VOL VV - __PAG COMMISSIONERS' COURT SPECIAL MEETING JUNE 4, 1990 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, June 4, 1990, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The Court next considered approval of the minutes of the Commissioners' Court meeting held April 16, 1990. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the minutes as submitted. The Court next considered a Resolution requesting that the Postmaster General establish a "local government postal rate" for local governments at a rate less than $.30 as part of the U.S. Postal services' rate increase filing. This is necessary in an effort to eliminate a potential federal mandate to increase local tax rates due to an increase in postal rates. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to forward the signed resolution to the Postmaster General. A copy is attached hereto. ' P J 1 3 { Commissioners' Court meeting June 4, 1990 I f On motion by the County Judge, seconded by Commissioner Wilcox, the Court voted unanimously to adopt the following State Board of Control Guidelines for the cost of reproduction of readily available standard size documents (legal size 8• 1/2" x 14"): $.10 for each page for fifty (50) pages or less $.85 for first page and $.15 for subsequent pages exceeding more than fifty (50) pages For documents not readily available: $.70 for first page and $.15 for each subsequent page plus actual labor cost. Commissioner Sims stated he felt the County should write to the State Board of Control saying that the rate is too low. The County Judge said he would write the letter. • The Court next considered a proposal submitted by General Telephone Southwest to secure the necessary right-of-way for the widening of Jones Road for approximately 2.4 miles, from F.M. 60 to the Villa Maria intersection. Garv Banta. i i representing General Telephone, estimated that the project will take from sixty (60) to ninety (90) hours to complete at an hourly rate of $65.00 per hour. Any utility relocation. drainage easements and condemnation proceedings will result in an additional $65.00 per hour rate. Brazos County will do title searches and abstract work. Commissioner Sims stated he felt it was a good rate. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to accept the proposal submitted by General Telephone Southwest and to pay for the work from Precinct 4's C.O. funds. • The Court next considered the request by United Telephone Company of Texas to install a buried communication cable in the right-of-way of Peach Creek Road in Precinct 1. Commissioner Sims asked that the burning of trees and trash on the right-of-way be cleared with the Air Control Board. He was informed that it was $12,000.00 plus Professional Insurance. He asked if $1,2500 was the maximum deductible and if the County could be named as insured. Commissioner Sims asked the Purchasing Agent to i investigate the deductible quote. Commissioner Sims then questioned check #63818 in which $450.00 was paid for a telephone card. It was explained to him that these are i installed in the telephone computer. It was the consensus of i the Court that at budget time, the Department Heads submit a i list of memberships and conferences which they will attend 1 i V® P~. • • 91 Commissioners' Court meeting June 4, 1990 during the year. Commissioner Sims asked the Assistant Auditor what was the subscription to Lotus. He was informed that it was a software magazine. on motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. Commissioner Wilcox informed the Court that the County Engineer had scheduled Tuesday, June 12 and Wednesday June 13 for Defensive Driving classes. At 10:30 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel. At 10:48 a.m. the County Judge announced the meeting open to the public. on motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to authorized the District Clerk to offer the temporary, full time position of microfilming clerk to Patsy Sanders. There being no further business to come before the Court, the meeting was adjourned. Lewallen and Mr. Gary Banta, with GTE Southwest out of Bryan, in regards to right-of-way negotiations along Jones Road in Brazos County. I understand that you are soliciting our help to secure the necessary right- of-way for the widening of Jones Road for approximately 2.4 miles, from F.M. 60 to the Villa Maria intersection. We will be glad to assist you in this project. Mr. Banta has relayed to me that this task can be completed in the range of from 60 to 90 hours. We will keep a weekly tracking of his time, and if problems arise that prohibit him from completing the work within the 60 to 90 hour time frame, we will contact you at that time and get your decision and approval for additional hours to proceed with the project. Mr. Banta does not anticipate any problems that would push us past the 90 hours. The hourly rate we charge for this type of work is $65.00 per hour. I have listed the scope of work to be performed by GTE in the acquisition by Deed of the Jones Road right-of-way: 1. Perform curative title research (Brazos County and Department of Highways and Public Transportation will provide title work and abstract of title, as required). 2. Assist Brazos County in the preparation of Documents. 3. Secure a metes and bounds description of the taking. This survey will be obtained from the Highway Department. 4. These efforts are not included in the 60 to 90 hours and will be an additional $65.00 per hour rate. If the statements in this letter are agreeable and acceptable, please sign and return one of the two letters, and we will accept this as your approval and notice to begin work on this project. TEXAS 77803 Dear Sirs WO 20810613 Formal notice is hereby given that the United Telephone Company of Texas, Inc. proposes to install buried communications Cable upon and along the right-of-way of county roads in BRAZOS County, Texas, as follows: IMPROVED ROADS (paved) - The contractor will plow cable in backslope with 8' of right-of-way line. Pipe will be bored under all paved county roads extending from ditch line to ditch line with a minimum cover of 30". IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope of the road, one track of the plow tractor on the backslope the other may come to the shoulder of the road neither whole tractor nor plow will be on the road surface. UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches, trees and other terrain features, it is more practical to plow in center of road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30" except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36". The following are requirements which are made on the contractor: 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jurisdiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be immediately repaired to the satisfaction of the Engineer and Public Authorities having jurisdiction over highway and road right-of- way where involved. 4. Trenches shall be promptly back-filled with earth, and mechanically tamped at six (6) inch lifts so that the earth is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight. 5. The usual 10% fees withheld from contractor until repairs are made satisfactory with Engineer and Public Authorities having jurisdiction of right-of-way involved. VOL . ~ I i ,r WO 20810613 BRAZOS County will not be held liable at any future date for accidental damages to the buried cable plant by road working equipment such as maintainers, hole diggers, etc. In the event of such damages the Telephone Company will be notifited immediately. • The County Commissioners Court may require the owners to relocate this line, for valid reasons under the law, by giving thirty (30) days written notice. a. Where communication facilities are located on county road ROW the Telephone Company will relocate said facilities at no expense to the County. b. Where communication facilities are located on private property the County will reimburse the Telephone Company for the relocation of said facilities. At any place where a communications line crosses over a county road, it shall be constructed and maintained at least eighteen (18) feet above the surface of the traffic lane.
