SPECIAL MEETING
JANUARY 22, 1990
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in, the Commissioners' Courtroom in. the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, January 22, 1990, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.

Commissioner Sims gave the invocation and led the pledge of
allegiance.
The Court first considered additional benefits to the health
insurance program for Brazos County employees. David Atkinson of
Anco Insurance Service explained the additional benefits to be
available to the employees. With the implementation of the
Preferred Provider Option (PPO) program employees will have a
composite $600.00 per family deductible, receive a 158 discount
for using St. Joseph Hospital and receive a 108 discount for
using any one of the physicians listed in the general information
provider directory. The result is a $3.78 increase to the
premium cost per employee and a $2.28 decrease to the claim cost.

collect from Brazos County and passed on to Alliance Health
Providers. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to approve and
adopt the amendment to the current health insurance plan and set
the implementation date for March 1, 1990.
Ramiro Quintero again asked to postpone his presentation to

the Court.
Richard Rosas, owner and operator of Rosas Trucking, asked
the Court to consider a weight limit of 58,420 pounds on all
county roads. Mr. Rosas owns and hauls from a pit located on
Rock Prairie Road which has a current weight limit of 30,000
pounds. Over the years Mr. Rosas stated he helped the previous
commissioner put down asphalt and install culverts and because of
that, the road is in much better shape now than ever before.
Commissioner Norton asked the County Engineer if the subgrade on
Rock Prairie Road could handle 58,420 pounds. The County
Engineer answered no, that a base material of five (5) to eight
(8) inches was needed to withstand the 58,420 pounds. Mr. Winder
was referring to that portion of.Rock Prairie Road within the
city limits of College Station that is County maintained. The
County Judge thanked Mr. Rosas and stated the County would study
the road problem and load limit.
The Court next considered Budget Amendment #21, which would
increase the ENTERP Contract by $650.00, increase the budget of
the Fire Protection department by $1,785.00, and reallocate fund
in the 361st District Court. On motion by Commissioner Turner,
seconded by Commissioner Norton, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court next considered renewal of the contract with the
Texas Department of Human Services for the provision of
protective homemaker services. The contract period is February
1, 1990 through August 31, 1991. The contract amount is
$43,255.00 which is fully funded by the state. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court

voted unanimously to approve the contract for the period stated
i and authorized the County Judge to execute it on behalf of Brazos
County. A copy is attached hereto.
The Court next considered a Wavier of Competitive Bidding
Requirements as provided in the Local Government Code, Section
262.024(a)(4) for the purchase of the personal and/or
professional legal services. On motion by Commissioner Wilcox,
seconded by Commissioner Sims, the Court voted unanimously to
approve the Waiver of Competitive Bidding Requirements and
purchase the services of Hubert D. Nelson DBA H. Nelson, Inc. for
acquisition of right-of-way for the Macy Road Project.
The Court next considered the request by Wellborn Water
Supply Corporation to install a water line within the right-of-
way of High Prairie Road in Precinct 1. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of Wellborn Walter
Supply Corporation and authorized the installation. A copy of
the request is attached hereto.
The Court next considered the request by United Telephone
Company to install buried communications cable within the right-
of-way of Peach Creek Road in Precinct 1. All paved road will be
bored under from ditch line to ditch line a minimum distance of
thirty (30) feet. On motion by Commissioner Norton, seconded by

Commissioner Turner, the Court voted unanimously to approve the
request of United Telephone Company and authorized the
installation. A copy of the request is attached hereto.
! The Court next considered the request by General Telephone
Company to install a communication line within the right-of-way
from the intersection of Macey Road and Old Bundick Road on Old
Bundick Road in the north right-of-way extending for a distance
of 4,320. Cable will be buried at a depth of 300. The location
of the work is in Precinct 2. Commissioner Wilcox asked why the
variation on the depth of installation between utility lines, oil
4 lines and communication lines. Commissioner Wilcox said he would

The Court next considered authorizing work outside of county
rights-of-ways for the enhancement of county road projects. The
Road and Bridge Department requests permission to dump and spread
two loads of crushed limestone on the parking lot in front of the
Millican post office. On motion by Commissioner Norton, seconded
by Commissioner Sims, the Court voted unanimously to authorize
the work.

Commissioners' Court minutes January 22, 1990
Commissioner Sims questioned the bill to Sausares for the
rental of a water machine. He suggested that the District Court
pay for the water. On motion by Commissioner Norton, seconded by
Commissioner Wilcox, the Court voted unanimously to approve the
Claims as submitted.
At 10:50 a.m. the County Judge announced the meeting closed
to the public so that the Court could meet in closed executive
session to discuss personnel.
At 11:16 a.m. the County Judge announced the meeting open to
the public and that no action would be taken on the closed
session.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 22nd day of January 1990 at a special meeting ofd the
Commissioners` Court, the following members were present:

THAT WHEREAS, on January 22, 1990, the Court heard and
approved a budget amendment for the 1989 budget year for Brazos
County, Texas.
WHEREAS, an emergency expenditure is necessary due to grave
public necessity to meet unusual and unforeseen conditions which
could not be reasonably included in the original budget adopted
September 29, 1988, the following amendment(s) to the original
are hereby authorized, as described on the attached 1 page(s).

Contract No. 06-511-9-00
The Texas Department of Human Services and Brazos County entered
into a contract effective January 1, 1989, through October 31, 1989,
for the provision of protective homemaker services, extended by plan
change amendment through January 31, 1990. Both parties mutually
agree to amend this contract as stated below.
The contract will be renewed for the period of February 1,
1990, through August 31, 1991. The allocation for the
contract period will be $43,255.00. Fiscal Year allocations
will be as follows:
Fiscal Year 1990 $15,767.00
Fiscal Year 1991 $27,488.00
TOTAL MAXIMUM REIMBURSABLE AMOUNT OF CONTRACT $43,255.00
In addition, it is agreed that if funds are available and if
the program director gives prior approval, the budget line
item allocations, including the salary authorized for the home
care specialist, may be increased during the contract period
without a required increase in the amount of services to be
provided.
The parties mutually agree that all terms and conditions of the
original contract not in conflict with the terms of this renewal
amendment shall remain in full force and effect.
In their capacities as stated below, the parties affix their
signatures and bind themselves.

The location or description of the proposed installation Is sore fully
shown by 1 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer suet be notified 72 boars prior to the beginning of
construction in order that he. along with the Commissioner of that
particular precinct, sight be on hand to designate the actual location
of the Installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer and
Commissioner in which the roadway or right-of-way lies.
7. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County. should same become
necessary due to wideuing or lowering, or other alteration of the
roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of-way In accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lover than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below the
center of the roadway.
7. That all sites will be barracaded during the construction period.

Formal notice is hereby given that the United Telephone Company of Texas.
Inc. proposes to install buried communications Cable upon and along the
right-of-way of county roads in BRAZOS County, Texas.
as follows:
IMPROVED ROADS (paved) - The contractor will plow cable in backslope with
8' of right-of-way line. Pipe will be bored under all paved county roads
extending from ditch line to ditch line with a minimum of 30".
IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope
of the road. one track of the plow tractor on the backslope the other may
come to the shoulder of the road neither whole tractor nor plow will be on
the road surface.
UNIMPROVED ROADS (dirt) - Same as improved. unless, because of ditches.
trees. and other terrian features. it is more practical to plow in center
of road. In these cases, the cable will be plowed in the center of the
road. Not applicable in County.
BRUSH DISPOSAL - Any brush. trees, etc.. that are cut will be burned or
disposed of and not left in the ditch. Rocks brought up by tractor or
plow will be disposed of.
DEPTH OF CABLE - All cables will be placed at a minimum depth of 30"
except where crossing dams or ditches, at which locations the depth cable
will be at a minimum of 36".
The following are requirements which are made on the contractor:
1, The plowing equipment shall be subject to the approval of the
Engineer and the Public Authorities having jurisdiction over highway
and road rights-of-way.
2. The equipment and constructions methods use by the constractor shall
be such as to cause minimum displacement of the soil. The slot made
in the soil by the cable.
3. Damage to banks, ditches, driveways, and roads caused by the equipment
shall be immediately repaired to the satisfaction of the Engineer and
Public Authorities having jurisdiction over highway and road right-of-
way where involved.
4. Trenches shall be promptly back-filled with earth, and mechanically
tamped at six (6) inch lifts so that the earth is restored to original
grade to assure no hazzard to vehicular, animal. or pedestrian traffic.
No trenches shall be left open overnight.
5. The usual 10% fees withheld from contractor until repairs are made
satisfactory with engineer and Public Authorities have jurisdiction of
right-of-way involved. •

BRAZOS County will not be held liable
at any future
date for accidental damages to the buried cable plant
by road working
equipment such as maintainers, hole diggers, etc. In
the event of
such damages the Telephone Company will be notifited
immediately.

The County Commissioners Court may require the owners
to relocate this
line, for valid reasons under the law, by giving thir
ty (30) days
•
written notice.
a. Where communication facilities are located on
county
road ROW the Telephone Company will relocate
said
facilities at no expense to the County.
b. Where communication facilities are located on
private
property the County will reimburse the Teleph
one Company
for the relocation of said facilities.
At any place where a communications line crosses over a county road, it
shall be constructed and maintained at least eighteen (18) feet above
the surface of the traffic lane.
Please, notify forty-eight (48)
hours prior to starting construction of the line. in order that a
representative may be present.
The locations of the proposed lines are more fully shown by the copies
attached to this notice.
Construction of this line will begin on or after the 15TH day of
FEBRUARY , 1990.

Formal notice is hereby given that GENERAL TELEPHONE COMPANY of the SOUTHWEST
will construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
From the intersection of Macey Road and Old Bundick Road, a buried cable
on Old Bundick in north right-of-way extending east for a distance of 4,320'.

provision or provisions so construed shall be null and void.
