SEPTEMBER 17, 1990
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 6:00
p.m. on Monday, September 17, 1990, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
Mr. John Edd Tucker, representing the 4-H Equestrian
Club, addressed the Court. He in turn introduced Matt Wood,
President of the 4-H Equestrian club who presented the Court
with the banner won at the Fort Worth Horse Show. Mr. Wood

informed the Court that this was the sixth straight year the
Equestrian club had won the competition. Mr. Tucker cited the
many achievements of the young people involved in 4-H and
stated that they needed help to continue being successful. He
asked if the Equestrian Club could use the Rodeo Arena for the
riding sessions. These sessions would be two (2) weekends per
month on Sundays for three (3) or four (4) hours and two (2)
nights during the week. He asked to be allowed to use the
Rodeo Arena for free. The County Judge stated the problem was
that it had been open to the public in the past and that it
had not worked. The County Judge appointed a committee of
Commissioners Norton and Wilcox and Phyllis Dozier, Director
of the Brazos Center, to meet with Mr. Tucker to reach an
agreement on the use of the facility. Commissioner Sims asked
if they could contract with the club for upkeep in exchange
for use of the facility. This was agreeable to Mr. Tucker.
The County Judge thanked Mr. Tucker and the members of the

Equestrian Club for coming.
The next matter for consideration by the Court was a
request submitted by the head of Data Processing requesting
approval for out of state travel for Patricia Tijerina. Mrs.
Tijerina would be traveling to Seattle, Washington to attend
a "Use Conference" seminar during the week of November 4
through the 9, 1990. on motion by Commissioner Norton,
seconded by Commissioner Wilcox, the Court voted unanimously
to grant the request from the head of Data Processing and
approved payment of out of state travel expense for Mrs.
Patricia Tijerina.

The County Judge announced that the Commissioners Court
of Brazos County, Texas will hold a public hearing to consider
traffic regulations on various county roads pursuant to
section 2.301 of the County Road and Bridge Act, Art. 6702-1
subchapter D, Vernons Civil Statutes. The meeting will be
held in the Commissioners Courtroom of the Brazos County
Courthouse on Monday September 24, 1990 at 1:00 p.m..
On motion by the County Judge, seconded by Commissioner
Commissioners' Court meeting September 17, 1990
Norton, the Court voted unanimously to appoint Celia Goode
Presiding Judge of the Absentee Ballot Board.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to extend the lease
agreement between Brazos county, Texas and the Brazos Valley
Art League on a month-to-month basis until a construction
schedule is firmly established by the Brazos Valley Museum or
until February 1, 1991 whichever comes first. A copy of the
lease is attached hereto.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to advance $6,617.00 in
1991 budgetary funds to the Millican Volunteer Fire Department
in order to purchase radios. A copy of the request is
attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to set the following fees
to be charged for services of the Sheriff and Constables of
Brazos County:

The County Judge stated copies of Brazos County's fees will be
sent to all counties in the state, the Texas Association of
Counties and to the State Bar.
The Court next considered a Court Order addressing the
reporting of excessive damage to county property, roadways,
bridges and right-of-way. Commissioner,Norton read the order
aloud. The County Judge asked why this was being limited to
the Constable of Precinct 7. Commissioner Wilcox replied that
the Constable had been designated the Traffic and Litter
Enforcement Officer and he covers the entire county. It was
the consensus of the Court that the Order should read all
enforcement officers. On motion by Commissioner Norton,
seconded by Commissioner Sims the Court voted unanimously to
table consideration until a future date.
The Court next considered reassigning the duties of
permitting for over weight vehicles from the Road and Bridge
Department to the office of Constable Precinct 7. The County
Judge asked if all law enforcement officers could give
tickets. He was informed that they could with the exception
of licensing and weights. Commissioner Sims indicated that he
liked the idea of permitting with the traffic section. The
County Judge recommended letting legal counsel review the
order. It was the consensus of the Court to table
consideration until a later date.
The Court next considered awarding the following bids:

motion by Commissioner Norton, seconded
by_Commissioner Sims, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Vulcan Materials on the THD
330 and to award the contract to Colorado
materials on the THD 350.
Bid No. 90-560 - Annual decking Timber Contract
Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Olsen Guerra Lumber Company
of Houston. On motion by Commissioner
Sims, seconded by Commissioner Norton,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Olsen Guerra
Lumber Company of Houston. A copy of the
bid tabulation is attached hereto.

recommended acceptance of the bid

Galvanized steel Corrugated Culverts and
acceptance of the bid submitted by

Reinforced Concrete Pipe Culverts. On
motion by Commissioner Norton, seconded
by Commissioner Sims, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Wilson Culverts, Inc. on the
Galvanized steel Corrugated Culverts and
to award the contract to Gifford Hill and

items #5 & 7. On motion by Commissioner
Norton, seconded by Commissioner Sims,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Producers
Cooperative on items #1,2,3,4 & 6 and to
award the contract to Farm and Ranch
Lumber on items #5 & 7.
The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requests permission
to enter the private property of Elmo Newsom, Jr. on River
Road near the intersection of valley View Road in Precinct 4
for the purpose of excavating an outlet channel from the road
ditch and permission to enter the private property of Kermit
Scott on Bush Lane in Precinct 4 for the purpose of providing
a turn around for Brazos County trucks. On motion by
Commissioner Wilcox, seconded by Commissioner Sims, the Court
voted unanimously to authorize the work.

On motion by Commissioner Turner, seconded by Commis-
signer Norton, the Court voted unanimously to approve the
Claims as submitted.
At 7:02 p.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section (6252-17(2)(g) Vernon's Texas Civil Statutes.
At 7:03 a.m. the County Judge announced the meeting open
to the public. On motion by Commssioner Sims, seconded by
Commissioner Norton the Court voted unanimously to approve the
request of the Sheriff to hire Walter Robnett at a Pay Group
12, Step 2 with no six month step increase.
There being no further business to come before the Court,
the meeting was adjourned.

LEASE AGREEMENT EXTENSION
This agreement, hereinafter called Lease Agreement Extension,
between BRAZOS COUNTY, TEXAS, and BRAZOS VALLEY MUSEUM, extends
the current lease agreement ending on September 30, 1990 to continue
on a month-to-month basis until a construction schedule is firmly
established by the Brazos Valley Museum or until February 1, 1991
I whichever comes first. The space allocated to Lessee is described
in Attachment "A" hereto attached, which has been signed by the
Director of the Center.
IN TESTIMONY WHEREOF, the parties to this agreement have hereunto

This is an agreement between Brazos County and the Millican Volunteer Fire Department.
County agrees to pay the Department $ 6,617.00 (six thousand. six hundred seventeen
dollars) for the purpose of purchasing radios for the Millican Volunteer Fire Department.
The payment will be made from the funds budgeted for the 1991 calendar year and will
reduce the amount paid to the Department in January of 1991 by that amount.
