox, seconded by Commis- sioner Sims, the Court voted unanimously to certify that Brazos County currently maintains 469 miles of county roads and to forward the information to the State Department of Highways and Public Transportation. This will be used by the County Tax Assessor to compute the distribution of registra- tion fees collected in the 1991 calendar year. The Court next considered extending the bid for the following bids: • Bid No. 89-495 - Annual Road Gravel Contract Expiration Date October 15, 1990 Cheryl Turney, Purchasing Agent, explained the request was necessary due to receiving only five (5) bids when they had received fourteen (14) in 1989. Road I Commissioners' Court meeting October 8, 1990 and Bridge has road gravel stockpile at two pit locations. Due to an oversight, neither landowner turned in bids this year. On motion by Commissioner Norton, seconded by commissioner Sims, the Court voted unanimously to accept the recommen- dation of the Purchasing Agent and extend the contract. Bid No. 89-517 - Annual Operator and Equipment Contract Expiration date October 15, 1990 Cheryl Turney, Purchasing Agent, explained the request was necessary due to the fact that they did not receive any bids by the August 27, 1990 due date. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to accept the recommendation of the Purchasing Agent and extend the contract. The Court acknowledged receipt of the Extension Service reports for September 1990 and acknowledged receipt of reports from County and Precinct offices showing revenues collected and remitted to the County Treasurer. TEXAS WHEREAS, the Commissioners Court has contacted the St. Joseph Church to obtain permission to use the school building in which to hold the election on November 6, 1990; and WHEREAS, the St. Joseph Church has advised the Commissioners Court that the area of the school that was used for a polling place has been completely fenced off and is no longer accessible by the public; and WHEREAS, the St. Joseph Church has offered the use of the 61 St. Joseph Catholic Church Activity Center to be used as the polling place for voting precinct 17; and WHEREAS, the St. Joseph Catholic Church Activity center is located across the street and approximately one-half block west of the previous location; and WHEREAS, the Commissioners Court is desirous of keeping the polling place in close proximity of the previous location; now therefore h VY 1k) BE IT ORDERED ADJUDUD AND DECREED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS, that the polling place for voting precinct 17 be located in the St. Joseph Catholic Church Activity Center located at 600 East 26th Street, Bryan, Texas effective this the 8th day of October, 1990. J. olmgreen, County Judge ATTEST: Frank Bor sk e, County Clerk ~'~a PAGE `610 • • STATE OF TEXAS COUNTY OF BRAZOS Y LEASE AGREEMENT This agreement between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and JUNIOR LEAGUE OF BRYAN-COLLEGE STATION, hereinafter called Lessee, is 1 made as follows: i Lessor, the Owner of the Brazos Center, a multi-use building and the adjacent grounds has agreed and does hereby agree, to lease and demise unto Lessee, a portion of the Brazos Center, hereinafter described, upon the following terms and conditions. 1. Lessee shall be entitled to the space exclusively allocated to it by the Director of the Center for a term extending from May 31, 1990 and continuing on a month-to-month basis until a con- struction schedule is firmly established by the Brazos Valley Museum or until February 1, 1991 whichever comes first. The space allocated to Lessee is described in Attachment "A" hereto attached, which has been signed by the Director of the Center. 2. In addition, fees for temporary use of space required for pro- visional, membership and board of directors meetings are included in this contract as well as space for the League Placement Fair. Such meetings should be scheduled as far in advance as possible on a space available basis. 3. Fees for meetings involving small spaces for puppet show practice as well as for committee meetings are also covered in this contract provided the following conditions prevail: a. Meetings in small rooms are to be held only during normal business hours or after 5 p.m. when another activity is scheduled requiring a Brazos Center attendant to be on the premises; b. If the space used for the meeting has been previously set-up for a meeting scheduled at a later time by another group, the committee chairman will be responsible for determining that the room is in the exact state as when the room was entered; c. The committee chairman should give the Brazos Center office a notice of intention to meet no less than one week in advance; d. The League member in charge of the meeting will sign a sheet kept in the Brazos Center office noting the date, name of the committee meeting, the entry time and the departing time. • 4. In consideration therefore, Lessee agrees to pay the Lessor, on the first day of each calendar month during the term hereof, in advance, the sum of $225.00 (two hundred and twenty-five dollars) for rental of exclusively occupied space as well as for fees assessed for space for temporary uses described above. In addition Lessee has permission for free use of Assembly I for two six-hour periods as scheduled in advance with the Brazos Center. Additional uses of Assembly I for membership meetings may be scheduled on a first-come, first-serve basis for $50 per day. ~ 8. 9. i , 10: ~i I 12. 13. 14. Additional charges may be made for activities other than those specified in this contract. Lessee will pay the regular User fees for apace used by it, other than space allocated to it under this agreement. A. Lessor shall furnish all utilities, including gas, water and electricity. B. Lessee shall furnish telephone and answering service for itself. Lessor does not provide and will not provide furnishings, custodial care, or maintenance of the space allocated to Lessee under this agreement. Lessee shall take good care of the space allocated to it, reason- able wear and tear only excepted, and shall surrender the premises at the termination of this agreement. Lessee agrees that no improvements to or alterations to the space shall be made without the consent of Lessor in writing. Risk or loss of all property owned by Lessee shall remain with Lessee, it being understood that Lessor will maintain no insurance on such property. Any insurance desired by Lessee on Lessee's property shall be purchased by Lessee at its expense. Lessor shall not be liable to Lessee or the Lessee's employees for any damage to person or property caused by the negligent act of Lessor, its agent, servants, or employees or due to the act of any other tenant in the building, or due to any defect or want of repair in any part of the building of which the allocated space forms a part. Lessee agrees to hold Lessor harmless from any and all claims, damages, expenses, including attorney's fees, growing out of or arising from any negligent act on the part of Lessee, its agents, servants or employees. No sign shall be placed at, or on or about the premises by Lessee except with the approval of the Center Director in writing. Lessee president, as designated below right, shall be issued only one key to the office allocated space. By accepting the key, Lessee president agrees on behalf of all Lessee associates to (a) use the allotted space only when the Brazos Center is open for business or in use and (b) allow no copies or duplicates of the key to be made. Lessor agrees to keep two duplicate keys on file in its office which will be available for use to those deemed qualified by Lessee. I understand and agree that: 1. The County Engineer must be notified 72 hours prior to the beginning of construction in order that he or his designated inspector may inspect the actual installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. ! 3. That Brazos County reserves the right to require Applicant to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That the line will be constructed and maintained on the County right- of-way in accordance with governing laws. 6.
