A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, May 7, 1990, with the following members of the
Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.

Commissioner Sims gave the invocation and led the pledge of
allegiance.
The County Judge announced that the canvassing of the
results of the election held May 5, 1990 would be delayed until
the afternoon session.
The County Judge read aloud a Proclamation proclaiming the
week of May 13 through 19, 1990 as "Brazos County Foster Family
Week". The Court joins with the Brazos County Foster Parent
Association, The Community Foster Child Support Services and the
Brazos County Child Protective Services Board to create greater
public awareness of the needs of foster children and the roles
and responsibilities of foster families. On motion by
Commissioner Wilcox, seconded by Commissioner Sims the Court

the week of May 13 through 19, 1990 as "Brazos County Foster Family
Week" throughout Brazos County. The County Judge then presented
the signed Proclamation to Mrs. Thelma Johnson, a long time foster
parent in Brazos County.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held April 12, 1990, April 19, 1990
and April 21, 1990. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve the
minutes as submitted.
The Court next considered Budget Amendment #7, for the 1990
Budget which would reallocate funds budgeted for the County
Attorney's Department and increase the budgets for the departments
of Constable Precinct 7 and Constable Precinct 4 by $375.00 each.
On motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered a Wavier of Competitive Bidding
Requirements as provided in Section 262.024 (a) (4) of the Local
Government Code for the purchase of personal and/or professional
engineering services from Garrett Engineering. Garrett Engineering
will assist in securing right-of-way for the Macey Road (FM 1940)
project. On motion by Commissioner Turner, seconded by
Commissioner Wilcox, the Court voted unanimously to approve the
Waiver of Competitive Bidding Requirements for the Macey Road
project.
On motion by Commissioner Turner, seconded by Commissioner
Wilcox, the Court voted unanimously to post signs on all County
parking lots which state "Brazos County Offices Customer Parking
Only. Improperly Parked Vehicles Towed At Owner's Expense."
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to adopt a resolution
authorizing the law firm of Vance, Bruchez and Goss to proceed with
condemnation proceedings on seven (7) tracts of land along FM 60.
A copy of the Resolution and description of the seven tracts of
land are atached to and made a part of thes minutes.

RESOLUTION OF THE COMMISSIONERS
OF BRAZOS COUNTY, TEXAS AT
MEETING HELD ON MAY 7, 1990

WHEREAS public convenience and necessity requires the widening and construction
of Farm-to-Market Highway 60 owned and maintained by Brazos County, Texas, such
widening and construction to be located in the Oak Hills Subdivision, Stephen Jones Survey,
Abstract No. 27, in Brazos County, Texas, and being more particularly described in Exhibits
"A", "B", "C, "D", "E", "F" and "G" attached to this Resolution and incorporated herein by
reference, with such widening and construction being part of the State Department of
Highways and Public Transportation and Brazos County established roadway improvement
project identified as the FM 60 Expansion Project; and
WHEREAS the FM 60 Expansion Project requires the taking of a portion of
privately owned land in the location described above and the acquisition and taking of said
property are necessary and appropriate for the public use described above; and
WHEREAS it is necessary that Brazos County, Texas appropriate and acquire the
land and rights-of-way and appurtenances, including without limitation making and causing
to be made final offers therefor and instituting and causing to be instituted any condemna-
tion proceedings that may be necessary for the acquisition of -the land, rights-of-way, or
appurtenances; and
WHEREAS Hubert Nelson, Inc. has made the following offers to property owners
for the right-of-way necessary for the widening and construction of the Farm-to-Market
Highway 60 in Brazos County, Texas:

The Texas Department of Highways and Public Transportation and Brazos
county are in the process of acquiring right-of-way for the widening of
FM 60 highway in Brazos County, Texas. Michael E. Saroka owns property
along said highway. Brazos County is negotiating with Mr. Saroka to
purchase a parcel of land from him for additional right-of-way to
complete this project.
During our title search we found that your organization holds a lien
against the property in question. It will be necessary to obtain a
partial release to complete the transfer of the property.
Enclosed you will find copies of the following documents:
1. Deed of Trust and warrant Deed.
2. Letter to Michael Saroka with plats and field note
description of property to be acquired.
