I VU F~ ? rn r7L- 1 i , I I COMMISSIONERS' COURT • REGULAR MEETING AUGUST 13, 1990 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in'the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, August 13, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Robert Heath Bickerstaff Heath & Smiley Commissioner Sims gave the invocation and led the pledge of allegiance. The.Court next considered approval of the minutes of the Commissioners' Court meeting held July 30, 1990. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the minutes as submitted. The Court recognized C. Robert Heath, representative of Bickerstaff Heath & Smiley, who addressed the issue of the impending redistricting facing the Court in 1991. He offered the assistance of his firm to help the County have an open and fair process and to help minimize litigation. Mr. Heath Q i Commissioners' Court meeting August 13,1990 i quoted hourly prices ranging from $50.00 to $160.00 and total cost ranges from $2,500.00 to $20,000.00. He stated the average total cost was somewhere between $12,000.00 to $15,000.00. The County Judge stated the Court used the firm previously and considered doing so again. He then thanked Mr. Heath for his presentation. The Court next heard a presentation by Jim Selby, representative of Colonial Life and Accident Company, who presented a proposal for doing third party administration for the Flexible Benefits Plan offered to Brazos County Employees. Mr. Selby outlined the services and costs to the employees and the value added services for the employer. The County Judge thanked him for the information. The Court next considered Budget Amendment #13, which would increase the funds budgeted for the Constable Precinct 7 Department by $4,500.00. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered awarding the following bid: Bid No. 90-546 - Property and Casualty Insurance The County Judge stated that there was a vast difference in the prices for coverage between the bidders. He felt it was too early to make a change due to the low bidder, Hibbs-Hallmark, only having a four year history in the state of Texas. He also stated that the County had exceptional coverage with Mallard Insurance. The County Judge also i noted that should coverage end with Hibbs-Hallmark the reserve is returned to the County and the County is liable and would not have back claim coverage. On motion by the County Judge, seconded by Commissioner Turner, the Court voted unanimously to award the contract to Mallard Insurance Company. A copy of the bid tabulation is attached hereto. The Court next considered an application for a tax refund from Sun Operating Limited Partnership. In a court settlement t it was decreed the appraised value of the property is i $250,000.00 and that Sun Operating Limited Partnership was due i a tax refund. On motion by Commissioner Sims, seconded by Commissioners' Court meeting August 13,1990 • i~ ,*I Commissioner Norton, the Court voted unanimously to approve the application for a tax refund in the amount $7,648.07. The next matter for consideration was a Roadway Easement proposed by Enserch Corporation to enable the County to widen Greens Prairie Road. After review by legal counsel it. was noted that the document failed to state who was responsible for the cost of repair in the event the Enserch Corporation damages the roadway while maintaining, repairing or replacing pipelines in the ground. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to accept the proposed Roadway Easement upon determination of who is responsible for the cost of repair in the event the Enserch Corporation damages the roadway while maintaining, repairing or replacing pipelines in the ground. The Court next considered the request by Wellborn Water to install a waterline within the right-of-way of Koppe Bridge Road in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Wellborn Water and authorized the installation. A copy of the request is attached hereto. The Court next considered the request by General Telephone to locate underground cable within the right-of-way of Stousland and Straub Roads in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of General Telephone and authorized the installation. A copy of the request is attached hereto. The Court acknowledged receipt of the Extension Service reports for July 1990 and acknowledged receipt of reports from County and Precinct offices showing revenues collected and remitted to the County Treasurer. At 10:47 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel 6252-17(2)(g). At 10:53 a.m. the County Judge announced the meeting open to the public. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Constable Precinct 4 to start a part time employee, Gayla Butler, in a budgeted position at $10.4504 per hour which is the same hourly rate of the employee who vacated the position.
