COMMISSIONERS' COURT SPECIAL MEETING AUGUST 20, 1990 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on Monday, August 20, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Asst. to County Judge Bea Green Secretary to Commissioners Rosalie Todaro Auditor's Office Cheryl Turney Auditor's Office Shelley Lambert Treasurer's Office Stephen Hanel District Attorney's Office Robert Hickman Pct. 4 Constable's Office Winfred Pittman Constable Pct. 4 Karen McQueen County Clerk's Office Jim Hiney Bryan/College Station Eagle Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendment #14, which would increase the funds budgeted for the Department of Constable Precinct 4 and increase the budget of the 9-1-1 j Service. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. I On motion by Commissioner Norton, seconded by Commis- sioner Wilcox, the Court voted unanimously to enter into agreement with Ed Slovacek, P.C. for administrative services of the County's Section 125 Cafeteria Plan. The effective date of this agreement will commence with the plan year on September 1, 1990. A copy of the agreement is attached hereto. At 6:07 p.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel as allowed under Section 6252-17(2)(g) Vernon's Texas Civil Statutes. At 6:14 p.m. the County Judge announced the meeting open to the public. On motion by commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of the Tax Assessor /Collector to move Lisa i i 0 I t f Commissioners' Court meeting August 20, 1990 E is Brinkman from a part time position to a full time position of Group 5 Step 2 with no six month step increase. Commissioner Wilcox moved to approve the request of the Tax Assessor Collector to hire Dana Horton at a pay group 5 step 2 with no six month step increase. Commissioner Turner seconded the motion. Commissioners Norton, Turner and Wilcox voted "Aye". Commissioner Sims voted "No". The County Judge declared the motion carried. The following proceedings were held: THAT WHEREAS, on August 20, 1990, the Court heard and approved a budget amendment for the 1990 budget year for Brazos County, Texas. WHEREAS, an expenditure is necessary due to the necessity to meet unusual and unforeseen conditions which could not be reasonably included in the original budget adopted September 22, 1989, the following amendment(s) to the original are hereby authorized, as described on the attached 1 page(s). C= certified public accountant C~ AGREEMENT FOR ADMINISTRATIVE SERVICES This agreement dated August 7, 1990 specifies the services to be provided to Brazos County hereinafter referred to as "County" in the ongoing administration of the County's Section 125 Cafeteria Plan, and the specified responsibilities of the County. The effective date of this agreement will commence with the Plan year beginning September 1, 1990. Administrator The County shall be the Plan Administrator and Ed Slovacek, PC, hereinafter referred to as the "Administrative Firm" shall be engaged as a subcontractor in the performance of administrative services for the plan. Administrative services to be provided by Administrative Firms 1. Prepare and conduct one seminar to explain the Cafeteria Plan to the employees. 2. Provide participant election forms to be used during the enrollment process. 3. Process initial enrollment forms and revocation forms to initiate the administration function. 4. Prepare confirmation letters to employees to verify elections. 5. Provide each participant with a Reimbursement Claim Booklet and instructions for filing claims. 6. Provide reimbursement checks to employees on a bi-weekly basis. 7. Provide a check register for all checks printed on a bi- weekly basis. 8. Provide each participant a Statement of Account on a bi- weekly basis. 9. Provide monthly worksheets for reconciling payroll amounts redirected to the Cafeteria Plan. 10. Provide annual County statements of participation by plan by participant. 12. Provide annual preparation of Form 5500. 13. Provide participant election forms at the end of each year for use in making elections for the following years. Conm■•n+cation services to be provided by Administrative Firm 1. Present informational seminar to the employee group. Responsibilities of the County 1. Secure legal review of the Cafeteria Plan Document and E Summary Plan Description from County's legal counsel. 2. Report participant terminations and changes of family j status to Administrative Firm to be effective 2 weeks after receipt. 3. Reconciliation of payroll amount redirected to the j Cafeteria Plan based on reports provided each month by I Administrative Firm. 4. Distribution of checks and participant statements of account to County employees. 4 5. Provide Administrative Firm with blank check stock for use in preparing reimbursement checks. 6. Actual signing of reimbursement checks. I 7. Initiate any action required in the event plan(s) become discriminatory. Fees and Terms of Payment i 1 At each reimbursement period we will prepare a check from your "Flex" account for the amount of our fee for that period. The County will remit that check to the Administrative Firm upon receipt. The fee schedule is attached as Exhibit A. The Administrative Firm has the right to change the fee schedule by giving at least 60 days notice to the County. Reports and Data All reports and data remain the property of the County. Administrative Firm will provide the County all data, upon request, in the electronic or printed format used by Administrative Firm in its administration procedures. j ~i • • i } 0 Software In the event the County wishes to self-administer the Cafeteria Plan, Ed Slovacek, PC, a CPA/CFP firm in Bryan, Texas will sell to the County the software written to administer the Cafeteria Plan at the price in effect at that time. Any time required to train company personnel will be charged at our normal per diem rates. Terms of this Agreement This agreement will be affective from the date both parties execute this agreement until it is terminated .
