(b) Deer Park Road - Deer Park Subdivision
5. Consider and take action on work outside of county rights-
of-ways for the enhancement of county road projects.

COMMISSIONERS' COURT
SPECIAL MEETING
FEBRUARY 26, 1990
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, February 26, 1990, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk, Absent.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge of
allegiance.
The Court first considered approval of the construction
agreement between the City of Bryan, Texas Department of Highways
& Public Transportation and Brazos County for right-of-way for FM
1179. The State Department of Highways & Public Transportation
plans to widen FM 1179 to a curb and guttered four (4) lane with
continuous left turn lane roadway. The construction plans call
for slope work adjacent to the Brazos Center with an encroachment
of approximately thirty (301) feet into the Brazos center
property. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve the
construction agreement and authorized the County Judge to execute
the agreement on behalf of Brazos County. A copy of the
agreement is attached hereto.
The Court next considered the request by Wellborn Water
Supply Corporation to install a water line, within the right-of-

way of Cherokee Drive in Precinct 1 and a water line within the
right-of-way of Deer Park Road in Precinct 1. On motion by
Commissioner Norton, seconded by Commissioner Wilcox, the Court
voted unanimously to approve the request of Wellborn Water Supply
Corporation and authorized the installation. A copy of each
request is attached hereto.
The Court next considered authorizing work outside of county

rights-of-ways for the enhancement of county road projects. The
Road and Bridge Department requests permission to enter the Terry
Stiles property on Walnut Road to drain the bar ditches. The
Road and Bridge Department requests permission to enter the J. T.
Lange property on Kurten Lane to drain the bar ditch. On motion
by Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to authorize the work.
The Court received, approved and ordered filed as submitted
the Treasurer's report for January 1990. A copy of which is
attached to and made a part of these minutes.
The Court proceeded to consider the change of status of the
following employees.

Dear Judge Holmgreen:
The State Department of Highways and Public Transportation
forwarded the attached construction' agreement to my office for
execution. The S.D.H.& P.T. plans to widen F.M. 1179 to a curb and
guttered four (4) lane with continuous left turn lane roadway.
Their construction plans call for slope work adjacent to the Brazos
Center. This work activity would encroach approximately thirty feet
(30') into the Brazos Center property. Therefore, they need to
obtain the permission of Brazos County's in order for them to
proceed with this work. The net effect of this work is the movement
of the existing roadway "toe of slope" laterally approximately
thirty feet.
I am forwarding the enclosed "Construction Agreement" for your
consideration and subsequent execution. Please contact Mr. D.D.
Williamson, District Planning Engineer, S,D.H.& P.T. at 768-2165
should you require additional information prior to your execution
of this instrument. We appreciate your cooperation in this project
that will benefit all Brazos County citizens.

CONSTRUCTION AGREEMENT
The reconstruction of FM 1179 to bring it into conformance with State
and Federal design standards, requires the flattening of the side slopes
as indicated on the Attached Sketch. To accomplish the desired improve.
ments, it will be necessary to enter your property to construct the
desired slope.
It is the City of Bryan's responsibility to obtain any additional
right of way. The City has agreed to obtain temporary easements and
to remove and replace all fence adjacent to the roadway where desired
by the property owners.
The State or its agent will construct the slopes and provide erosion
.control measures by sodding and seeding the exposed soil.
The area required for slope easement is shown in the attached Sketch
from approximate stations 11+00 to 17+00.
This agreement executed by the following parties will serve as a right
of entry to permit the City and the State to construct the proposed
project.

construction in order that he, along with the Commissioner of that
particular precinct, might be on hand to designate the actual location
of the Installation.
That all damage to the roadways and right--of-way will be repaired to
their original condition to the satisfaction of the County Engineer and
Commissioner to which the roadway or right-of-way lies.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should ease become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines In the right-of-way.
S. That the line will be constructed and maintained on the county right-
of-way In accordance with governing laws.
6. That the line or lines will be constructed no lose than forty-eight
inches (08") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (I') below the
center of the roadway.
