REGULAR MEETING
JUNE 11, 1990
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, June 11, 1990, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Presiding;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to authorize the
Brazos County Bar Association to place a plaque in the
courthouse. The plaque, presented by the Pro Bono Awards
Committee, honors those lawyers who have unselfishly devoted
their time, talent and knowledge to serving the legal needs of
the poor. The 20" x 30" solid walnut plaque with brass will
also contain individual brass plates reserved for the names of
the recipients of the Brazos County Bar Association Pro Bono
Award. Commissioner Sims stated that they do a tremendous
job.
The Court next considered adopting an order confirming
the creation of Rural Fire Prevention District No. 1.

Commissioner Wilcox stated that there were 214 votes for the

creation of the Rural Fire Prevention District and 150 against
the creation of the Rural Fire Prevention District. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to adopt an Order confirming the
creation of the Rural Fire Prevention District under the name
of Brazos County Rural Fire Prevention District No. 1 under
and pursuant to Article III, Section 48-d of the Constitution
of Texas and with the powers vested in such district conferred
by law. A copy of the Order is attached hereto.
The next matter for consideration was the appointment of
. the Board of Fire Commissioners for Rural fire Prevention
District No. 1. Commissioner Norton read out the following
names:

On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to appoint the previously
named people to serve on the Board of Fire Commissioners for
Rural Fire Prevention District No. 1.
The Court next considered adopting an order confirming
the creation of Rural Fire Prevention District No. 4.
Commissioner Wilcox stated there were 122 votes for the
creation of the Rural Fire Prevention District and 83 against
the creation of the Rural Fire Prevention District. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to adopt an order confirming the
creation of the Rural Fire Prevention District under the name
of Brazos County Rural Fire Prevention District No. 4 under
and pursuant to Article III, Section 48-d of the Constitution
of Texas and with the powers vested in such district conferred
by law. A copy of the order is attached hereto.
The next matter for consideration was the appointment of
the Board of Fire Commissioners for Rural Fire Prevention
District No. 4. Commissioner Norton read out the following

on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to appoint the previously
named people to serve on the Board of Fire Commissioners for
Rural Fire Prevention District No. 4.
The Court next considered the purchase of uninterruptible
power supply backup power batteries for the Data Processing
Department. On motion by Commissioner Sims, seconded by
Commissioner Wilcox, the Court voted unanimously to approve
the purchase of the batteries for $4,130.00 from Power Scan.
This price includes installation and a two (2) year warranty.
The Court next considered the request by General
Telephone Company to install a buried cable along the right-
of-way of Dowling Road, I&GN Road and Capstone Drive in
Precinct 1. The County Engineer indicated all was in order.
On motion by Commissioner Wilcox, seconded by Commissioner
Norton, the Court voted unanimously to approve the request of
General Telephone Company and authorized the installation. A
copy of the request is attached hereto.
The Court next considered authorizing work outside of

county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requests permission
to enter the private property of J. L. King, Jr. on Deep Well
Road to excavate a channel to allow water to drain into pond
from Deep Well Road in Precinct 2. The Road and Bridge
Department also requests permission to enter the private
property of David and Mary Holleman on Capstone Drive in
Precinct 1 and remove topsoil consisting of clay material to
be used in bar ditches along county roads for the prevention
of further erosion. On motion by Commissioner Wilcox,

The Court acknowledged receipt of the Extension Service
eports for May 1990 and acknowledged receipt of reports from
ounty and Precinct Offices showing revenues collected and
remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
The Court proceeded to consider the change of status of
the following employees.

ORDER CONFIRMING CREATION OF RURAL FIRE PREVENTION DISTRICT NO. 1
S
WHEREAS, at an election duly and regularly held on the 5th
day of May, A.D. 1990, within the portion of Brazos County, State
of Texas, described as:
Section 1: BEGINNING at the point of intersection of the
centerline of the Brazos River and the Centerline of White
Creek;
Thence southward along the meanders of the centerline of the
Brazos River (Brazos County-Burleson County and Brazos
County-Washington County line) to its intersection with the
centerline of the Navasota River;
Thence Northwardly along the meanders of the centerline of
the Navasota River (Brazos County-Grimes County line) to its
intersection with the center line of Carter Creek;
Thence Northwestward along the meanders of the centerline of
Carter Creek to its intersection with the College Station
city limits line;

WHEREAS, at such election 214 votes were cast in favor of
formation of said district and 150 votes were cast against such
formation; and

Thence Southwestward following the meanders of the City of
College Station city limits and Westwardly following the
meanders of the City of College Station city limits until it
intersects with the centerline of White Creek;
Thence Southerly along the meanders of the centerline of
White Creek to the point where it intersects with the
centerline of the Brazos River thus returning to the point
of the beginning.
Section 2: WHEREAS also including the area of land bordered
Rock Prairie Road on the East, Greens Prairie Road on the
South, and State Highway 6 on the West, excluding College
Station Extraterritorial Jurisdiction of 200 feet from the
centerline and the Southeast corner of this section known as
the College Station City Landfill.
there was submitted to the legal voters thereof the question
whether the above described territory shall be formed into a
Rural Fire Prevention District under the provisions of the laws
of this state; and

WHEREAS, the formation of such Rural Fire Prevention
District received the affirmative vote of the majority votes cast
at such election as provided by law;
NOW, THEREFORE, the County Commissioners Court of - Brazos
County, State of Texas, does hereby find, declare and order that
the tract hereinbefore described has been duly and legally formed
into a Rural Fire Prevention District under the name of Brazos
County Rural Fire Prevention District No. 1, under and pursuant
to Article III, Section 48-d of the Constitution of Texas, and
with the powers vested in such district conferred by law.

Road to the point where said centerline intersects Bryan

THENCE continuing in a southeast direction along the

ATTENTION COUNTY JUDGE:

Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Beginning at a point 15' east of the intersection of Dowling Rd. and IGN Rd., 15' of buried
cable will be placed west @ 5' within the north ROW of Dowling Rd; then cable will continue
West for 100' through a road bore; then 3,506' of buried cable will continue north on IGN Rd.
@ 5' within the west ROW; then 140' of cable will continue north through a road bore. Begin-
ning at the intersection of IGN Rd. and Capstone Rd., 607' of buried cable will be placed at 5'
within the south ROW of Capstone Rd; a road bore will be made across Capstone Rd; then the
cable will continue in the south ROW of Capstone Rd. for 527'; a road bore will be made
across Capstone Rd.; and then 358' of buried cable will be placed south at 5' within the east
ROW of Dowling Road.
The proposed cable will be buried to a minimum depth of 30"
The location and description of this line and associated appurtenances is
more fully shown by two copies of drawings attached to this notice.
The line will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that tender of this notice by the General Telephone Company of the
Southwest does not constitute a waiver, surrender, abandonment or impairment of
any property rights, franchise, easement, license, authority, permission,
privilege or right now granted by law or may be granted in the future and any
provision or provisions so construed shall be null and void.
Construction of this line will begin on or after June 1, 19 90
