SPECIAL MEETING
SEPTEMBER 4, 1990
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, September 4, 1990, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court heard Jon Miller, an attorney, representing an
Ad Hoc group comprised of Black and Hispanic voters. Mr.
Miller came before the Court to propose the following four (4)
locations for branch absentee polling places:
1. Santa Teresa Catholic Church
2. Galilee Baptist Church
3. Retain the MSC on the TAMU campus
4. Retain the College Station I.S.D. Office building
Mr. Miller stated that the church leaders agreed to allow the

use of the buildings for this purpose. He continued by saying
that the churches were better located and offered accessible
parking. Ben Milam School was not that easily accessible with
school in session and the school buses coming and going. The
MSC location gives many the opportunity to vote as does the
College Station Independent School District Office building.
Mr. Miller cited sections from the Election Code regarding
clearance from the Justice Department and hours of operation.
The County Judge asked if the west side of town didn't need a
location since the churches were both on the east side of
town. Mr. Carey Cauley stated that the Galilee Church was in
the center of the population of both the east and west sides
of town. The County Judge stated it was the intent of the
Court to make the locations available for all people and that
he had no problem with the two new proposed sites.
Commissioner Sims asked about the accessibility for
handicapped persons. Father Robles, Pastor of Santa Teresa
Church assured him that the locations can be made accessible.
The County Judge informed Mr. Miller that the Court could not
take action on the recommendation but would put it on the
agenda of the next Commissioners Court meeting.
It was the consensus of the Court to table consideration
of the minutes of the Commissioners' Court meeting of August
6, 1990.
The Court next considered Budget Amendment #16, which
would reallocate funds budgeted for the Non-Departmental
department and the District Attorney's department. On motion
by Commissioner Norton, seconded by Commissioner Sims, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
On motion by Commissioner Sims, seconded by commissioner
Norton, the Court voted unanimously to call a Public Hearing
to consider traffic regulations on various county roads in the
Oakland Lakes Subdivision in Precinct 3. The date of the
Public Hearing was set for Monday, September 17, 1990 at 1:00
p.m. in the afternoon.

The Court next considered a Wavier of Competitive Bidding
Requirements as provided in the Local Government Code, Section
262.024(a)(4) of Vernon's Annotated Civil Statutes for the
purchase of the personal and/or professional Election services
from Mr. Bill McLeod, Texas Voting Systems. This was
necessitated due to it being a single source supplier. On
motion by Commissioner Norton, seconded by commissioner Sims,
the Court voted unanimously to approve the Waiver of
Competitive Bidding Requirements and authorized the payment
for said work in an amount not to exceed $15,000.00.
The Court next considered liability coverage for the
prosecutors. The County Judge stated that the coverage for
the County Attorney and the District attorney was quite
expensive. The present carrier offered a Master Policy on all
elected officials, but does not cover "Grievance" which is the
cost to cover defending a criminal case against an employee.
The District Attorney asked that the County assume up to
$5,000 of the cost of grievance. Cheryl Turney, Purchasing
Agent, stated there would be a $3,000.00 savings with this
policy plus all the elected officials would be covered. On
motion by the County Judge, seconded by Commissioner Norton,
the Court voted unanimously to pay up to $5,000.00 on the cost
of "Grievance."
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to table consideration of
traffic enforcement, regulations and permitting on county
roads until a future date to allow further study.
The Court next considered the installation of private
road signs for rural citizens to meet 9-1-1 District
requirements. The County Judge asked why we needed to do
this. Commissioner Wilcox explained that sometimes there are
two (2) or more dwellings on a private road and that 9-1-1
needed the names of the roads posted to direct emergency
services to the location. The County Engineer stated that the
people on these roads will purchase the signs and the Road and
Bridge Department will install them. The only cost to the

County will be for the posts. -In the event a road sign is
stolen, the requestor will provide another sign. The colors
will be reversed and the letters "PVT" will appear on the sign
to distinguish it from the other signs. The cost will be
$1,300 for posts and installation of the sixty (60) signs. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to authorize the installation of
private road signs for rural citizens to meet 9-1-1 District
requirements.
The Court next considered the request by General
Telephone Company of the Southwest to construct a
communication line within the right-of-way of Batts Ferry and
Koppe Bridge Roads in Precinct 1 and Old Spanish Trail and
Redbud Drive in Precinct 4. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request of General Telephone Company of the
Southwest and authorized the installations. A copy of each
request is attached hereto.
The Court next considered awarding the following bids:

Commissioner Sims questioned check number 66589 which was
payment for a State Mileage Guide. The District Clerk
explained that people coming to testify are reimbursed mileage
and they go by the charts in the State Mileage Guide.
Commissioner Sims also questioned the payment to Engineering
and Office Supply for purchase of a desk and chair. It was
explained that there were no chairs or desks in inventory. on
motion by Commissioner Norton, seconded by Commissioner Sims,
the Court voted unanimously to approve the Claims as
submitted.
There being no further business to come before the Court,
the meeting was adjourned.

Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
BRAZOS County, TEXAS as follows:

All cables to be placed 5' inside R.O.W-a where possible..

The location and description of this line and associated appurtenances is
more fully shown by 2 copies of drawings attached to this notice.
The line will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that tender of this notice by the General Telephone Company of the
Southwest does not constitute a waiver, surrender, abandonment or impairment of
any property rights, franchise, easement, license, authority, permission,
privilege or right now granted by law or may be granted in the future and any
provision or provisions so construed shall be null and void.
Construction of this line will begin on or after August 27 199_•

ATTENTION COUNTY JUDGE: Gary Norton
Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
Brazos County, Wellborn as follows:
From the intersection of Batts Ferry and Koppe Bridge Rd. going north
approximately 1/4 of a mile. We propose to place a two pair buried drop
1 across Koppe Bridge going east of the right-of-way of Koppe Bridge Rd.
At this point, we propose to cohtinue north for approximately 1400'. This
buried drop will be placed parallel inside of the right-of-way 5'.

Koppe Bridge Rd is to be bored.
i
Cable along Koppe Bridge is to be placed 30" deep.
The location and description of this line and associated appurtenances is
