SPECIAL MEETING
MARCH 26, 1990
A special meeting of the Commissioners'' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, March 26, 1990, with the following members of the
Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4, Absent;
Frank Boriskie, County Clerk, Absent. -
The following citizens and officials were in attendance:

Janet Natowitz League of Women Voters
Commissioner Sims gave the invocation and led the pledge of
allegiance.
The Court recognized Ms. Shirley Plapp, Vice President of
Programs for the League of Women Voters, who presented a list of
recommendations regarding voting procedures in Brazos County.
Ms. Plapp stated this was a consensus position on the election
process. She went on to enumerate some of the concerns, voting
rights, planning, monitoring, replacement of voting equipment,
appointment of County Election Administrator and proper education
for election officials. The County Judge stated that no one
disagreed with the recommendations of the League's report. He
continued by saying that a big problem is getting people to
volunteer to be election judges and clerks. He asked if the
league members would serve as a pool for election personnel.

Commissioner Sims stated that if an election administrator is
appointed he/she will be appointed by an election commission. He
then recommended putting together a committee including the
election commission and expand it to include local citizens to
review the 1987 McFall study and the League study then come up
with a proposal to the Commissioners Court. Commissioner Sims
then made the motion to form the committee. The motion was
seconded by Commissioner Norton who amended it to charge the
committee to explore all avenues and include a budget. The
motion carried unanimously.
The Court next considered Budget Amendment #5 to the 1990
budget, which would reallocate funds budgeted for the County
Court at Law #2 Department and the Jail. On motion by the County
Judge, seconded by Commissioner Sims, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which is
attached hereto.
On motion by Commissioner Wilcox, seconded by Commissioner
Sims, the Court voted unanimously to appoint Donald Lampo to the
Board of Commissioners of Rural Fire Prevention District #2 to
fill the unexpired term of Vincent Marino and reappoint Hawley
West and Raymond McCallan whose terms expired December 31, 1989.
On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to renew the contract with
Retired Senior Volunteer Program of Brazos County (RSVP).
Contract period will be from January 1, 1990 to December 31,
1990. Brazos County will make a total lump sum payment of
$2,250.00 to RSVP on or before April 30, 1990. RSVP will provide
the following services:
a. Volunteer assistance to all residents of
Brazos County with tax preparations.
b. Volunteers assisting where needed in the
schools.
c. Senior volunteers serving as active members
of the County Extension Aging Committee.
d. Senior volunteers assisting at the Bryan
Library
e. Senior volunteers assisting with youth
activities.
f. Senior volunteers assisting with commodities.
g. Senior volunteers assisting with clerical
needs.

The Court next considered the request by General Telephone
Company to install a buried communication cable within the right-
of-way of Leonard Road in Precinct 4 and Cliff Road in Precinct
3. The County Engineer stated all was in order. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the request of General Telephone
Company and authorized the installation. A copy of each request
is attached hereto.
On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to accept the Right-of-Way Deed
to an easement for the purpose of expanding and improving Greens
Prairie Road in Precinct 1. In exchange for the easement donated
by Betty V. Goss, B. F. Vance, Jr.and W. R. Vance, Co-Independent
Executors of the Estate of Vonnie Ray Vance, Deceased, the County
will re-fence the Vance property along Greens Prairie Road prior
to removal of the existing fence.
The Court next considered authorizing work outside of county
rights-of-ways for the enhancement of county road projects. The
Road and Bridge Department requested permission to enter the
property of Duane Peters on Weedon Loop to clean an outlet
channel to allow water to drain from an 181 culvert under the
roadway. The Road and Bridge department requested permission to
enter the property of Mike Saroka on Welcome Lane to excavate an
outlet channel downstream from two (2) 481 culverts under Welcome
Lane. The Road and Bridge Department also requested permission
to enter the property of J. L. Pausewang on Welcome Lane to
dispose of excess material from road and ditch construction. On
motion by Commissioner Sims, seconded by Commissioner Wilcox, the
Court voted unanimously to authorize the work.
The County Judge told the members of the Court that Walter
Wilcox was named Safety Coordinator a number of years ago. He
congratulated Commissioner Wilcox for a job well done then the
County Judge read aloud a Resolution honoring those employees who
have gone accident free for the last two (2) years. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to honor those employees who have gone accident

attached hereto.
The Court proceeded to consider the change of status of the

Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on March 26, 1990, the Court heard and
approved a budget amendment for the 1990 budget year for Brazos
County,-Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 22,
1989, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

CONTRACT FOR VOLUNTEER SERVICE
•
Brazos County, Texas hereinafter referred to as Volunteer Station
and the Retired Senior Volunteer Program of Brazos County
Community Council, hereinafter referred to as RSVP for the
covenants and consideration herein expressed, mutually agree to
the following terms and conditions:
I
The Volunteer Station agrees to pay the total sum of $2250.00 to
RSVP in a single payment on or before April 30, 1990. All
payments will be payable to the Retired Senior Volunteer Program
and mailed to their current address.
II
RSVP agrees to provide the service to its program to the
Volunteer Station. There is not established any definite program
of assignments. But, the number of volunteers and assignments
can be changed throughout the term of this contract by agreement
of all parties. RSVP does agree to make every effort to arrange
for the number of volunteers and assignments which are being
performed or contemplated at the time of this agreement.
A. Volunteer assistance to all residents of Brazos
County with tax preparations.
B. Volunteers assisting where needed in the schools.
C. Senior Volunteers serving as active members of the
County Extension Aging Committee.
D. Senior Volunteers assisting at the Bryan Library.
E. Senior Volunteers assisting with youth activities.
F. Senior Volunteers assisting with commodities
distribution throughout the community.
G. Senior Volunteers assisting with clerical needs.
The terms of this contract will be January 1, 1990 to December
31, 1990.
III
Any invention of literacy or artistic production arising out an
assignment shall be the exclusive property of the Volunteer
Station, and the Volunteer shall have the right to produce
additional copies and distribute to the general public.
Volunteer Station may consent to other uses by the Volunteer.
IV
Volunteers shall comply with all the rules and standards
exercised by the employees in the department to which she or he

The County Judge or his delegate shall have the authority to
1 represent the Volunteer Station and to make whatever further
agreements necessary to administer and effectuate the terms and
conditions set for herein.
VI
The Volunteers will not receive any pay from the Volunteer
Station for their services, and they will not be considered an
employee and this service will be considered as a voluntary
contribution to the betterment of the community and the public
purpose of the County.
VII
Since the Volunteer is not a part to this agreement, Volunteer
Station may require Volunteers who accept service to sign other
instruments setting forth other terms and conditions between the
Volunteer Station to amend or rescind this contract by mutual
agreement.
IN WITNESS WHEREOF, the parties to this agreement have set their
hands for 1990, the 1 day of March, 1990.

Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:-
On Cliff Road.810 ' West of Opersteny Road, a buried cable will be
placed in the north right-of-way. The cable will extend west fora
distance of 943'. Cable will be placed 4' of right-of-way 30" deep.
The location and description of this line and associated appurtenances is
more fully shown by two copies of drawings attached to this notice.
The line will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that tender of this notice by the General Telephone Company of the
Southwest does not constitute a waiver, surrender, abandonment or impairment of
any property rights, franchise, easement, license, authority, permission,
privilege or right now granted by law or may be granted in the future and any
provision or provisions so construed shall be null and void.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Beginning at GTE Sta. 0+00 at the intersection of Leonard and Silver
Hill Road in the southwest most corner and proceed in a northwest direction
and bore under Silver Hill Road at a depth of seven feet under roadbed a
distance of fifty feet then place buried cable along and five feet within
the northwest most right-of-way of Leonard Road to GTE Sta. 30+92 for a
total distance of 3,092 feet. This cable is to be buried a minimum depth
of 30".
The location and description of this line and associated appurtenances is
more fully shown by two copies of drawings attached to this notice.
The line will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that tender of this notice by the General Telephone Company of the
