stable to appoint a committee to review current regulations
in regard to the issuance and enforcement of county road
permits and conduct a study to determine if all county road
and bridges are properly marked with regulatory signs, etc.
8. Consider and take action on request from Wellborn Water
Supply Corporation to install waterline in county right-of-
way of Peach Creek Cut-Off Road in Precinct 1.
9. Consider and take action on request from Lone Star Gas Com-

Company of the Southwest to install communication line in

SPECIAL MEETING
APRIL 30, 1990
A special meeting of the Commissioners'- Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, April 30, 1990, with the following members of the
Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.

Commissioner Sims gave the invocation and led the pledge of
allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held March 51 1990 and March 12,
1990. On motion by Commissioner Turner, seconded by Commissioner
Sims, the Court voted unanimously to approve the minutes as
submitted.
The Court next heard a request for a refund of ad valorem
i
taxes in accordance with Section 31.11 Vernon's Annotated Texas
Civil Status - "Erroneous Payments and Over Payments' submitted
by Joe Ferreri. Taxes in the amount of $976.80 were paid on
personal property for the years of 1982 through 1988 which Mr.
Ferreri did not own. Commissioner Sims asked if the County was

Mr. Durrant. He also asked if Mr. Ferreri could get his money
from Mr. Durrant instead. Buddy Winn, Tax Assessor/Collector,
said that the statute says that a tax payer may make application
to the Tax Collector. Commissioner Sims asked what happens if
Mr. Durrant does not pay. Mr. Winn replied that the county will
assess Mr. Durrant the full amount owed and if he does not pay
then the County will sue him. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously to
refund to Joe Ferreri $976.80 representing county taxes he
erroneously paid for the years 1982 throught 1988.
The next matter for consideration was the proposal for the
collection of delinquent ad valorem taxes for Brazos County. The
County Judge felt that if proposals are to be taken then he would
like to appoint a committee made up of representatives of the
Cities of Bryan and College Station, and representatives from the
School Boards of each school district to determine the best
action for the court to take regarding the cancellation of the
contract with Gates Steen. The County Judge then moved to
appoint a committee. Commissioner Sims seconded the motion.
Commissioner Norton stated he had no problem with the proposed
committee but felt no action should be taken until the contract
expires. The Tax Assessor/Collector mentioned that if the County
stays with Gates Steen, then Henry Steen, Jr. will have to sign a
contract as a partner in the Gates Steen Firm and familiarize
himself with all of the County's files. Commissioner Norton
suggested requesting proposals prior to the end of the contract
period. The County Judge stated he felt the other entities
needed a voice in the matter. Commissioner Sims asked the Tax
Assessor/Collector what the charge was for this service. Mr.
Winn answered that most firms charge 15% and enlist the help of
the Appraisal District employees to work returned mail in an
effort to locate the tax payers. Commissioner Sims said he would
like an experienced attorney to handle what is already filed.
He asked if Mr. Walker, who previously handled the County's
business while working for Gates Steen, could handle the County's

business on a monthly basis until the end of the contract period
which expires in December of this year. He was informed that Mr.
Walker agreed to do so. Mr. Winn stated he had cases filed that
needed service before the Judge dismisses them.* The County Judge
withdrew his motion and asked if Commissioner Sims would withdraw
his second. Commissioner Sims agreed to do so and then moved to
enter into contract with Albert Walker on a monthly basis through
December 1990 with the contract to become effective May 1, 1990.
Commissioner Norton seconded the motion which carried
unanimously.
The Court next considered a request from District Judges
Ruffino and McDonald to reconsider the order including the
District Judges in the County and District Retirement System but
not allowing them to claim prior service from the time they
became District Judges. Commissioner Sims felt that the court
should not reconsider the previous action. He then moved to not
reconsider the Order. Commissioner Norton seconded the motion.
Commissioners Sims and Norton voted "Aye". Commissioners Wilcox,
Turner and the County Judge voted "No" where upon the County
Judge announced the motion failed. Commissioner Turner moved to
reconsider and allow the District Judges to claim prior service
and to pay the amount required to match the funds the District
judges will pay in to the system. The motion was seconded by
Commissioner Wilcox. The County Judge along with Commissioners
Turner and Wilcox voted "Aye Commissioners Norton and Sims
voted "No". The County Judge declared the motion carried. A
copy of the amended Order is attached hereto.
It was the consensus of the Court to appoint Commissioners
Norton and Wilcox to serve on a committee to review the current
regulations regarding the county weight limit regulations as well
as HB 2060. The committee will include representatives of the
Sheriff's office, Constable's office, the County Attorney and the
Road and Bridge Department.
The Court next considered the request by Wellborn Water
Corporation to relocate water lines within the right-of-way of

Peach Creek Cut-Off Road in Precinct 1. The County Engineer
stated all was in order and the water company will bore under the
road bed. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve the
request of Wellborn Water Corporation and authorized the
installation. A copy of the request is attached hereto.
The Court next considered the request by Lone Star Gas
Company to install a gas line, across the right-of-way of Graham
Road in Precinct 1. The County Engineer stated all was in order
and the gas company will bore under the road bed. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the request of Lone Star Gas Company
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request by General Telephone
Company to install cable within and across the right-of-way of
Silver Hill Road in Precinct 4. The County Engineer stated all
was in order and the telephone company will bore under the road
bed. On motion by Commissioner Sims, seconded by Commissioner
Wilcox, the Court voted unanimously to approve the request of
General Telephone Company and authorized the installation. A
copy of the request is attached hereto.
The Court next considered authorizing work outside of county
rights-of-ways for the enhancement of county road projects. The
Road and Bridge Department requests permission to enter the
property of Mrs. Gerry Chandler on Old Reliance Road to remove an
old cattle guard and replace it with an 18" culvert to allow for
proper drainage in the ditch. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously to
authorize the work.
The Court proceeded to consider the change of status of the
following employees.

CONTRACT FOR THE COi.LECTION OF DELINQUENT TAXFc

THIS CONTRACT is made and entered into by and between BRAZOS COUNTY,
acting herein by and through its governing body, hereinafter styled First Party, and the
law firm of YOUNG & WALKER, P.C., Courtyard Atrium, Suite 140, 5910
Courtyard Drive, Austin, Texas 78731, hereinafter styled Second Party.
I.
First Party agrees to employ and does hereby, employ Second Party to enforce by
suit or otherwise the collection of all delinquent taxes, penalty and interest owing to
First Party; provided current year taxes falling delinquent within the period of this
contract shall become subject to its terms on the first day of July in the year in which
they become delinquent.
II.
Second Party is
to call to the
attention of
the Collector
of Taxes or other
officials any errors,
double assessments or other
discrepancies
coming under its
i observation during the
progress of the
work, and is
to intervene
on behalf of First
Party in all suits for
taxes hereafter
filed by any
taxing unit
on property located
within its corporate limits.
III.
i First Party agrees to pay to Second Party as compensation for the services
required hereunder fifteen percent (15%) of the amount collected of all delinquent
taxes, penalty and interest for the years covered by this contract, actually collected and
paid to the collector of taxes during the term of this contract, as and when collected.
All compensation above provided for shall become the property of Second Party at the
time payment of taxes, penalty and interest is made to the collector. The collector
shall pay over said funds monthly by check.
IV.
This contract shall be effective commencing on the 1st day of May, 1990, and
ending on the 31st day of December, 1990; provided, however, that Second Party shall
have an additional six months to reduce to judgment all suits filed prior to such
termination, and provided further that Second Party shall handle to the conclusion all suits
in which trial judgments are obtained during the period of this contract and which are
appealed by any party. In consideration of the terms and compensation herein stated,
Second Party hereby accepts said employment and undertakes the performance of this
contract as above written.
This contract is executed on behalf of First Party by the presiding officer of its
governing body who is authorized to execute this instrument by order heretofore passed
and duly recorded in its minutes.

On this the 30th day of April , 19 90 , the Commissioners
Court of Brazos County, Texas was convened in Special
session at a Special Term of said Court, with the following members
present, to wits

and at such session, among other proceedings, the following order was passeds
"Whereas, by virtue of an order of the Commissioners Court of
Brazos County, Texas adopted on the 30th day of April
19.. 2_0 , said County became a participating subdivision in the Texas County
and District Retirement System; and
Whereas, at said date of participation persons holding State or District
offices who receive supplemental compensation from County funds in addition
to the compensation received by them from the State of Texas were not eligible
to be included, and in consequence were not included as employees of said
County in the Texas County and District Retirement System; and
Whereas, by enactment of Chapter 522, Acts Regular Session, 62nd Legisla-
ture, the County has now been authorized on the terms therein stated to provide
for inclusion of such State and District offices in the Texas County and Dis-
trict Retirement System to the extent of the compensation paid each such person
by the County, and the Commissioners Court of Brazos County has
determined that it is to the public interest that such officials be so included;
it is therefore,
ORDERED BY THE COMMISSIONERS COURT OF Brazos COUNTY, TEXASt
"1. Pursuant to the provisions of Section 842.201 of Texas Government
Code, Title 8, Subtitle F. Revised Civil Statutes, Rra .n s County
hereby elects to include in the Texas County and District Retirement System
effective the 1st day of March , 19 90 (the effective date
of this order) all persons regularly engaged in the performance of the duties
of an elective or appointive State or District office (and who are members
of Judicial Retirement System) who, in addition to the compensation received
from the State of Texas, are paid supplemental compensation from County funds
of said County; and all such persons shall be considered to the extent of
• the compensation paid to such person by the County, to be employees of said
County within the meaning of said Act, and as such eligible for membership
in the Texas County and District Retirement System.

"2.(a) Every person who is, on the effective date of this order as above
specified, within the class designated by this order to be included in the
Texas County and District Retirement System, shall become a member of said
System, as an employee of Brazos County, unless such person, within
thirty (30) days from the effective date of this order, shall execute and
file with the Director of said System a written waiver of membership, in such
form as the Board of Trustees of said System may prescribe. Any person who
files a waiver of membership as hereinabove provided, may subsequently apply
for membership in said System as of the first day of any month thereafter
and, if such person would then be eligible for membership in the System as
a beginning employee of said County, may thereupon become a•member of the
System at that date but without credit for any service antedating the date
of membership.
"(b) Every person who subsequent to the effective date of this order
becomes for the first time an employee of said County by reason of an employment
described hereinabove, shall become a member of Texas County and District
Retirement System at the date of such employment.
"3. Any person who becomes a member of Texas County and District Retire-
ment System pursuant to this order shall not be allowed credit for service
rendered prior to the effective date of this order, unless within ninety (90)
days after the effective date of said order:
"(a) For each and all months that such person performed services as
an employee of said County between the effective date of this County's partici-
pation in Texas County and District Retirement System and the effective date
of this order, such person shall pay over and deposit with said System a sum
equal to the deposits which a member of the System drawing the same compensation
from the County during the same period was required to make to said System;
and
"(b) Brazos County within the ninety (90) day period
from the effective date of this order shall contribute to the System an amount
equal to, and for the purpose of matching, the deposits made by the member
pursuant to paragraph 3(a), above.
"In the event the deposits mentioned in paragraphs 3(a) and 3(b) are
made within the time specified, the sum so deposited by the member shall be
credited to his individual membership account in the Employees Saving Fund
of the System, and such member shall be allowed current service credit for
each month of service from which his said deposits derive; and the matching
deposits made by the County shall be deposited to its account in the Subdivision
j Accumulation Fund of the System.

"4. Any person who becomes a member of the System pursuant to paragraphs
1 and 2 of this order, and who shall make and cause to be made the deposits
specified in paragraphs 3(a) and 3(b) above, shall be entitled to receive,
/ and is hereby allowed, credit for "prior service" rendered to this County
•
prior to its participation in said System, and upon certification of his prior
service in the manner provided by law and the Rules and Regulations of said
System, shall be allowed an Allocated Prior Service Credit determined in the
same manner and on the same percentage of Maximum Prior Service Credit as
was used in determining the Allocated Prior Service Credit of those employees
of the County who became members of said System on the date of this County's
participation therein.
"Each such employee who claims "prior service" credit for service performed
before the effective date of participation prescribed above shall promptly
file with the Auditor 1 a detailed written statement (on such forms
as are prescribed by or under the direction of the Board of Trustees of the
System) of all such prior service. The Auditor 1 is hereby authorized
and directed to verify each such statement of prior service claimed, and upon
being satisfied that the same is correct, to certify to the Board of Trustees
of the System on behalf of this Countyt (a) length of "prior service" for
which credit is allowed by this County to the employee-member (stated in terms
of months of such service), and (b) the "average prior service compensation"
of the employee-member, to be computed and reported as directed by the Board
of Trustees of the System.
"S. Member contributions of each person who becomes a member of Texas
County and District Retirement System by virtue of this order shall be made
to the System for each payroll period from and after the effective date of
this order, at the rate of contribution prescribed for all employees of this
County, upon all compensation (not exceeding the maximum compensation for
the period applicable to other employees of the County) which said person
receives out of County funds; and the Treasurer 2 shall collect such
member deposits, and shall transmit the same to the System, as provided in
Sections 845.402 and 845.403 of Texas Government Code, Title 8, Subtitle F.
Revised Civil Statutes, as amended."
The above order being read, it was moved and seconded that the same do
pass and be adopted. Thereupon, the question being called for, the following
members voted Ayes Commissioner Turner, Commissioner Wilcox , County Judge ,
and ; and the following voted Not
Commissioner Sims and Commissioner Norton.

(Applicant), proposes to place a WATERLINE
within the right-of-way of PEACH CREEK CUT-OFF (name of
road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (21) below
the center of the roadway.
7. That ill sites will be barricaded during the construction period.
Construction of this line will begin on or after the 1st day of

particular precinct, might be on hand to designate the actual location
of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer and
Commissioner in which the roadway or right-of-way lies.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Beginning at GTE Sta. 0+00 in the west ►ight-of-way of Silver Hill Road
approximately 900' northwest of Leonard Road and proceed in a northeast
direction to Cross Silver Hill Road to GTE Sta. 0+20.At GTE Sta. 0+20
dig bore pit and bore asphalt to GTE Sta. 0+60 to a receiving pit then
proceed northeast to GTE Sta. 0+80 and right-of-way. Then turn southeast
and plow cable parallel to and 3' inside right-of-way for distance of 230'
to GTE Sta. 3+10 and stop. This cable is to be buried a minimum depth of
30" and road bore a minimum depth of 4'.
The location and description of this line: and associated appurtenances is
more fully shown by two copies of drawings attached to this notice.
The line will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that tender of this notice by the General Telephone Company of the
Southwest does not constitute a waiver, surrender, abandonment or impairment of
any property rights, franchise, easement, license, authority, permission,
privilege or right now granted by law or may be granted in the future and any
provision or provisions so construed shall be null and void.
