COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 10, 1990 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, September 10, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Drake Well Solutions Scotty Stroud Well Tech, Inc. Commissioner Sims gave the invocation and led the pledge of allegiance. The Court heard from Mr. Clarence Lacy, representative of Lacy well Service, on the heavy weight permits and the impact it will have on the oil industry in Brazos County. He cited numerous statistics on the number of people involved in the oil industry in Brazos County along with payroll figures and the claim that oil was the largest tax paying industry in the county. He explained that county permitting has curtailed the ability to service wells, utilize equipment thus reducing Vol. .i:-.-° lob - - W- - Al /~1 Commissioners' Court meeting September 10, 1990 • 4D 1. Vro revenues, salaries and production. He asked the members of 1 1. U) , P, E~ the Court to appoint a committee of oil and gas producers, water haulers etc. to come up with a solution to the problem. Mr. Edwin Drake, representative of Well Solutions, echoed Mr. Lacy's sentiments. Mr. Richard Rosas, representative of Rosas Trucking, stated all the roads in the county need to be brought up to the 58,420 pound limit and fix the roads where they would all be even. The County Judge interjected that he would love to do it all but that the County needed money to do it. The County Judge continued saying that it was not the intent of the County to be detrimental to business. Who pays to fix the roads afterwards. The County does not have unlimited funds, when the roads are torn to pieces, the users should help pay for usage. Mr. Lacy stated that the county fails to recognize what well service companies have already paid, what is currently being paid in taxes and fees. The better roads that we have now are due to oil and gas money. The County Judge stated that the oil and gas industry did not build the roads in Brazos County. Mr. Lacy continued by saying that companies based in Brazos County have a lot at stake because Brazos County is the only one enforcing permit regulations. He said he could foresee the day you will have to pay $300.00 or more in permits to get to an oil well. We need to come up with something that won't hinder or delay work. The County Judge stated he saw no problem with the request. Mr. Scotty Stroud, representative of Well Tech, reiterated Mr. Lacy's concerns and stated he would like to work with the Court to resolve the dilemma. The County Judge thanked the representatives of the oil industry for their comments. The Court next considered approval of the minutes of the Commissioners' Court meeting held August 6, 1990. on motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the minutes as submitted. The Court next considered a Resolution in support of A Commissioners' Court meeting September 10, 1990 keeping the 6th Congressional District intact as far as Brazos County is concerned. The County Judge requested that the Court table consideration of the Resolution until such time as the person requesting adoption could be present in Court. He went on to explain that if the district is split and Brazos County were to be placed in a District with Houston the interests of Harris County would almost certainly dominate. Commissioners Norton, Sims and Wilcox were in favor of leaving Brazos County in the 6th Congressional District. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to adopt the Resolution requesting that Brazos County remain intact within the 6th Congressional District and to forward the Resolution to a meeting of the Texas Legislature Redistricting Committee in Austin on September 28, 1990. The Court next considered adopting the following orders: (1) Order creating one temporary branch absentee polling place and relocating one temporary branch absentee polling place. Such order would create on additional temporary branch at the Galilee Baptist Church, relocate the Ben Milam temporary branch absentee polling place to the Santa Teresa Catholic Church and retain the temporary branch absentee polling place at the MSC on the Texas A&M campus and retain the temporary branch absentee polling place at the College Station Independent School District Offices. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to adopt the Order as attached to these minutes. (2) Order relocating the polling place for voting Precinct 3 from the SPJST Hall to the Volunteer Fire Department building, relocating the polling place for voting Precinct 21 from the Married Student Housing to the University Tower Building and relocating the polling place for voting Precinct 29 from the Brushy Community Center to St. Mark's Baptist Church. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to adopt this Order as attached to these minutes. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to approve a tax refund for Carey Dale Ted, Inc.. The County will refund $958.30. The Court next considered the request by United Telephone to install buried communications cable along the right-of-way of Peach Creek Cut-Off in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request of United Telephone Company and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by Lone Star Gas to install a 3/4" gas service line within the right-of-way of Post Oak Bend in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Lone Star Gas and authorized the installation. A copy of the request is attached hereto. The Court acknowledged receipt of the Extension Service reports for August 1990 and acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. TEXAS THE STATE OF TEXAS rOUNTY OF BRA20S ORDER RELOCATING POLLING PLACE FOR VOTING PRECINCT 3, POLLING PLACE FOR VOTING PRECINCT 21 AND POLLING PLACE FOR VOTING PRECINCT 29 WHEREAS, there exists at the present three certain polling places which can not be used for the purpose of conducting elections; and WHEREAS, the polling place for voting precinct 3 is presently located in the SPJST Hall located on the east side of i silver Hill Road, Brazos County, Texas; and 1 WHEREAS, Brazos County has been notified that the SPJST Hall has been listed for sale and will no longer be available for use as the polling place for voting precinct 3; and WHEREAS, the Commissioners Court is desirous of relocating the polling place for voting precinct 3 in the Fire Station of the Volunteer Fire Department located on the east side of Smetana Road; and WHEREAS, the polling place for voting precinct 21 has been located in a portable building at the Married Student Housing complex in College Station, Texas; and WHEREAS, Brazos County has been unsuccessful in locating a portable building that can be moved to this location that is suitable for conducting elections; and WHEREAS, the Commissioners Court is desirous of permanently relocating the polling place for voting precinct 21 in the University Towers located at Texas Avenue and University Drive in College Station, Texas approximately three blocks east of it's present location and this being the same location used by the local Republican and Democratic Parties for the primary election; and LID I vc io E Yom. ti-• ha rr✓ • • i WHEREAS, the Commissioners Court has been contacted by the Election Judge and Clerks of voting precinct 29 regarding their safety and that of the voters where the polling place is presently located in the Brushy Community Center on Vincent Road and requested the location be changed; and WHEREAS, the Commissioners Court is desirous of locating the polling place in an area where the voters, and election workers will feel safe; and WHEREAS, the Commissioners Court is desirous of permanently relocating the polling place for voting precinct 29 in the St. Marks' Baptist Church located on State Highway 60 and Vincent Road; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS THAT: Pursuant to section 43.031(d) of the Election Code that the location of three polling places be relocated in Brazos County to wit: (1) THAT the polling place for voting precinct 3 be located in the Fire Station for the Volunteer Fire Department located on Smetana Road, Brazos County, Texas; and (2) THAT the polling place for voting precinct 21 be located in the University Towers located at 410 Texas Avenue South, College Station, Texas; and (3) THAT the polling place for voting precinct 29 be located in the St Mark's Baptist Church located on State Highway 60 and Old Jones Road, Brazos County, Texas; and (4) THAT submission be made to the Assistant Attorney General, Civil Rights Division, Voting Section, Department of Justice, Washington D.C. requesting preclearance of this Order pursuant to Section 5 of the Federal Voting Rights Act. UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches, trees and other terrain features, it is more practical to plow in center of road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30" except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36". The following are requirements which are made on the contractor: 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jurisdiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be immediately repaired to the satisfaction of the Engineer and Public Authorities having jurisdiction over highway and road right-of- way where involved. 4. Trenches shall be promptly back-filled with earth, and mechanically tamped at six (6) inch lifts so that the earth is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight. 5. The usual 10% fees withheld from contractor until repairs are made satisfactory with Engineer and Public Authorities having jurisdiction of right-of-way involved.
